Sub: Proceeding of the personal hearing given before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 13.02.2024 w.r.t. show cause notice for refusal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 - M/s Pooja Enterprises, Khasra No-1022, Khata No-300/334, Street No-1, Harpal Nagar, Industrial Area-C,, Ludhiana.

The Add. Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry is a small scale red category unit and it has applied for obtaining fresh 'Consent to Operate' under the Water (Prevention & Control of Pollution) Act, 1974.
The application of the industry has been perused and it has been observed that the industry has been commissioned without NOC of the Board. As per MSME certificate submitted by industry date of commissioning is 03.02.2020 and date of Udyam Registration is 26.11.2020. It seems that the industry has been shifted from some other place to this location. The industry is required to clarify the above.
The date of agreement with M/s JBR Technologies Ltd. Ludhiana is 23.10.2023. The industry has not submitted record w.r.t. fresh water consumption and effluent lifting to M/s JBR Technologies Ltd. Ludhiana from 26.11.2020 to 23.10.2023. Also, the industry needs to clarify for disposal of trade effluent from 26.11.2020 (date of commissioning) to 23.10.2023 (date of agreement with JBR).
The industry is not complying with the provisions of Water (Prevention & Control of Pollution) Act, 1974. Thus, violating provisions of said Act.
In view of above, the industry was issued show cause notice for refusal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 with hearing before the Senior Environmental Engineer of the Board on 13.02.2024.
No one from industry attended the hearing and not submitted any written reply.
After hearing the industry, officer of the Board and considering material facts on record, the Senior Environmental Engineer of the Board decided that:-
1. The consent to operate applied by industry under the Water (Prevention & Control of Pollution) Act, 1974 be refused.
2. Further action u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 be recommended to CEE Ludhiana.
Submitted for confirmation of decisions of the hearing and for conveying to the industry and Regional Office for compliance of above decisions, please.
