• It is submitted that the industry is a small scale orange category unit.
• A complaint was received from Sh. Bharat Bhushan S/o Harbhal Chand House no B-5/65 Mohalla Wadda Saipur, Jalandhar against Sh. Deshraj Heer S/o Puran Chand and Sh. Kulbhusan Heer S/o Desraj Heer regarding dumping of kachra (waste) from their industries in Dr. Ambedkar Park near the statue of Baba Sahib Wadda Saipur, Jalandhar
• To verify the facts, the site of the complaint was visited by officer of this office on 10/06/2022 and it was observed that no waste was observed near statue of Baba Sahib in the park, however few quantity of C&D waste was observed lying in the park. Further, the industry was visited by officer of the Board & observed that the industry is engaged in manufacturing of forged products on job basis. The industry has installed 2 no. presses, 4 no hammers, 2 no grinding machines, polishing addas and 2 no. metallurgical coal fired furnaces attached to stack Additionally, the industry has installed 3 no, presses which were lying disconnected. During visit, hammers and presses were not in operation and only 1 no. coal fired furnace was operational. The industry does not generate any trade effluent and domestic effluent is discharged into sewer. The industry has not applied consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act 1981.
• Accordingly the industry was issued show cause notice for violations of the provisions of the Water Act 1974 & Air Act, 1981 with hearing before Senior Environmental Engineer, Zonal office, Jalandhar on 26/8/2022, wherein it was decided as under:-
1. The industry shall submit the documentary proof regarding commissioning of unit and certificate regarding designation of area within 15-days.
2. The industry shall apply for fresh consent to operate under the Water Act, 1974 & Air Act, 1981 alongwith complete documents through OCMMS within 15- days.
3. The Environmental Engineer, Regional Office-1, Jalandhar shall visit the industry after 15-days and submit the detailed report alongwith recommendations accordingly.
• Thereafter, the industry was again visited by AEE of this office on 26.10.2022 and observed that the industry was not in operation at the time of visit. The industry has not submitted any documentary proof regarding commissioning of its unit and also has not submitted certificate regarding designation of area. The industry has failed to apply for consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and under Air (Prevention and Control of Pollution) Act, 1981.
• A complaint was again received Sh. Bharat Bhushan S/o Harbhal Chand House no B-5/65 Mohalla Wadda Saipur, Jalandhar against the industry regarding noise pollution created by the industry vide Govt. memo No. 478179 dated 21.12.2022.
• Thereafter, the industry was issued directions u/s 31-A of Air (Prevention and Control of Pollution) Act, 1981 with an opportunity of personal hearing before the Chief Environmental Engineer, Jalandhar on 13.03.2023, wherein it was decided as under: -
1. The industry shall take adequate measures to control noise and to achieve noise levels well within prescribed norms, within 15-days.
2. The industry shall apply for consent to operate under the Water Act, 1974 & Air Act, 1981 alongwith complete documents including proof regarding date of commissioning of industry & certificate regarding designation of area as per Master Plan through online system within 15-days.
3. The Regional Office-1, Jalandhar shall verify the status, measure noise levels after stipulated period and submit detailed report along-with recommendations, accordingly.
• In compliance of the decision of the hearing the industry was visited by AEE of this office on 04.09.2023 and it was observed that :-
1. The industry was in operation during visit and is engaged in manufacturing of forged products on job basis.
2. The noise monitoring was carried out during visit and results of the same is as under:

• It is further mentioned here that the National Green Tribunal (Principal Bench), New Delhi had passed order in the matter of bharat Bhushan V/s P.C Tools which is reproduced as under :-
1. The grievance of the applicant is noise pollution caused by three industries i.e. (1) P.C. Tools (2) Peeran Pupri Forgings (3) Heer Brothers Industry in Saipur, Jalandhar, Punjab causing health hazards and adversely affecting the environment.
2. Copy of this application be forwarded to the Regional Officer, Punjab Pollution Control Board (PPCB) to examine the matter and for taking proper necessary action. In case of noise pollution, necessary remedial measures must be initiated, in addition to assessment and realization of environmental compensation, accordance to the rules.
The application stands disposed of.
