Sub: Proceeding of the personal hearing given before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 13.02.2024 w.r.t. show cause notice for refusal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974- M/s New Punjab Nickel Works, BXXIX83/6-P/1-C, Street No. 7, Near Jain Colony, Hargobind Nagar, Daba Road,, Ludhiana.

The Add. Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry is a small scale red category unit and it has applied for obtaining fresh 'Consent to Operate' under the Water (Prevention & Control of Pollution) Act, 1974.
The application of the industry has been perused and it has been observed that the industry has been commissioned without NOC of the Board.
The industry has failed to submit the documentary proof of permissibility to operate the unit at present site. The industry has not provided environmental data board at main entrance gate. As per MSME certificate submitted by industry date of commissioning is 06.12.2006 and date of udyam registration is 22.06.2023. It seems that the industry has been shifted from some other place to this location. The industry is required to clarify the above. Also, date of agreement with M/s JBR Technologies Ltd. Ludhiana is 19.07.2022.
The industry has not submitted record w.r.t. fresh water consumption and effluent lifting to M/s JBR Technologies Ltd. Ludhiana from 19.07.2022.
In view of above, the industry was issued show cause notice for refusal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 with hearing before the Senior Environmental Engineer of the Board on 13.02.2024.
Sh. Baljeet Singh, Proprietor of the industry attended the hearing and submitted that the industry is engaged in process of nickel platting. The industry was engaged in the process of buffing since 2006 and now installed electroplating plant in year 2022. They have agreement with M/s JBR Technologies Ltd. Ludhiana @ 3000 Ltr/month and they are properly maintaining record of water consumed for process and effluent lifted by JBR. The industry has submitted letter issued by MC, Ludhiana dated 06.06.2023 on name of Sh. Raghubir Singh Rohan, as per which the site falls under industrial mix zone.
After hearing the industry, officer of the Board and considering material facts on record, the Senior Environmental Engineer of the Board decided that:-
1. The industry shall submit the permissibility certificate from Competent Authority in view of installation of electroplating plant in the year 2022.
2. The industry shall get the trade effluent lifted to CETP operator regularly.
3. The industry shall maintain the record of water consumption in the process and trade effluent got lifted to CETP operator.
4. The Environmental Engineer, Regional Office shall verify submission made by industry and send further recommendations in view of installation of electroplating plant in the year 2022.
Submitted for confirmation of decisions of the hearing and for conveying to the industry and Regional Office for compliance of above decisions, please.
