Sub: Proceeding of the personal hearing given before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 13.02.2024 w.r.t. show cause notice for refusal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 - M/s Shiv Shakti Impex, Maan Kanda Wali Gali, Kabir Colony, Village Jaspal Bangar, Ludhiana.

No one attended the hearing
The Add. Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry is a small scale red category unit and has applied for fresh of consent to operate under Water (Prevention & Control of Pollution) Act, 1974.
The industry has been established without NOC of the Board.
The site of industry was visited by officer of the Board on 01.02.2024 and it was reported as under:-
1. The industry was in operation during visit and engaged in process of H.B. wire.
2. The industry has signed agreement with M/s JBR Technology Pvt. Ltd., Focal Point, Phase-8 Ludhiana @ 2500 Ltr/M for the treatment & disposal of trade effluent generated from process.
3. The industry could not show any record of water consumption and effluent lifting. 4. The house keeping of the industry is poor.
4. The industry has not any certificate regarding site suitability of the industry.
In view of above, the industry was issued show cause notice for refusal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 with hearing before the Senior Environmental Engineer of the Board on 13.02.2024.
No one from industry attended the hearing and not submitted any written reply.
After hearing the industry, officer of the Board and considering material facts on record, the Senior Environmental Engineer of the Board decided that:-
1. The consent to operate applied by industry under the Water (Prevention & Control of Pollution) Act, 1974 be refused.
2. Further action u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 be recommended to CEE Ludhiana.
Submitted for confirmation of decisions of the hearing and for conveying to the industry and Regional Office for compliance of above decisions, please.
