File Note: It is submitted that brick kiln is a Small Scale / Orange Category existing unit. It has already been obtained the Consent to Operate under the Air (Prevention & Control of Pollution) Act, 1981 vide No. CTOA/Renewal/LDH2/2022/18541257 Dated 10.05.2022 which is valid upto 30.09.2031 for manufacturing of Bricks & Tiles @ 40000 Numbers/Day. Now, The brick Kiln has applied for fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 for manufacturing of Bricks @ 40,000 Nos/Day using Clay, Sand, Coal and Paddy Straw Pellets as fuel alongwith required documents & Fee as under:- 1. The Brick Kiln is an existing unit Since April, 1999. 2. The Brick Kiln has submitted the copy of Location Plan, Manufacturing Process and copy of License issued by Distt. Controller Food Civil Supplied & Consumer Affairs, Ludhiana. 3. The kiln has provided a induced draft technology with Zig-Zag firing. 4. The brick kiln has submitted completion certificate of dated 30.04.2019 issued by CSIR-Central Building Research Institute, Roorkee. 5. The Brick Kiln has already been submitted the copy of lease deed with Air consent application which is valid upto 31.12.2025. 6. As per DTP, Ludhiana letter No. 1240 DTP(L) dated 22.04.2014, the site of the brick kiln falls in residential Zone as per proposed Master Plan of Samrala (2010-2031). The brick kiln is in operation before July, 2007, hence the brick kiln may continue its operation for 10 years. The Master Plan, Samrala was notified as per Govt. of Punjab, Department of Town and Country Planning Punjab notification circulated vide No. 3009-3100 CTP(PB)/SS-64 dated 6.7.2015 and thereafter the Govt. of Punjab, Department of Legal and Legislative Affairs, Punjab Notification dated 21.10.2016 the time period has been extended from 10 years to 15 years (copy attached). 7. The value of Fixed assets of the Brick Kiln is Rs. 49.25 Lacs as on 15.01.2024. 8. As per MoM taken by Chairman of the Punjab Pollution Control Board on 28.1.2020 in the Committee Room, Vatavaran Bhawan, Nabha Road, Patiala with the Punjab Brick Kiln Association regarding compliance of Govt. orders dated 28.05.2019- The Brick kiln owner is required to deposit the consent fee for obtaining consent to operate under the Water (Prevention& Control of Pollution) Act, 1974 w.e.f. 01.11.2018. 9. In light of Sr.No. (7) above, the Consent fee deposited by the Brick Kiln of Rs. 27,700/- vide Receipt No. 918131459 dated 30.01.2024 (Rs. 25,200/- Consent fee Water + Rs. 500/- consent form fee) and Rs. 6,900/- vide Receipt No. 136029794 dated 06.02.2024 as balance penalty amount. Hence, the consent fee is adequate upto 30.11.2025. 10. It has already been deposited Rs. 2900/- as NOC Regularization fee due to increased fixed assets with Air Consent case vide UTR No. SBIN422110178849 dated 20.04.2022. To verify the facts, the site of the Brick Kiln was visited by the undersigned on 02.02.2024 and Sh. Harkunwar Deep Singh, Representative of the Brick Kiln was contacted. During visit it was observed as under:- 1. The Brick Kiln was not in operation and stacking of Bricks inside the Kiln observed. 2. The brick kiln has not started the firing to kiln yet. 3. He gave his comments on visit report that he will not operate his kiln without using paddy straw pellets. 4. The Brick Kiln is complying with the Code of Practice Prescribed for Brick Kilns. 5. It has provided the Septic Tank to treat the domestic effluent and treated domestic effluent is discharged onto land for Plantation. Keeping in view of above, it is recommended that the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 may be granted to Brick Kiln upto upto 30.09.2025 with usual conditions and special conditions that:- 1. The BKO will comply with all the code of practice prescribed by the Board for Brick kilns all times. 2. The BKO shall use small spoon for feeding of fuel. 3. The BKO shall use only crushed coal and paddy straw pellets as per notification issued by the Govt. as fuel in the brick kiln. Small Scale/Orange Category. Competency: EE, RO.
