Sub: Proceeding of the personal hearing given before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 13.02.2024 w.r.t. show cause notice for refusal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 - M/s Laxmi Udyog, Rana Gas Lane, Sherpur Khurd, Ludhiana.

The Add. Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry was granted consent to operate under the Water Act, 1974 vide no. CTOW/Renewal/LDH1/2020/12746864 dated 17/07/2020 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/LDH1/2020/12746843 dated 17/07/2020 both valid upto 30/06/2025.
The industry has applied for obtaining varied consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
Earlier, the industry was lifting effluent to re-processor as it was using sulphuric acid as raw material. Now, the industry has started using HCl as raw material and made fresh agreement with M/s JBR Technologies Ltd. Ludhiana from September 2023. The industry has not submitted proof regarding use of sulphuric acid from Jan 2023 to Aug 2023.
On perusal of application, it has been observed that the industry has not submitted record of water consumption as well as lifting of effluent to re-processor from January 2023 to Aug 2023. The industry has also not submitted record of water consumption as well as lifting of effluent to CETP operator from Sept 2023 to Jan 2024. The industry exists at Rana Gas Lane, Sherpur Khurd, and it has failed to submit the documentary proof of land use pattern of the area.
In view of above, the industry was issued show cause notice for refusal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 with hearing before the Senior Environmental Engineer of the Board on 13.02.2024.
Sh. Karan Dhingra, Partner of the industry attended the hearing and submitted written reply which has been taken on record. He submitted that the industry is engaged in electroplating and pickling process. They have made agreement for lifting of effluent arising from electroplating process with CETP operator i.e. M/s JBR Technologies Ltd. Ludhiana, Unit-1 at phase-8, Focal Point Ludhiana and same has been renewed in the year 2023. The industry has also made agreement for lifting of effluent arising from pickling process with re-processor i.e. M/s JBR Technologies Ltd. Kohara, Ludhiana in the year 2019 for using sulphuric acid and now made fresh agreement with CETP operator i.e. M/s JBR Technologies Ltd. Ludhiana, Unit-1 at phase-8, Focal Point Ludhiana for using HCl on 10.12.2021. They are maintaining proper record of water consumption and effluent lifting by JBR.
After hearing the industry, officer of the Board and considering material facts on record, the Senior Environmental Engineer of the Board decided that:-
1. The industry shall get the trade effluent lifted to CETP operator regularly.
2. The industry shall maintain the record of water consumption and trade effluent got lifted to CETP operator for electroplating and pickling process, separately.
3. The Environmental Engineer, Regional Office shall verify submission made by industry and send further recommendations in the matter.
