File Note: It is submitted that the industry is a small scale red category dyeing unit and engaged in process of manufacturing of dyeing and finishing of Polyester Fabrics. The industry was granted consent to operate under Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Fresh/LDH1/2021/14000028 dated 15.03.2021 valid upto 30.06.2024 and consent to operate under Water (Prevention & Control of Pollution) Act, 1974 applied by the industry was refused vide no. CTOW/Fresh/LDH1/2022/19507294 dated 1.11.2022 due to non-compliance. The report regarding non-compliance of the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and discharge standards was sent to the Competent Authority and directions u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 has been issued to the industry Zonal office letter no. 814-817 dated 29.01.2024 to disconnected the electric supply after affording an opportunity of personal hearing. Now the industry has applied consent to operate under Water (Prevention & Control of Pollution) Act, 1974 alongwith request of temporary restoration of electric supply. The industry has filled an online application form, uploaded CA certificate, location plan site plan, manufacturing process flow chart, copy of TDCO issuing by the PSPCL authority, analysis report, photographs of plantation area, request letter, MSME certificate, lease deed, partnership deed. In addition to already deposited consent fee which is adequate upto 30.06.2024, now deposited Rs. 10800/- vide no. SDL106901775 dated 15.06.2022 as NOC Fee, Rs. 54000/- vide no. SDL106901605 dated 15.06.2022 under Water Act, 1974. The adequacy of fee deposited by the industry is upto 30.06.2029 The industry was visited by the officer of the Board on 07.02.2024 and it was observed as under:- 1. The industry was in operation during the visit. 2. The ETP was in operation during visit and the treated effluent was being discharge onto land for plantation. 3. The industry has now developed new area of plantation for disposal of treated water. Presently the industry has developed 4 acres plantation area (new +old). 4. The industry has removed the stagnation in the plantation area just opposite to the main gate. 5. The industry has also disconnected the source of disposal of treated effluent in previous area, where stagnation was observed. 6. Letter has been written by this office to PSPCL Kohara for compliance of directions regarding disconnection of electric connection and same are yet to be complied. In view of the above, if approved, request of the industry for temporary restoration may be considered and Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974 may be granted to the industry for six months with suitable terms and conditions, please
