It is intimated that :-
1. The project proponent has obtained consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/LDH4/2019/8706938 dated 23/01/2019 which was valid upto 30/09/2019 for residential colony in an area of 143461.1 sqm (35.45 acres) with residential plots @ 354 numbers and commercial @ 46 number and for discharge of domestic effluent @ 573.48 KLD into sewer and further leading to STP Balloke and consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 was granted vide no. CTOA/Renewal/LDH4/2019/8706927 dated 23/01/2019 which was valid upto 30/09/2019 for one DG set of capacity 50 KVA equipped with canopy.
2. Now,the project proponent has applied for varied of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 through OCMMS on 03.02.2024 for residential plots @ 349 numbers and commercial shops @ 46 number and for discharge of domestic effluent @ 569 KLD into sewer and further leading to STP Balloke.
3. The project proponent has not installed its individual STP.
4. The sewerage network of the project has been connected with MCL sewer network. The Asstt. Commissioner (T), MC Ludhiana vide its letter dated 03.05.2012 has acknowledged the connection of project sewage to MC sewerage which is further disposed off at STP Balloke. The colony had been approved dated 20.09.1996 vide license no. 96/12. Further, the project proponent has also submitted copy of letter issued from PUDA vide its letter no. 98/1487 dated 03.04.1998 which indicates that the permission has been given to colony to connect its sewer to the M.C. sewer line.
5. The discharge generated from the project is being treated ultimately at the STPs at balloke, which is being monitored by the regional office-02 ,Ludhiana on monthly basis. The STP is found regularly complying with the prescribe standards during last six motnhs.Though, the STP-baloke is achieving the prescribed standards, in future, the action against the authorities of STP may can be initiated if the STP does not achieve the prescribed standards.
6. The total area of project as mentioned in application form is 143461.1 sq mtrs. It is an group housing project with plotting.The built up area of the project exceeds the limit of 20,000 sq mtrs. It is pertinent to mention here that MoEF vide its letter no 205 dated 15.04.2019 has clarified that the projects with a land area of less than 50 ha but a built-up area of more than 20,000 Sqm may be appraised as per provisions of Schedule 8(a) of the EIA Notification2006 as amended from time to time. In this regard the Board vide its letter no. 10949 dated 09.05.2023 has sought a clarification from the Joint Director MoEF, Chandigarh and reply of clarification is awaited.
7. The project proponent has applied for varied CTO , there is no increase in pollution load and change in mode of disposal from its previously granted CTO and the untreated effluent of the project is discharged into the MC sewer and same is being treated ultimately at the STPs at balloke
Keeping in view of above, it is recommended that consent to operate under the Air (Prevention and Control of Pollution) Act, 1981 may be granted to the upto 31.03.2026 with suitable conditions and subject to following special conditions for regular compliance:-
1. The project proponent shall obtain the Environmental clearance under EIA Notification2006 as amended from time to time, as when required based on the reply of clarification regarding EC formt he MoEFCC the which is awaited .
2. The project proponent shall obtain permission from CGWA for abstraction of ground water (if required) and shall comply with the guidelines issued by it from time to time.
3. The project proponent shall provide adequate capacity of bio composter for management of its wet waste and shall provide adequate arrangement such as waste segregation, compost pits, MRF shed etc for management of municipal solid waste as per Solid waste management Rules, 2016.
4. The project proponent shall fulfill its responsibility as a bulk waste generator and shall comply with the provisions of Solid waste management Rules, 2016.
5. The project proponent shall comply with the provisions of the Noise Pollution (Regulation & Control) Rules 2000.
6. The project proponent shall ensure compliance to the comprehensive guidelines for the regulation of noise/ sound pollution caused by use of loud speakers, public address system etc. issued by Punjab Government, Deptt. of Science, Technology & Environment vide notification no. 3/100/2013-STP(4)/145 dated 26.02.2014.
7. The industry shall obtain permission from the concerned Department(s) and shall comply with the conditions of relevant permissions obtained by it from other related Departments (if any).
8. The Consent is being issued to the project proponent based upon the undertakings/documents/ information submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time.
9. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the promoter.
10. The regional office-0 2,Ludhiana may also be requested to monitor the STPs at Baloke performance as per the Board's protocol and shall recommendations on merits, in case the STP fails to achieve the prescribed standards.