A copy of this order, along with copy of the application, be forwarded to PPCB by e-mail for compliance.
• Accordingly, the industry was issued show cause notice for violation of provisions under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. 139 dated 15.1.2024 alongwith personal hearing before Senior Environmental Engineer, Jalandhar on 23.1.2024, wherein it was decided that:-
1. The industry shall apply for consents under the Water (Prevention & Control of Pollution) Act 1974 and Air (Prevention & Control of Pollution) Act 1981 within 10 days
2. The Regional Office-1, Jalandhar shall visit the industry, verify the compliance made by the industry and submit report within 15-days.
• Now, the industry has applied for fresh consent to operate under Water (Prevention & Control of Pollution) Act 1974 and Air (Prevention & Control of Pollution) Act 1981 through OCMMS of the Board for manufacturing of Crowbar @ 200 nos/day by using Steel Rounds 350 Kgs/day as raw material and detail of the same is as under:-
1. The industry has deposited of Rs. 36500/- (i.e Rs. 34200/- under Water Act, 1974, Rs. 1800/- NOC fee, Rs. 500/- form fee) vide UTR. No. SBIN323269226012 dated 26.09.2023. Rs. 15000/- vide UTR No. SBIN223306572378 dated 02.11.2023 VDS Scheme and Rs. 37800/- (i.e 27000/- under Air Act, 1981, Rs. 10000/- under VDS Scheme, Rs. 800/- balance fee vide UTR. No. SBIN323269174458 dated 26.09.2023, Rs. 15000/- vide UTR No. SBIN223306571921 dated 02.11.2023 VDS Scheme, which is adequate upto 30.09.2031 against the fixed assets of Rs. 22.05 lacs.
2. The industry has submitted an approved building plan issued by the Competent person under Director of Factories Act, Punjab.
3. The industry has submitted an area classification certificate issued by ATP, Municipal Corporation, Jalandhar vide No. 1172 dated 18.08.2022, in which mentioned that the site of the industry falls in General Industrial Zone as per Master Plan, Jalandhar 2009-2031. Hence site of the industry is suitable.
4. The industry has submitted MSME certificate as proof of date of commissioning of the unit i.e April/1995.
5. The industry has submitted manufacturing process, Proprietorship certificate and registry of the land with the application.
6. The industry has also submitted affidavit with the application in which mentioned as under:-
" I, Des Raj Heer (Aadhar No.3617-1645-8113) S/O Puran Chand R/O B5/11, Saipur Kalan PO Industry Area, Dist Jalandhar, Punjab do hereby solemnly declare as under:
1. That I am permanent resident of above said address.
2. That my property situated at M/S P.C Tools, plot No. 1, Sanjay Gandhi Nagar, opp. Focal Point, Jalandhar, Khasra No. 15012, 15013, 15014, 15057, 30296/15058, 15088 as per Classification letter No. MTP/1172 Municipal Corporation Jalandhar record and on my Property paper.
3. That I am also running my Firm M/S P C Tools (Peeran Puri) Second unit on above address.
4. That I am prop. of both firm
5. That both firm names carry equal value, authenticity and legal validity.
The industry was visited by AEE of this office on 13.02.2024 and it was observed that:-
1. The industry was in operation during visit and is engaged in manufacturing of forged products on job basis.
2. The industry has installed 3 nos. kinematic hammer press of capacity (1 no. 60 kg, 100 kg and 50 kg), 01 no. Grinders, 1 no. polisher, 02 no. cutters, 01 no. drill machine, 1 no. hydraulic cutter, hydraulic press in its premises.
3. The industry has installed 03 nos. metallurgical coal fired furnace with adequate stack height.
4. There is no source of generation of trade effluent only domestic effluent is generated and same is discharged into sewer.
5. There is no source of trade effluent generation and only domestic effluent is discharged into sewer.
6. The industry is complying with the provisions under Water (Prevention & Control of Pollution) Act, 1974 and under Air (Prevention and Control of Pollution) Act, 1981.
The industry is a small scale orange category unit and competency to decide such type of cases lies with Senior Environmental Engineer, Zonal Office, Jalandhar.
Keeping in view of above, it is recommended that fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry upto 30.09.2029 with usual conditions as per policy of the Board.
