File Note: It is submitted that the industry was granted consents to operate vide no. CTOW/Renewal/FZR/2019/10035732 dated 04.07.2019 and vide no. CTOA/Renewal/FZR/2019/10035549 dated 04.07.2019 under the Water Act, 1974 and the Air Act, 1981, respectively for operation of saila/streamed rice sheller unit to manufacture Parboiled Rice or Steamed Rice or Raw Rice @ 200 TPD and Sorted rice @ 200 TPD,both are valid upto31.03.2024, under Red category, subject to the certain conditions mentioned therein. Thereafter, the industry was visited by then AEE and then EE of ZO, Bathinda on 19.11.2022 and observed that:- 1. The industry was in operation for the production of steamed rice. Parboiling section was not in operation. 2. The industry has installed ETP for the treatment of effluent generated during production of saila rice. The same was found not in operation. The plantation area developed by the industry is an area of 3.5 acres in front of main gate of the industry, was found in good condition and the same was found dry from which it seems that the industry has not operated the saila plant in the recent past. As such, effluent samples could not be collected. 3. The boiler furnace of 12 TPH and shelling section line-1 was in operation. The industry has installed trima cyclone with the boiler furnace and cyclone with paddy cleaner of shelling section line-1 both were in operation. Separate cyclones installed as air pollution control device with pre-cleaning sections and shelling section was found in working condition. 4. The industry has installed EMF at the borewell, but the same was found out of order. No flow meter installed at the outlet of ETP. Flow meter installed at inlet of ETP was found out of order. 5. Inside emission were observed in the shelling area because of inadequate emissions collection points. 6. No effluent was coming into ETP. However, water was found stagnated inside the different components of ETP. 7. Solid waste segregation is to be done and at present disposed off outside. 8. The industry has installed two DG sets of capacity 500 KVA and 140 KVA with canopies and adequate stack heights. However, used/waste oil is disposed off unscientifically manner. 9. Overall cleanliness is satisfactory within the premises of the industry. 10. No record is being maintained regarding generation & disposal of fuel ash. 11. Instead of R.O. plant, softener used to avoid more water consumption. 12. PRS (Procure Redressing System) after boiler and APT (Automatic Pumping Trap) installed on dryers, which result in less consumption of fuel in boiler furnace. In view of above, the industry has been issued show cause notice before revocation of consents to operate granted under the provision of Water Act, 1974 & Air Act, 1981 alongwith an opportunity of personal hearing before the Chairman on 19.01.2023. During hearing, Sh. Vipul Garg, Representative of the industry submitted written reply to the notice issued to the industry, which has been taken on record. He further stated that:- 1. The industry is currently engaged in production of steamed rice and the saila plant will be operated in future. 2. Tne ETP installed has now been maintained and is under stabilization. The approach ETP has also been improved. 3. The flow meters installed at the source of water supply and at the inlet of ETP have been put in order and the flow meter has also been provided at the outlet of the ETP. Record of the same is being maintained. 4. The plantation has been developed in an area of 3.0 acres as well as alongwith the boundary wall. Network to dispose off the treated effluent in the plantation area has been provided . 5. The height of the stacks installed with the APCD of shelling section has been increased and all the dust emitting points are connected with the APCD. 6. Proper segregation of solid waste is done before its disposal. 7. No hazardous waste has yet been generated. 8. The fuel ash of the industry is lifted by the nearby farmers. Record of the same is being maintained. After hearing the representative of the industry and the officers of the Board, the Chairman of the Board decided that:-:- 1. The industry shall inform the Board atleast 15 days prior regarding schedule of operation of saila plant so as to enable the Board to collect effluent samples. In case of non-compliance, further action as deemed fit shall be taken against the industry. 2. The industry shall maintain record of readings of water meter installed on fresh water supply line, flow meter installed at the inlet & outlet of ETP, energy meter installed with ETP & APCD on daily basis & shall submit the same to the Regional Office, Faridkot on monthly basis. 3. The industry shall ensure proper handling, transportation, storage and disposal of fuel ash so that no air pollution / public nuisance is caused due to above activities and also maintain the record of fuel ash generated, disposed off etc. on daily basis & shall submit the same to the Regional Office, Faridkot on monthly basis. 4. The industry shall ensure the compliance of code of practice prescribed by the Govt. for such unitsalongwith compliance of conditions of consents under the Water Act, 1974 & Air Act, 1981, at all times. 5. The industry shall ensure to manage, treat and dispose of the solid waste generated from its premises in accordance with the provisions of the Solid Waste Management Rules, 2016. 