The industry has applied for fresh ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, for manufacturing of BIOMASS (PALLETS/BRIQUETES) @ 32.4 MTD as products using biomass/agricultural waste & wood dust as raw material, along with requisite document. the industry has applied under Green Category under- 3005- Biomass briquettes (sun drying) without using toxic hazardous wastes category.
The industry has establish its unit without obtaining Consent to establish from PPCB and has directly applied for obtaining ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
The industry has deposited Rs. 32500/- vide R no. 105998568 dated 31.01.2024 under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 38900/- vide R. no. 427526055 dated 31.01.2024 under the Air (Prevention & Control of Pollution) Act, 1981, which is adequate upto 31.12.2028 (Considering NOC regularization fee of Rs. 6400/-) for both the Acts against the fixed assets of Rs. 1.10 cr. on 23.01.2024.
Manufacturing process:
RAW MATERIAL Grinding/Crushing Drier, Binders & Mixing Biomass Pellets/Briquettes Machine Cooler Biomass Solid Fuel.
Suitability of Site:
The industry has uploaded a copy of land use classification letter issued by DTP SAS Nagar vide letter no. 123 dated 07.02.2024, wherein it has mentioned as under:
“ਉਪਰੋਕਤ ਵਿਸ਼ੇ ਅਧੀਨ ਹਵਾਲੇ ਅਧਿਨ ਪੱਤਰ ਦੇ ਨਾਲ ਨੱਥੀ ਦਸਤਾਵੇਜ਼ਾ ਦੇ ਸਨਮੁਖ ਸੂਚਿਤ ਕੀਤਾ ਜਾਂਦਾ ਹੈ ਕਿ ਪਿੰਡ ਭਗਵਾਨਪੁਰ (ਹ.ਬ.ਨੰ. 199) ਤਹਿਸੀਲ ਡੇਰਾਬੱਸੀ, ਜ਼ਿਲ੍ਹਾ ਐਸ.ਏ.ਐਸ ਨਗਰ ਵਿੱਖੇ ਪੈਂਦਾ ਖਸਰਾ ਨੰਬਰ 124/1/2 (1-8) ਕੁੱਲ ਰਕਬਾ 1 ਬਿੱਘੇ 8 ਬਿਸਵੇ (ਲਗਭਗ 0.29 ਏਕੜ) ਦਫਤਰੀ ਰਿਕਾਰਡ ਵਿੱਚ ਉਪਲੱਬਧ ਰਿਜਨਲ ਪਲੈਨ, ਗਮਾਡਾ ਅਨੁਸਾਰ ਐਫ.ਈ.ਜੈੱਡ ਜ਼ੋਨ ਅਧਿਨ ਪੈਂਦਾ ਹੈ, ਨਾਲ ਨੱਥੀ ਰੈਵੀਨਿਉ ਦਸਤਾਵੇਜ਼ਾ ਅਨੁਸਾਰ ਉਕਤ ਰਕਬੇ ਨੂੰ 5 ਕਰਮ ਚੌੜਾ ਰੈਵੀਨਿਉ ਰਸਤਾ ਲਗਦਾ ਹੈ, ਜਿਸ ਉੱਤੇ ਉਦਯੋਗਿਕ ਇਕਾਈ (ਮੈਨੂਫੈਕਚਰਿੰਗ ਆਫ ਬਾਓ ਮਾਸ ਫਿਊਲ) ਆਗਿਯੋਗਿਕ ਹੈ, ਬਸ਼ਰਤੇ ਸਾਈਟ ਵਿਭਾਗੀ ਗਾਈਡਲਾਈਨਜ਼ ਦੀ ਪ੍ਰਤੀ ਪੂਰਤੀ ਕਰਦੀ ਹੋਵੇ। ਸਾਇਟ ਵਿੱਚ ਕਿਸੇ ਵੀ ਤਰ੍ਹਾਂ ਦੀ ਐਕਟੀਵੀਟੀ ਕਰਨ ਤੋਂ ਪਹਿਲਾ ਉਸ ਸਬੰਧੀ ਮਨਜ਼ੂਰੀ ਸਬੰਧਤ ਸਰਕਾਰੀ ਅਦਾਰਿਆਂ ਤੋਂ ਪ੍ਰਾਪਤ ਕਰਨ ਦੇ ਅਤੇ ਰਕਬੇ ਦੀ ਮਾਲਕੀ/ਕਬਜ਼ੇ ਸਬੰਧੀ ਵੱਖਰੇ ਤੌਰ ਤੇ ਮਾਲ ਵਿਭਾਗ ਪਾਸੋ ਤਸਦੀਕ ਕਰਵਾਉਣ ਦੇ ਆਪ ਪਾਬੰਦ ਹੋਵੇਗੇ। ਇਸ ਤੋਂ ਇਲਾਵਾ ਉਕਤ ਕਲਾਸੀਫਿਕੇਸ਼ਨ ਆਪ ਵੱਲੋ ਪੇਸ਼ ਕੀਤੇ ਗਏ ਦਸਤਾਵੇਜ਼ਾ ਦੇ ਸਨਮੁਖ ਜਾਰੀ ਕੀਤੀ ਗਈ ਹੈ।
ਇਸ ਪੱਤਰ ਨੂੰ ਵਿਸ਼ੇ ਅਧੀਨ ਸਾਈਟ ਦਾ ਲੈਂਡ ਯੂਜ਼ ਕਲਾਸੀਫਿਕੇਸ਼ਨ ਸਰਟੀਫਿਕੈਂਟ ਹੀ ਸਮਝਿਆ ਜਾਵੇ। ਇਸ ਲੈਂਡ ਯੂਜ਼ ਕਲਾਸੀਫਿਕੇਸ਼ਨ ਸੀ.ਐਲ.ਯੂ ਦੀ ਪ੍ਰਵਾਨਗੀ ਜਾ ਕਿਸੇ ਕਿਸਮ ਦਾ ਐਨ.ਓ.ਸੀ ਨਾ ਸਮਝਿਆ ਜਾਵੇ।”
As the site of the industry is located in F.E.Z Zone, thus, the site of the industry is suitable.
The industry has submitted a copy of registry dated 05.10.2020 executed between Smt. Surinder Kaur Johal and Smt. Renu Bala for land bearing Khasra no. 123/1 (3-0), 124/1 (2-10).
The industry has also submitted a copy of building plan signed by the Joint Director of Factories of Punjab.
Visit:
Accordingly, the industry was visited by AEE of this office on 01.02.2024 and during visit, it was observed as under:
1. The industry has installed environmental data board at its entrance.
