File Note: The industry has applied for fresh ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, under Green Category for manufacturing of for operation of a Warehouse, as products, along with requisite document. The industry has establish its unit without obtaining ‘Consent to establish’ from PPCB and has directly applied for obtaining ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. The industry has deposited Rs. 37800/- vide UTR no. 000938824066 dated 15.06.2024 and Rs. 16800/- vide R. no. 24081964 dated 02.02.2024 under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 34100/- vide UTR. no. 000938823822 dated 15.06.2024 and Rs. 16800/- vide R. no. 629590926 dated 02.02.2024 under the Air (Prevention & Control of Pollution) Act, 1981, which is adequate upto 31.12.2027,(Considering NOC regularization fee and Penalty of Rs. 46200/-) for both the Acts against the assets of Rs. 77 lakhs (including annual rent of Rs. 67 lakhs) on 30.12.2026. While processing the application, the industry was raised clarification and the reply submitted by the industry w.r.t to the said observation as under: ‘Undertaking for the lease of premises. Sir We are running warehouse M/s Abbott Healthcare Pvt. Ltd., Village- Nimbua, Derabassi, SAS Nagar on lease from Kalsi warehousing corporation since 23rd July 2020. Thus, all documents (like CLU, layout plan) are in the name of Kalsi Warehousing Corporation. We have attached all the documents CLU, Map and required fee for air & water consents (fee receipt enclosed). ‘ Suitability of Site: The industry has submitted a copy of CLU issued by Department of Town and Country Planning, Punjab to M/s Kalsi Warehousing Corporation vide memo no. 6126 dated 18.07.2008 for warehousing purposes. Further, the industry has submitted a copy of layout plan approved by Chief Town Planner, Punjab vide letter dated 10.09.2008 for Kalsi Warehousing Corporation in an area of 5.06 acres. As such, the site of the industry is suitable. The industry has also submitted a copy of lease agreement dated 23.07.2020 executed between M/s Kalsi Warehousing Corporation and Abbott Healthcare Private Limited, which is valid upto 31.07.2026. Visit: Accordingly, the industry was visited by AEE of this office on 06.02.2024 and during visit, it was observed as under: 1. The project is a warehouse and was in operation during the visit. 2. The project proponent has installed one no. of tubewell in its premises and flowmeter is yet to be installed with the same. 3. The project proponent has constructed septic tank, after which domestic effluent is used onto land for plantation within premises. 4. The project proponent has installed any boiler, furnace, paint booth, powder coating etc., or any source of air pollution in its premises. 5. The industry has installed 02 no. DG sets of capacities 250 KVA & 180, which is provided with canopies and stack of adequate height. From above, it is clear that the industry is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Recommendations: In view of above, if may approved, the industry may be granted fresh ‘consent to operate’ granted to the industry under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, upto 31.12.2025 with usual conditions & with following special conditions: 1. The industry shall not carry out any activity, which can change in category from Green to Orange or Red, under any circumstances. 2. The industry shall established its unit only in Khasra nos. for which the industry has obtained change of land use and lay out plan approval from the Department of Town and Country Planning. 3. The industry shall comply with the by-laws of Master Plan, Derabassi as well as the guidelines of Department of Town & Country Planning, at all times. 4. The industry shall not generate and discharge any kind of trade effluent from its premises and shall discharge only domestic effluent onto land for plantation in its premises after passing through septic tank. 5. The industry shall not discharge the effluent into any drain/choe/nallah, in any case. 6. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances. 7. The industry shall ensure that no problem related to pollution is being caused by the unit due to its operation and no public complaints are received by the Board in this regard. 8. The project proponent shall comply with the guidelines issued by PWRDA and shall obtain permission from PWRDA for abstraction of ground water (as applicable). 9. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time. 10. The industry shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time. 11. The ‘consent to operate’ is being issued to the project proponent based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing. 12. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent. *Competency- Environment Engineer, (Small, Green)
