File Note: Earlier, the industry was earlier granted ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/SAS/2021/16236875 dated 15/08/2021 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/SAS/2021/16236859 dated 25/08/2021, both having validity upto 30/06/2025, for manufacturing of Atenolol @ 100 Kgs/day, subject to certain conditions mention therein. Now, the industry has applied obtaining Varied ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, for manufacturing of Dextroprop oxyphene hydrochloride @5000 Kg/Year, Dextroprop oxyphene nypsylate @ 2900 Kg/Year, Diphenoxylate hydrochloride @ 2000 Kg/Year, Aceclofenac @ 2600 Kg/Year, Dichlofenac sodium @3180 Kg/Year, Atenolol @ 2000 Kg/Year and Paracetamol @ 6000 Kg/Year. As per record file, earlier, the industry had deposited consent fee, which has valid upto 30.06.2026. The industry has now deposited Rs. 119300/- vide UTR. no. AXOIC40193593171 dated 19.01.2024 under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 97200/- vide UTR. no. AXOIC40193593176 dated 19.01.2024 under the Air (Prevention & Control of Pollution) Act, 1981, against the total value of fixed assets of Rs.7.42 cr. The fee deposited by the industry is adequate upto 30.06.2028 (including NOC regularization fee of Rs. 21600/- for increase in value of the fixed assets of Rs. 98.58 lakhs to 7.42 cr. on 11.01.2024.) Suitability of Site: The site of the industry is located in industrial focal point, Derabassi, thus, the site of the industry is suitable varied ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Status of EIA Clearance/Change of product mix: The industry namely M/s ARL Healthcare (P) Ltd., (Old name- Pesticon Chemicals Pvt. Ltd.) was earlier granted Environmental Clearance by MoEF&CC vide letter no. J-11011/312/2005-IA-II(I) dated 24.01.2004 for manufacturing of following bulk drugs: Sr. no. Atenolol 30 TPA Thereafter, the industry HAS BEEN granted permission for change in product mix by MoEF&CC vide no. 5-61/2004-RO(NZ)/2314 dated 31.08.2009 for manufacturing of following bulk drugs: Sr. no. Paracetamol 6000 Kg/PA Now, the industry has applied for varied ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for the above mentioned products, for which permission for change in product mix was earlier obtained by the industry. The industry has submitted a copy of building plan signed by Er. Jasvir Singh, Competent Person under the Director of Factories of Punjab. Visit: The industry was visited by AEE of this office on 01.02.2024 and during visit, it was observed as under: 1. The industry is engaged in manufacturing of bulk drugs and was in operation during the visit. 2. The source of fresh water is PSIEC supply and the same has been equipped with mechanical flow meter to maintain the record regarding the quantity of water consumed. 3. The industry has installed single stage evaporator for evaporation of high TDS wastewater i.e. the mother liquor generated from the reactors and low TDS effluent generated from regeneration of DM plant, floor washing, vessel washing etc. the industry has installed flow meter at inlet and outlet of the evaporator and is maintaining the record regarding of the same. 4. The industry is discharging the domestic effluent into sewer leading to STP of 2 MLD capacity installed by the PSIEC. 5. The industry has installed 02 no. wood fired baby boilers of capacity 800 kg/hr each, which are provided with common stack of adequate height. The representative of the industry informed that one out of these to boilers, only one is operated at a time and the 2nd one remains on standby. 6. The industry has installed one no. DG set of capacities 325 KVA, which is provided with canopy and stack of adequate height. 7. The industry has submitted a copy of stack emission (boiler) analysis report of the monitoring carried out by M/s Centre for Environment and Food Technology Pvt. The industry has submitted a copy of Process stack analysis report of the monitoring carried out M/s Centre for Environment and Food Technology Pvt. The details of hazardous waste being generated from the unit is being sent separately alongwith Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 authorization of the industry. From above, it is clear that the industry is conforming to the prescribed standards. From above, it is clear that the industry is complying of the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Recommendations: In view of above, if may approved, the industry may be granted varied ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, upto 30.06.2028 with usual conditions & with following special conditions: 1. This consent is being granted to the industry in supersession to the earlier consents granted to the industry under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/SAS/2021/16236875 dated 15/08/2021 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/SAS/2021/16236859 dated 25/08/2021, both having validity upto 30/06/2025. 2. The industry shall comply with the conditions of environmental clearance granted by the MoEF&CC vide letter no. J-11011/312/2005-IA-II(I) dated 24.01.2004 and permission of change of product mix granted by the MoEF&CC vide no. 5-61/2004-RO(NZ)/2314 dated 31.08.2009, at all times. 3. The industry shall stick to the production capcites mentioned in this consent letter as well as permission of change of product mix granted by the MoEF&CC vide no. 5-61/2004-RO(NZ)/2314 dated 31.08.2009, at all times. 4. The industry shall operate only one boiler at a time and shall keep the second boiler on standby only. 5. The project proponent shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances. 6. The entire responsibility of treatment and disposal arrangements provided at the site, shall be of the industry. 7. The industry shall ensure that the activities of unit does not create any nuisance in the surrounding areas and no public complaints are received 8. The Consent is being issued to the industry based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time. 9. In case the industry fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the industry.