2. The industry has installed the machinery for manufacturing of biomass briquettes using loose biomass and wood dust as fuel in its premises. The industry is yet to start operations at the site.
3. The machinery installed by the industry consists of cutter, mixer and compressor for manufacturing of briquettes.
4. The industry has installed cyclone separator as APCD with the cutting and mixing processes.
5. The industry has covered the entire area with shed and the entire processing shall be carried out in closed area. The representative of the industry further informed that they shall take 2-3 acres of land area on lease for storage of agricultural waste from coming season.
6. The industry has constructed septic tank, after passing through which domestic effluent shall be used for plantation developed near the boundary wall.
7. The industry shall not carry out any wet process in its premise and shall not generate any kind of trade effluent.
8. The industry has not installed any DG set in its premises.
Recommendations:
In view of above, if may approved, the industry may be granted ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 upto 30.09.2027, with usual conditions & with following special conditions:
1. The industry shall not carry out any activity, which can change in category from Green to Orange or Red, under any circumstances.
2. The industry shall not generate and discharge any kind of trade effluent from its process. The industry shall discharge only domestic effluent onto land for plantation within premises, after passing through septic tank.
3. The industry shall not install any boiler or furnace in its premises without prior permission of the Board.
4. The industry shall immediately provide flow meter at the tubewell installed in its premises.
5. The industry shall ensure that no problem related to dust pollution is being caused by the unit due to its operation and no public complaints are received by the Board in this regard.
6. The project proponent shall comply with the guidelines issued by PWRDA and shall obtain permission from PWRDA for abstraction of ground water.
7. The industry shall not discharge the effluent into any drain/choe/nallah, in any case.
8. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances.
9. The industry has been approved by the Board from pollution angle and the industry shall obtain the statutory clearances / permissions from all other concerned departments.
10. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time.
11. The industry shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time.
12. The ‘consent to operate’ is being issued to the project proponent based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing.
13. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent.
