Renewal CTO Water + Air Applied
Earlier, the industry was granted consent to operate under Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/ASR/2023/22108051 dated 11/07/2023 up to 31/12/2023 And Under Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/ASR/2023/22108054 dated 04/02/2022 up to 31/12/2023 for Electroplating (on job basis) @ 20Kgs/day subject to the suitable condition mention therein and temporary restore the electric connection of the industry for six months.
Directions us/ 33-A of the Water (Prevention & Control) Act, 1974 were issued to PSPCL authorities Zonal Office for temporary restore the electric connection of the industry for six months i.e. upto 31/12/2023.
The industry had applied for obtaining renewal of the consent through OCMMS. The industry was visited 08.01.2024 and was observed that the industry was violating the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Consent applications of the industry were revoked vide letter no 166 dated 15.01.2024 after affording an opportunity of show cause inwriting.
Now the industry has applied for renewal of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 details of the case are as under: -
1. The industry has submitted CA certificate dated 20.12.2023, with value of gross fixed assets as Rs. 4.04 Lacs. It has already deposited Rs 9800/- (including penalty @ 350/-) vide UTR No. SBIN121156215529 under Water Act, 1974 and Rs. 9800/- (including penalty @ Rs 350) vide UTR. No. SBIN121156218843 under Air Act, 1981. Rs. 2475/- vide UTR No. SBIN522306156705 dated 02.11.2022 as consent fee under Water Act, 1974, Rs. 2475/- vide UTR No. SBIN522306162848 dated 02.11.2022 as consent fee under Air Act, 1981, which is adequate upto 30/09/2028 under both acts.
2. Now the industry has a submitted revised agreement made with CETP - M/s JBR Technologies Pvt. Ltd., Ludhiana for lifting of effluent @ 2000 Lts./Month, valid for a period upto 18.01.2027.
3. The industry has submitted building plan prepared by approved architect under Factory Act, 1948.
The site was visited by undersigned on 14.02.2024 and observed as following: -
1. During visit, industry was in operation.
2. The industry has installed 02 no. barrels, 02 no. rotating drums for purpose zinc plating of different machine parts on job basis.
3. The industry has installed a water flow meter on fresh water line leading to process whose reading was 50290 lts. at the time of visit.
4. The industry has provided underground storage tank of unknown capacity for storage of effluent to be disposed off to JBR Private Ltd.
5. The industry has now maintained the record of fresh water consumption in the process and quantity lifted to the JBR technology. Record maintained by the industry found balanced in respect of water consumed and lifted to the JBR technology.
The industry is now complying the with the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
In view of above, it is therefore recommended that:
1. Directions us/ 33-A of the Water (Prevention & Control) Act, 1974 may be issued to the PSPCL Authorities to continue the electric supply to the industry temporarily for further 06-months.
2. Consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry for the period of 06 months with special conditions that:
