• The brick kiln is a small scale orange category unit.
• It is pertinent to mention here that a meeting was held by Hon’ble Chairman of the Board on 28.01.2020 with the Punjab Brick Kiln Association regarding compliance of Govt. orders dated 28.05.2019 wherein it was decided as under:
1. The Regional Offices of the Board are required to impose / charge environmental compensation from the brick kiln owners from 01.02.2019 to 30.09.2019 for the period for which the brick kilns are actually operated (without converting to the induced draught technology).
2. In case brick kiln is not operated after 30.06.2019 due to rainy season but the same brick kiln restarted its operations later on but without converting to induced draught technology, then environmental compensation will be levied for full period till the adoption of new technology.
3. In case, any brick kiln is still operating without adopting the induced draught technology, immediate action for closure of kiln / cancellation of license by DFSC shall be taken.
4. Following document shall be obtained from the BKOs to ascertain the actual period of operation of the kiln:
a) The Coal Register duly signed by the BKOs and getting an undertaking to the effect that the entries made in the Coal Register are true & correct, may be taken as a documentary evidence.
b) For the Brick Kiln, which are using other authorized fuel than coal such as agro fuels/biomass, may be asked to submit a self undertaking mentioning the period for which the BKOs had operated the Brick Kiln without conversion into Induced Draught Technology.
c) The documents as mentioned in Para a & b above are to be authenticated by the Charted Accountant.
5. Since the Brick kilns are generating and discharging very nominal quantity of domestic effluent and are of small scale, as such, the request of the association for exemption of fee for consent under the Water (Prevention & Control of Pollution) Act, 1974 be accepted and may be made applicable w.e.f 1.11.2018 subject to the ex-post facto approval of the Board.
• Now, the BKO has applied for fresh consent to operate under Water (Prevention and Control of Pollution) Act, 1974 through OCMMS of the Board for manufacturing of Bricks and Tiles @ 10,000 numbers/day by using Clay @ 40 Metric Tonnes/Day, Paddy straw based Pellets @ 0.6 Metric Tonnes/Day, Coal @ 2.4 Metric Tonnes/Day and detail is as under:-
1. The brick kiln has deposited Rs. 25200/- vide R. No. CBINH22131772289 dated 11.05.2022 under Water Act, 1974 adequate upto 31.03.2027 against the fixed assets of Rs. 21.20 lacs including 500% penalty for late application submission.
2. The brick kiln has submitted approved site plan cum location plan from competent person under factories Act, Punjab.
3. The brick kiln has submitted partnership deed and jamabandi with the application.
• The BKO was visited by Er. Manvinder Singh Hundal AEE (OS) of this office on 13.01.2024 and observed that the BKO was not in operation due to off season.
• There is no source of trade effluent generation and only generation of domestic effluent and has made arrangement for the disposal of domestic effluent onto land for plantation after septic tank.
The BKO falls in orange category and the competency to decide the case lies with Environmental Engineer, RO-1, Jalandhar.
Keeping in view of above, it is recommended that the fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 may be granted to BKO upto 30.09.2026 with usual conditions and special conditions that:-
1. The BKO will obtain Environmental Clearance under EIA notification for mining of brick clay to be used as raw material for manufacturing of bricks at site immediately.
2. The BKO will provide more plants along boundary wall.