6. Regional Office shall immediately visit the industry to verify the submissions made by the representative of the industry and thereafter submit report/recommendation in the matter within 10 days. The proceedings of the personal hearing were conveyed to the industry, for compliance of decisions taken during hearing dated 19.01.2023, vide Board’s letter no. 752 dated 27.02.2023. Now, the industry has applied for renewal of consents to operate under the Water Act, 1974 and the Air Act, 1981 for operation of saila/streamed rice sheller unit to manufacture Parboiled Rice or Steamed Rice or Raw Rice @ 200 TPD and Sorted rice @ 200 TPD, under Red category. Details of the case area as under: The industry has deposited Rs. 2,46,000/- vide UTR/Ref. No. HDFCR52024011671192639dated 16.01.2024as water fee under the Water Act, 1974 and Rs. 2,46,000/- vide UTR/Ref. No. HDFCR52024011671195715dated 16.01.2024as air fee under the Air Act, 1981, against the fixed assets of Rs. 2482.37 Lacs as on 31.12.2023 as per CA certificate submitted by it. Thus, the adequacy of consent fee becomes 31.03.2029 under each Acts. It has submitted an undertaking regarding the compliance of proceedings, reproduced as under: 1. We have not operated saila plant in our industry as per market conditions and have operated the plant only for production of steamed rice and raw rice. We have carried out washing and repair of machinery during the visit of your office. 2. We have kept ETP of our plant in operationanle condition and the plantation has also been maintained as per kernel technology. 3. Flow meter has been provided at the outlet of ETP and energy meter has also been provided. Flow meter has also been provided at the outlet of one no. Submersible pump (source of fresh water). 4. We have provided a dedicated room for storage of fuel Ash generated from boiler section along with sprinkling arrangement. 5. No solid waste is generated from our premises. However whatever solid waste will be generated will be treated as SWM Rules. The industry has submitted record regarding the fuel ash disposal. To verify the facts, the industry was visited by AEE (undersigned) on 19.01.2024 it was observed as under:- 1. The industry was in operation for production of steamed rice via both shelling lines. 2. ETP installed by the industry was under stabilization. Industry has provided EMF at outlet to ETP. The industry has also provided separate energy meter with ETP. The industry has one submersible pump as source of water supply in the premises and it has provided water meter to the same. 3. The industry has provided Trima-cyclone as APCD with boiler of capacity 10 TPH alongwith stack of adequate height and sampling arrangement for carrying out emission sampling. 4. The industry has provided room type enclosure for storage of fuel ash generated from boiler of capacity 10 TPH. Arrangement for wetting of fuel ash has also been provided to avoid its wind blowing. Fuel Ash is lifted by farmers of nearby area & the industry is maintaining record of the same. 5. The industry has two shelling sections & rice husk generated from both shelling sections is stored in closed shed and from this shed; rice husk is taken to the feeding point of boiler through covered conveyer belt. The industry has installed mechanical feeding system for feeding rice husk into boiler. 6. The industry has provided cyclone separators as APCDs with both paddy pre-cleaners of parboiling section, separately and stacks of adequate height have been provided to the APCDs with provision to facilitate emission sampling. 7. The industry has provided cyclone separators as APCDs with both shelling sections separately and stacks of adequate height have been provided to the APCDs with provision to facilitate emission sampling. 8. The industry has provided plantation in an area more than 04 Acres in it’s own land, adjoining to its premises, for discharge of treated trade effluent & condition of plantation was good. Part of plantation area was filled with water to which industry informed that they have carried out washing of the machinery recently and along with boiler feed water discharge. Further informed that they have not operated saila section as per market demand and will priorly intimate the Board, whenever they will operate the saila section. 9. The industry has provided bricked and concrete paving in the movement area of vehicles. 10. No source of solid waste was found in the premises of industry and the industry was advised to always comply with the provisions of SWM Rules, 2016. 11. The industry is complying with the provisions of the Water Act, 1974 & Air Act, 1981. The industry is complying with the provisions of the Water Act, 1974 and Air Act, 1981 for operation of parboiling plant / rice sheller unit as well as code of practice notified by the Govt. of Punjab, Department of Science, Technology & Environment vide notification no 10/48/2004-STE-(4) / 932 dated 15/10/2013. As per Ministry of micro, small and medium enterprises notification dated 26.06.2020, an enterprise will be considered as medium where the investment in plant and machinery or equipment does not exceed fifty crore rupees and turnover does not exceed two hundred and fifty crore rupees. Therefore, as per the CA certificate submitted by the industry, it falls in medium enterprise. Keeping in view of above mentioned facts, it is, therefore, recommended that consent to operate granted under the Water Act, 1974 and the Air Act, 1981 may be renewed to the industry for a period upto 31.03.2029 for operation of saila/streamed rice sheller unit to manufacture Parboiled Rice or Steamed Rice or Raw Rice @ 200 TPD and Sorted rice @ 200 TPD, subject to the suitable conditions and special condition as under:- 1. The industry will get its effluent/emissions analyzed from Board's lab, within one month. 2. The industry shall kept its ETP in operational condition and shall intimate the Board in advance regarding operation of saila section so that effluent monitoring of the ETP can be carried out. 3. The industry shall always maintain its plantation area for scientific disposal of effluent generated during the operation of saila section. 4. The industry shall always maintain record regarding fresh water intake, effluent generation and treated effluent.
