The report and recommendation of Ro may be perused. Earlier, a complaint was received from smt. Neelam Rani resident of 25, Gopal Nagar, New Colony, Jalandhar regarding closure of workshop operating in residential area without getting Consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and under Air (Prevention and Control of Pollution) Act, 1981 of the Board. The service station was issued direction for sealing of washing section as the workshop was in non-designated area. Accordingly the industry was issued notice u/s 33-A of the Water Act (Prevention & Control of Pollution) Act, 1974 alongwith personal hearing before CEE, Jalandhar on 06.10.2022, wherein it was decided as under:-
1. The Environmental Engineer, Regional Office-1, Jalandhar shall visit the industry to seal the washing section and D.G set installed without canopy within 07 days.
2. Case be forwarded to Hon'ble Chairman of the Board for getting orders for imposition of Environmental Compensation, being a fit case as per record and the Committee constituted by the Board vide office order no. 260 dated 10.08.2022 shall calculate/evaluate the Environmental Compensation to be imposed on the industry.
Thereafter the service station was issued also issued directions for sealing of workshop as it was in non designated area.
Now the service station has submitted change of land use certificate from residential to commercial use issued from MTP, Municipal Corporation, Jalandhar vide their office letter No. 1369 dated 16.01.2024 in which it is stating that the process of the showroom and workshop washing centre is allowed.
May if approved:-
1. Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act 1974 as amended in 1988 be issued to de-seal the washing section and workshop.
2) Consent to operate under the Water Act 1974 & Air Act 1981 be granted to the service station upto 30.09.2028 with usual condition as per policy of the Board and with special condition as mentioned by Regional Office.
3) Fresh instructions /guidance be given regarding imposition of Environmental Compensation or not.
