It is submitted that the industry is a small scale green category unit. The industry was given personal hearing before the SEE, ZO-2, Ludhiana on 16.01.2024, wherein it was decided as under: -
1. The industry shall submit DTP certificate regarding land use pattern of the site as per Master Plan, Ludhiana wthin 01 month.
2. The industry shall apply for CTO under the Water Act, 1974 and Air Act, 1981, within 01 month.
3. EE, RO-4, Ludhiana shall visit the industry after 01 month to verify the contentions of the industry and process the consent application on merits.
Now, the industry has applied for obtaining fresh CTO under the Water Act, 1974 and Air Act, 1981 along with requisite documents under VDS scheme. The industry has deposited Rs. 17200 (including 10000/- as national fee as per VDS) as air consent fee vide R No. 364061904 dated 03.02.2024 and Rs. 18600/- (including 10000/- as national fee as per VDS) as water consent fee vide R No. 946894369 dated 03.02.2024 including 900/- as NOC regularization fee, which is adequate up to 31.10.2026 against the CA certificate of Rs. 7.06 Lacs.
The site was visited by the Er. Maninderjit Singh Kaler on 12.02.2024 and it was observed as under:-
1. The industry was in operation and engaged in manufacturing of auto parts.
2. The industry has installed 09 power presses, out of which 03 of 10 ton capacity, 02 of 05 ton capacity, 02 of 20 ton capacity 01 f 50 ton capacity and 01 of 75 ton capacity. The power presses of capacity 75 ton and 50 ton were found defunct. The industry has also installed 01 drill machine, 01 thread machine and 01 grinder.
3. There is no generation of trade effluent, only domestic effluent is being discharged into sewer.
4. No D.G. set has been installed.
5. The industry has submitted MSME certificate as a proof of date of commissioning i.e. 28.09.2006.
6. The industry has submitted an undertaking that there is no increase in machinery/pollution load since 2006.
7. The industry has submitted approved building plan from the Competent Person of the Director of Factories.
8. The industry has submitted DTP certificate vide letter no. 247 dated 25.01.2024 regarding the site is located within MC limit and is a residential zone as per the Master Plan of Ludhiana (2007-2031).
It is further submitted that the Department of Housing and Urban Development vide its notification no. 08/05/2023-441/2208 dated 06.10.2023 has allowed the existing industries lying in residential zone (within & outside MC) of Master Plan, Ludhiana for further 03 years i.e. from 11.09.2023 to 10.09.2026.
As such, the industry is complying with the provisions of Air Act, 1981 and Water Act, 1974.
In view of above, it is recommended that Consent to operate under Air (Prevention & Control of Pollution) Act, 1981 and under the Water (Prevention & Control of Pollution) Act, 1974 may be granted up to 10.09.2026 with usual conditions and special conditions as under: -
1. The industry shall comply with the conditions mentioned in notification no. 08/05/2023-441/2208 dated 06.10.2023 of Department of Housing and Urban Development.
2. The industry shall shift its unit to designated zone as and when asked by the Govt.
3. The industry shall not create any type of pollution in the vicinity.
4. The industry shall not operate its unit during night hours.
5. The industry shall always comply with the Noise Pollution (Regulation and Control) Rules, 2000.
