It is intimated that earlier, the consent to operate under Water (Prevention& control of Pollution) Act, 1974 & Air (Prevention & control of Pollution) Act, 1981 were extended upto 30/06/2023 for the production of Washed Crushed Bajri @ 3400 CFT/day & Washed Sand @ 200 CFT/day by using River Bed Material @ 3600 CFT/day vide online reference No. CTOW/Renewal/GRP/2019/10070763 & CTOA/Renewal/GRP/2019 /10070858 dated 28/05/2019, respectively under orange category and this firm is Partnership Firm.
Now, the industry has applied for obtaining fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 for the operation of stone crusher through OCMMS in a totally paperless manner by uploading necessary documents as PDF due to change in the interest of operation of business of the firm, which is due to change in its partnership. The name & style of the firm has remained same i.e. M/s Ramwal Bajri Co., Village-Ramwal, P.O. Bianpur, Tehsil & District-Gurdaspur. As per the application form there is no change in land/production capacity and raw material of the industry.
The industry has submitted a New Partnership Deed and intimated that the previously the Stone Crusher was being run by partners namely Sh. Chander Mohan Walia S/o Sh. Prem Chand Walia and others. Now, the Stone Crusher is run by New Partners i.e. Sh. Randhir Singh S/o Sh. Mastan. There is no change in the pollution load of the stone crusher and no change in the raw material/production capacity and machinery.
The industry has deposited Rs. 22,100/- vide UTR No.
688724319 dated 13/02/2024 & Rs. 21,600/- vide UTR No.
317400453 dated 13/02/2024 as consent to operate fee under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 including Rs. 500/- as Form Downloading fee against total gross value of fixed assets worth Rs. 72,42,000/- as on 31/01/2024 and same are adequate upto 31/03/2029 under both Acts.
As per policy of the Board and in the light of Head Office Order No. 59 dated 02/02/2016, the consent cases of Orange Category units are to be processed without
visiting them (Agenda Note is also attached herewith).
In view of above, it is recommended that consent to operate under Water (Prevention& control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 30/09/2028 with suitable along with special conditions :-
1. The stone crusher shall comply with the orders of NGT in O.A. No 57/2020 or any relevant orders of Competent Authority in related matter.
2. The stone crusher shall maintain the plantation cover around the periphery so as to comply with the code of practice.
3. The stone crusher shall comply with the new Environmental Guidelines issued by the CPCB for the stone crushing unit.
4. The Stone Crusher shall comply with the orders of the Hon’ble Supreme Court issued in the CWP No. 202/95.
5. That board is at liberty to revoke the NOC/Consent to operate granted to the industry, if industry fails to comply with Environmental Guidelines issued by CPCB vide letter no. CP12/9/2022-IPC-V-HO-CPCB-HO dated 01/08/2023.
