File Note: It is submitted that earlier, the project proponent has started development of colony without obtaining NOC of the Board. Accordingly, project proponent was given opportunity of personal hearing before the Hon'ble Chairman of the Board on 10.04.2023 u/s 33-A of the Water Act, 1974 and it was decided that directions u/s 33-A of the Water Act, 1974 be issued to the effect that project proponent shall immediately stop any further construction activities at the project site and will not restart the construction activity without getting prior written permission from the Board. In compliance to the decisions of the personal hearing, directions u/s 33-A of the Water Act, 1974 were issued to the project proponent vide letter no. 1378 dated 28.04.2023. Thereafter, the project proponent had applied for obtaining consent to establish (NOC) of the Board three times on 17-08-2023, 04-09-2023 and 22-12-2023 but the same were returned due to in-completions in applications. Now, the project proponent has again applied for obtaining consent to establish (NOC) of the Board for pollution angle for development of a “Residential Project” for 82 no. Residential Plots in an area of 21946.25 sq. yd, 22 no. EWS Plots in an area of 2185.93 sq. yd. and 09 no. Commercial Plots in an area of 410.17 sq. yd. at Dhanaula Road, Tehsil & District Barnala, Punjab in an area of 35814.38 sqm (8.85 acres). The project proponent has deposited Rs. 11300/- (Rs. 10800/- NOC fee + Rs. 500/- application form fee) vide UTR no. 395355812 dated 30/11/2022 against the proposed cost of Rs. 482.86 lakhs, which is adequate for one year. The project proponent has obtained CLU from Local Government, Punjab issued by Competent Authority vide memo endst no. PB/CLU/BNN/BARNA/1598 dated 24/01/2022 for change of land use for Residential Plotted use project in the land measuring 70 Kanal 16 Marla with share of owner 26 K-17 M - 8.50 S (35814.38 sq. mtr) in the revenue estate of Dhanaula Road, Tehsil & District Barnala. The project proponent has also obtained NOC from MC, Barnala for connecting the sewerage of project proponent with MC sewer which is passing by the project proponent. The project proponent has deposited requisite fee for the same. The project proponent has also submitted NOC from MC, Barnala for disposal of solid waste generated by the project proponent wherein it is mentioned that the project proponent will be bound to comply as it is with the Solid Waste Management Rules, 2016. The project proponent will be bound to dump the solid waste at the site authorized by MC, Barnala at their own expanses. MC, Barnala will help the project proponent as facilitator in disposing off the solid waste at project's expanses. The project proponent has submitted the feasibility report and stated that the residential colony will consists of 82 no. Residential Plots, 22 no. EWS Plots and 09 no. Commercial Plots and the estimated population for the project will be 619 persons. The total water requirement for the project will be 72 KLD for domestic purposes, out of which 58 KLD of domestic wastewater will be generated. The project proponent has submitted that 5.71 KLD treated wastewater will be used onto park/green area of 0.47 acre considering 12.14 kl/acre/day, 28.5 KLD onto land for plantation of an area of 0.35 acre considering 80 kl/acre/day and 23.79 KLD in dual plumbing system after treatment in STP of 70 KLD capacity to be installed based on MBBR Technology. Hence, the total 58 KLD effluent will be reused inside the premises. The project proponent has also obtained the NOC from from MC, Barnala for connecting the sewerage of project proponent with MC sewer, if required. The proposed STP will be consisting of collection pit, screening, oil & grease removal, aeration tanks, secondary clarifier, multimedia tanks, UF, UV and sludge drying beds. The project proponent has also submitted in its reply that the plantation area will be developed as per karnal technology for utilization of treated wastewater. The project proponent has submitted in feasibility report that after the full operational activity, 113.9 kg per day solid waste (considering 0.1 kg/capita/day for commercial/ floating population and 0.2 kg/capita/day for residential population) will be generated from the project. From which 45% waste will be kind of Bio-degradable or wet waste, 53% waste will be kind of non-bio-degradable or dry waste and 2% waste will be kind of domestic hazardous waste. Bio-degradable waste will be converted into manure using mechanical composter, non-bio-degradable waste will be handed over to authorized recycler as per SWM Rules, 2016 and domestic hazardous waste will be disposed off through authorized vendor as per SWM Rules, 2016. The project proponent has proposed to install 02 no. D.G sets of capacity 750 KVA equipped with canopies and stacks of adequate height. To verify the facts, the site of the project was visited by the AEE of this office on 05.02.2024 and it was observed as under:- 1. The site of the project proponent is located at Dhanaula Road, Tehsil & District Barnala within MC limit. 2. No saila plant, stone crusher, cement plant, grinding unit, rice sheller, hot mix plant etc. and MAH unit falls within 500 mtr distance from the boundary wall of the project. 3. The project proponent has proposed to develop 82 no. Residential Plots in an area of 21946.25 sq. yd, 22 no. EWS Plots in an area of 2185.93 sq. yd. and 09 no. Commercial Plots in an area of 410.17 sq. yd. The total area of the project is 8.85 acres. 4. The construction work of the road is almost completed and remaining work is yet to be done at site. 4-5 houses has been already constructed at site. 5. The development of the parks and tree plantation as per the plan was under process at site. The project proponent has proposed 0.47 acre under parks and 0.35 acre for tree plantation. 6. The project proponent has also proposed dual plumbing for reuse of the treated water @ 23.79 KLD in flushing. 7. The construction work of the STP yet to be start at site. 8. The project proponent has proposed to install 02 no. D.G sets of capacity 750 KVA equipped with canopies and stacks of adequate height. The total area of the project is less than 50 Hectare, hence, the project is not covered under Environmental Clearance. From the above, it is evident that, the site of the project is suitable for establishment of such projects. Keeping in view of above, if approved, the consent to establish (NOC) for development of a residential colony at Dhanaula Road, Tehsil & District Barnala in an area of 8.85 acres may be granted with usual conditions as per policy of the Board and special condition that 1. The project proponent shall install the STP of adequate capacity to treat its domestic effluent. 2. The project proponent will be bound to develop the adequate plantation area as per Karnal Technology with long trees for the disposal of its treated effluent. 3. The project proponent shall provide the dual plumbing arrangement for maximum reuse of its treated effluent. Competency SEE
