Sub: Proceeding of the personal hearing given before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 13.02.2024 w.r.t. show cause notice for refusal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 - M/s Verma Heat Treatement, ST No 3, Shanti Nagar, Ind Area C, Giaspura, Ludhiana.

The Add. Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry is a small scale orange category unit and it has applied for obtaining fresh 'Consent to Operate' under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
On perusal of the application of industry, it has been observed that the industry has been commissioned without NOC of the Board. The industry has failed to submit the documentary proof of permissibility to operate the unit at present site. The industry has not provided environmental data board at main entrance gate. The industry has installed rotary Furnace in which HSD is used as fuel but it has failed to install pollution control measures to control air emissions.
The industry is not complying with the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Thus, violating provisions of said Acts.
In view of above, the industry was issued show cause notice for refusal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 with hearing before the Senior Environmental Engineer of the Board on 13.02.2024.
Sh. Shubham Kumar, Proprietor of the industry attended the hearing and submitted written reply which has been taken on record. He submitted that the industry is on rent and falls in industrial area-C. He will submit site classification certificate from Competent Authority within 15 days. They have provided environmental data board at main entrance gate. They have provided hood with rotary furnace to exhaust the emissions.
After hearing the industry, officer of the Board and considering material facts on record, the Senior Environmental Engineer of the Board decided that:-
1. The industry shall submit the documentary proof of permissibility to operate the unit at present site.
2. The industry shall provide stack of adequate height with rotary furnace in which HSD is used as fuel.
3. The Environmental Engineer, Regional Office shall verify submission made by industry and send further recommendations in the matter.
Submitted for confirmation of decisions of the hearing and for conveying to the industry and Regional Office for compliance of above decisions, please.
