It is submitted that earlier, the project proponent has applied for obtaining 'consent to establish' (NOC) under the Water Act, 1974 & the Air Act, 1981 for development of residential colony in an area of 4.73 acres for developing 83 no. of residential plots &34 commercial shops in the revenue estate at Cantt Road, Fazilka.
The applications earlier applied by the project proponent were refused / returned due following incompletions:-
1. The project proponent has not submitted copy of the approved layout plan from the Competent Authority alongwith copy of Change of land use (CLU).
2. The project proponent has not submitted permission from the Municipal Council (MC) regarding disposal of treated effluent into MC sewer and shall also obtain the detail from the MC regarding the capacity of the terminal STP, quantum of treated effluent of the colony permitted for disposal into MC sewer and distance of the sewerline from the colony or shall provide adequate alternate arrangements for disposal of treated domestic effluent.
Now, the project proponent has again applied for obtaining 'consent to establish' (NOC) under the Water Act, 1974 & the Air Act, 1981 for development of residential colony in an area of 4.73 acres for developing 83 no. of residential plots &34 commercial shops in the revenue estate at Cantt Road, Fazilka. Details of the case are as under:-
1) The project proponent has submitted copy of Change of land use (CLU) to Prime Developers through Sh. Arun Kumar issued by the Local Govt. Punjab vide his office letter Memo No. PB/CLU/FKA/FAZIL/1437 dated 26-07-2022, as per which the site of area 37 kanal 17 marlas bearing khasra no. 87/15/2, 87/16, 87/25, 87 /20/1, 88/21/1, 98/1/1, 98/10/1/ 2, 99/5, 87/14, 87/17 & 87/24falls in Residential as per Master Plan Fazilka (2007-2021).
2) The project proponent has submitted revenue in the form of registered sale deed to the name of partners of the firm.
3) The project proponent has submitted letter issued by EO, MC, Fazilka vide his office letter no. 1560 dated 03.11.2023, which states that approval is given for connection of water supply and sewerage with the subject cited colony and MC further vide his office letter no. 24 dated 09.01.2024 informed that STP of capacity 13 MLD based on SBR technology is working condition.
4) Further, the project proponent has submitted copy of letter issued from the Municipal Council, Fazilka vide no. 184 dated 02.02.2024, which is reproduced as under:-
ਇਥੇ ਆਪ ਜੀ ਨੂੰ ਇਹ ਦਸਿਆ ਜਾਂਦਾ ਹੈ ਕਿ ਨਵਾਂ ਸੀਵਰੇਜ਼ ਟਰੀਟਮੈਂਟ ਪਲਂਟ ਜੋ ਕਿ ਸਾਲ 2023 ਵਿਚ ਸ਼ੁਰੂ ਹੋਇਆ ਹੈ ਅਤੇ 13 ਐਮ.ਐਲ.ਡੀ.ਕਪੈਸਟੀ ਐਸ.ਬੀ.ਆਰ.ਟੈਕਨੋਲਜੀ ਦਾ ਹੈ ਅਤੇ ਤਜਵੀਜਤ ਕਲੋਨੀ ਤੋਂ ਹੋਣ ਵਾਲਾ Maximum treated Domestic influent ਲੈਣ ਵਿੱਚ ਸਮਰਥ ਹੈ ।
5) The project proponent has proposed STP of capacity 140 KLD and has proposed to utilize treated effluent partially for the flushing purpose, to the green area and remaining (98 KLD) into M.C. sewer.
6) The project proponent has proposed to construct compost pits for in-house management of bio-degradable solid waste to be generated from the project premises in compliance to the Solid Waste Management Rules, 2016.
7) The project proponent has submitted approved layout plan of the project, wherein the plot area has been mentioned as 12805.43 sq. yards, which is less than 1,50,000 sq. meters. As such, the project not covered under the EIA notification dated 14.09.2006. Also as per layout plan, the green area of the project will be 181.24 sq. yards.
The site has already been visited by undersigned (AEE) on 14.11.2023 and it was observed as under:
1. The site of the project falls on the Cantt. Road, Fazilka and it has carried out construction of boundary wall at site. Construction of office premises was under process.
2. There is no MAH unit within the 250 mtrs from the boundary of the project. There is no brick kiln, cement plant, saila plant, rice sheller, stone crusher, grinding unit or hot mix plant within 100 mtrs of the site.
In view of above, the project proponent has now submitted compliance of the disposal of treated wastewater generated from its premises and management of solid waste. It is complying with the decisions of the personal hearing held before the Senior Environmental Engineer.
Keeping in view of above, it is recommended that the consent to establish (NOC) may be granted to the project proponent under the provisions of the Water Act, 1974 and the Air Act, 1981 for establishment of residential colony in an area of 4.73 acres for developing 83 no. of residential plots & 34 commercial shops in the revenue estate at Cantt Road, Fazilka, subject to the suitable conditions and specific as under:-
1) The project proponent shall comply with the conditions of CLU granted by Dept. of Local Govt. Punjab vide Memo No. PB/CLU/FKA/FAZIL/1437 dated 26-07-2022.
2) The project proponent shall install STP as per proposal before the commissioning of project.
3) The project proponent shall be liable to provide alternate arrangements (additional plantation area) for disposal of domestic effluent, as per actual quantum of effluent discharged from its premises.
