Sub: Proceeding of the personal hearing given before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 13.02.2024 w.r.t. show cause notice for refusal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 - M/s RPK Steels Rolling Mills (P) LTD., Pahruwal Road, Village Jandiali, Ludhiana.

The Add. Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry was granted 'Consent to Operate' under Water Act, 1974 and Air Act, 1981 both valid upto 30.09.2025 for manufacturing of Steel Ingots @36TPD by using of PIG IRON/I C SCRAP @ 36 TPD and with induction furnace of capacity 4.5 TPH.
The industry has now applied for obtaining varied consent to operate under the Water Act, 1974 and Air Act, 1981 by replacing induction furnace of capacity 4.5 TPH with induction furnace of capacity 7 TPH and production has been increased from 36 TPD to 80 TPD.
The industry has submitted Completion certificate issued by Punjab State Council for Science & Technology vide letter no PSCST/TFD/82 dated 17.05.2023 as per which installed induction furnace is of 7 TPH capacity and it seems that production capacity will be 7 x 16 heat x 320 days = 35840 Ton/year which cover under Environmental Clearance. The industry has failed to obtain Environmental Clearance as required under EIA Notification, 2006.
The industry has failed to submit analysis report of air emissions.
The industry has not submitted compliance of conditions of NOC granted to it under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
The industry is not complying with the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Thus, violating provisions of said Acts.
In view of above, the industry was issued show cause notice for refusal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 with hearing before the Senior Environmental Engineer of the Board on 13.02.2024.
Sh. Parmod Kumar, Director of the industry attended the hearing and submitted written reply which has been taken on record. He submitted that the industry is engaged in manufacturing of Steel Ingots and installed induction furnace of capacity 7 TPH by replacing induction furnace of capacity 4.5 TPH. Actual production is 26880 Tonn/year and the industry is not covered under Environmental Clearance. He submitted compliance of conditions of NOC granted to it.
After hearing the industry, officer of the Board and considering material facts on record, the Senior Environmental Engineer of the Board decided that:-
1. The industry shall operate its APCD regularly and efficiently so as to achieve the prescribed standards of the Board.
2. The industry shall maintain record regarding regular operation of the APCD.
3. The Environmental Engineer, Regional Office shall re-verify the production capacity of the industry.
4. The Environmental Engineer, Regional Office shall verify submission made by industry, collect air emission sample and send further recommendations after verifying the compliance of NOC conditions.
