It is submitted that the project proponent was earlier granted Consent to Establish under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/SAS/2022/18078838 dated 19/04/2022 having validity upto 31/03/2023 for commercial project in an area of 10546 sqm (i.e. 2.6 acres), having total built up area of 14271 sqm, subject to certain conditions as mentioned therein. Thereafter, the project proponent was granted partial consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Fresh/SAS/2022/20056717 dated 05.12.2022 which was valid upto 04.12.2023 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Fresh/SAS/2022/20056711 dated 05.12.2022 which was valid upto 04.12.2023 for Partial CTO for operation of Block-A having built up area 3731 (36 showrooms on 9 plots of showroom site) subject to certain terms and conditions mentioned therein. Now, the project proponent has applied for obtaining varied consent to operate under green category under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for commercial project in an area of 10546 sqm (i.e. 2.6 acres), having total built up area of 14271 sqm alongwith requisite documents. The project proponent has deposited Rs. 180000/- vide R. No. 921253989 dated 16.01.2024 under Water (Prevention & Control of Pollution) Act, 1974 and Rs. 180000/- vide R. No. 114008114 dated 16.01.2024 under Air (Prevention & Control of Pollution) Act, 1981. The fee deposited by the project proponent is adequate upto 30.11.2031 after adjusting late fee / penalty against the total cost of the project Rs. 2915 lacs. The project proponent has submitted compliance report of the conditions of the previous granted consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. The project proponent has submitted analysis report of the effluent samples carried out by NABL approved laboratory i.e. M/s Chandigarh Pollution Testing Laboratory on 26.07.2023, the conc. of the parameters were found within the permissible limits of the Board as tabulated below: S. The project proponent has completed the construction of the commercial project. 2. The project proponent has provided occupancy in about 40-50 %. 3. The project proponent has installed STP of capacity 30 KLD and same was in operation during the visit. 4. The treated wastewater is being used for flushing purpose as well as onto land for plantation. 5. The project proponent is complying with the conditions of the previous granted consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. In view of the above, may if approved, it is recommended that consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 31.12.2030 subject to suitable conditions and following additional conditions that: 1. The project proponent shall perform / promote its Corporate Environment Responsibility (CER) activities as well as use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic. 2. The project proponent shall not discharge the effluent into any drain/choe/nallah/river/inland surface water under any circumstances in any case. 3. The project proponent shall ensure that there are no usages of single use plastic- thermocol disposable items such as water bottles / water pouches/water cups, plates, forks, spoons, straw etc. and single use decorating material made of plastic-thermocol or any other non-biodegradable material in the premises.
