File Note: It is submitted that the project is a medium-scale orange category unit. Earlier, the project proponent was given personal hearing before the Chairman of the Board on 03.03.2023 and it was decided as under: A) To confirm with the following directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974: 1) The project proponent shall stop the construction activities at the site with immediate effect and stop forthwith discharging any effluent/ wastewater into sewer/ inland surface water/ onto land or through any other mode. 2) The project proponent shall not allow any new occupancy and shall not allow any new possession in the premises of the project, with immediate effect. 3) The Revenue Authorities shall not to register any sale deed related to any plot/ flat/ house/ shop/ any other component of this project with immediate effect. 4) The PSPCL authorities shall not release any electric connection for this project or any of its components, with immediate effect. B) The Municipal Council, Zirakpur shall be written to explain its position why the sewer connection has been given to the project proponent when the directions have already been issued by the Board vide its letter no. 6221-22 dated 11/10/2022 for not giving any connection to any new project in the area. C) The Environmental Engineer, Regional Office, SAS Nagar shall visit the project to check the compliance of the directions issued as above. The project proponent has applied for obtaining Consent to Establish (NOC) under the Water (Prevention & control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for development of a Commercial Plot alongwith requisite documents and fee. The project proponent has submitted brief project report as per which the proposed cost of the project is Rs. 50.0 crore. The project proponent has deposited Rs. 1,12,800/- vide UTR. No. N348211751966343 dated 14.12.2021, Rs. 28,200/- vide R. No. 284893786 dated 16.08.2022 & Rs. 1,12,800/- vide R. No. 468509014 dated 24.11.2023 as NOC fee. The NOC fee deposited by the project proponent is adequate for one year. The project proponent has submitted CLU letter issued by Office of Regional Deputy Director-Cum-Competent Authority Local Govt. Patiala under PAPRA vide no. CLU/DDLG/PTL/2018/11571 dated 31.05.2018 regarding permission of change of land use for total land area 25 Bigha 0 Biswa 0 Biswasi. The project proponent has submitted brief project report, the water requirement and pollution as under: Total No of Plots 145 no. No of Workers/ employees 1160 persons @ 45 Ltr/day 52 m3/day Domestic water required 3000 persons @ 15 ltr/day 45 m3/day Total Consumption of water 97 m3/day Total discharge @ 80% to STP 77 m3/day As per the project report STP of 100 KLD will be provided based on SBR technology and the components of STP are Collection Tank, SBR reactors, Clear water sump, Dual Media Filter and Sludge drying beds, which is adequate. The treated effluent @ 46 KLD will be used for flushing, 3 KLD will be utilized for green area and the rest 28 KLD will be discharged into MC sewer. As per project report, the project shall generate total solid waste of approximately 832 Kg/ Day, which will be segregated into biodegradable and non-biodegradable. The biodegradable solid waste shall be converted to organic manure by providing adequate capacity of mechanical composter and the rest shall be disposed of as per the provisions of solid waste management rules, 2016. The site of the project was visited by AEE of this office on 02.02.2024 and during visit, it was observed that: 1. The site of the proposed project is located in Zirakpur. 2. The project has 145 plots out of which construction of about 90 plots is complete and other plots are empty. Currently about 10 plots are occupied. 3. The project proponent has submitted allotment letters of few individual plots as a proof that the showroom are not been constructed by the promoter company. 4. As per the application form and site plan submitted by the project proponent the project shall be developed as Area Development Project. As the total project area is 4.6 acre, it is not covered under category 8-B of the EIA notification dated 14.09.2006 5. As physically observed, the distance of the proposed site from the various approved existing operational industries / units (for which specific siting guidelines has been issued by the Board for time to time), is more than the required distance as per the siting criteria given as under: Sr. No. Type of Industrial unit Required distance as per siting criteria 1. Jaggery Unit 200 m The site is complying with general siting criteria as per policy dated 30.04.2013 and specific sitting guidelines as per the Department of Science, Technology, Environment, Government of Punjab notification no. 3/6/07/STE(4)/2274 dated 25.07.2008. 6. The project proponent has installed STP of capacity 100 KLD based on SBR technology which was in operation during the visit. The treated effluent is being utilized for green area and the rest is being discharge into sewer. 7. The representative informed that the mechanical composter will be installed within one month. 8. The project proponent has installed 1 no. D.G set of capacity 125 KVA with canopy and adequate stack height. 9. The project proponent has submitted the approved site plan issued by Competent Authority cum Regional Deputy Director, Local Govt. Punjab vide no. LDC/CA-3DDLG/PTA-18/21404 dated 06.11.2018. The project proponent has submitted letter no. 4306/BB dated 29/11/2017 issued by EO, MC, Zirakpur wherein it has been mentioned that MC Zirakpur will have no objection for discharge of treated waste water of the project with its main sewer line after depositing necessary sewerage charges. As such, the PP has obtained permission from MC Zirakpur for discharge of treated sewage vide no. 4306/BB dated 29/11/2017, which is well before the directions issued to MC Zirakpur by the Board on 15.6.2022. Also decided in the review meeting taken by CEE (P) on 13.7.2023, the permissions may be given to such projects, which are having permission from MC regarding connectivity of MC sewer before 15.6.2022. In view of the above, it is recommended that a) Direction u/s 33-A of the Water (Prevention & control of Pollution) Act, 1974earlier issued to the project may be dropped please. b) The Consent to Establish (NOC) from pollution angle under the provisions of the Water (Prevention & control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted for one year subject to suitable conditions and following additional conditions that: 1. The industry shall apply for obtaining consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 immediately. 2. The project proponent shall submit permission from PWRDA regarding abstraction of ground water. 3. The project proponent shall submit the complete drawing and design of the STP and its component at the time of obtaining consent to operate. 4. The project proponent shall place adequate no of bins outside its premises from where the Municipal Solid Waste shall be got lifted. 5. The project proponent shall properly handle and manage the solid waste as per the provisions of the Municipal Solid Waste Management Rules, 2016 and ensure that the solid waste is segregated into biodegradable and non-biodegradable components. The biodegradable component shall be treated by providing on-site facility to produce compost, which will be disposed of/reused in an environmentally sound manner and the non-biodegradable solid waste shall also be disposed of in an environmentally sound manner. The project proponent shall install mechanical composter for the treatment of wet biodegradable solid waste within one month. 6. The project proponent shall also ensure that the hazardous waste and e-waste components of the solid waste shall also be segregated and the same shall be channelized to the authorized facility for such type of waste. 7. The project proponent shall comply with the provisions of the Construction and Demolition Management Rules, 2016. 8. The project proponent shall take adequate steps to the effect that the construction material of any kind that is stored at site shall be fully covered in all respects so that it does not disburse in the air in any form. 9. The project proponent shall ensure that all the construction material and debris shall be carried out in trucks or other vehicles which are fully covered and protected so as to ensure that the construction debris or the construction material does not get disburse into the air or atmosphere in any form. 10. The project proponent shall take all necessary steps to control the dust emissions to be generated from the construction activities of the project. 11. The NOC/ CTE has been granted on the basis of information filed by the project proponent and if, in future any information is found wrong, the Board has right to revoke the NOC/ CTE. *Competency – Worthy Chairman of the Board Date of Receipt: 10.01.2024 Date of Scrutiny: 07.02.2024 Date of Deemed Approval: 14.02.2024
