1. It is intimated that the industry is a small scale orange category unit.
2. Earlier, a complaint has received against industry regarding air pollution being caused by the industry due to burning of waste. As such, the industry was visited by officer of this office and found violations during the visit.
3. Thereafter, the industry was issued notice u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 with opportunity of personal hearing before the Chief Environmental Engineer, Jalandhar on 17.12.2023. After hearing, the Chief Environmental Engineer, Jalandhar decided that:-
A. The industry shall submit Bank Guarantee of Rs. 25,000/- as an assurance not to burn any waste in its premises and to comply with the provisions of the Air (Prevention & Control of Pollution) Act, 1981.
B. The Environmental Engineer, Regional Office-2, Jalandhar shall visit the industry verify the compliance made by the industry and process the application on merit.
4. In compliance of the decisions of the personal hearing, the industry has submitted Bank Guarantee of Rs. 25,000/- bearing no. 01161BGD24000001 dated 25.01.2024, valid upto 24.01.2025.
5. Now, the industry has applied for fresh consent to operate under Water (Prevention and Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 through OCMMS of the Board.
6. The industry has deposited Rs. 5500/- vide R. no CBINH24025442613 dated 25.01.2024, Rs. 4400/- vide R. no CBINH24025442613 dated 25.01.2024 as balance fee and Rs. 4400/- vide R. no CBINH24025442613 dated 25.01.2024 as penalty fee under Water (Prevention & Control of Pollution) Act, 1974 and Rs. 5500/- vide R. no CBINH24025442571 dated 25.01.2024, Rs. 4400/- vide R. no CBINH24025442571 dated 25.01.2024 as balance fee, Rs. 4400/- vide R. no CBINH24025442571 dated 25.01.2024 as penalty fee and Rs. 1100/- vide R. no CBINH24025442571 dated 25.01.2024 as NOC fee under Air (Prevention & Control of Pollution) Act, 1981 through IMPS. The fee adequacy is valid upto 31.03.2029.
7. The industry has submitted land use classification certificate from Municipal Corporation, Phagwara vide no. 4351 dated 10.03.2016 as per which the industry falls in industrial zone.
8. To verify the facts, the industry was visited by EE alongwith AEE of this office on 14.02.2024 & observed that:-
1. The industry was in operation during the visit.
2. The industry has installed 02 mixers in which raw material including sand, dolomite, cement and resins are mixed.
3. No other manufacturing process or machinery provided.
4. The whole of processing area and raw material storage area is inside covered shed.
5. The industry has now stopped burning the discarded plastic material as the industry uses inert materials such as sand which come in these plastic drums, these drums are not hazardous.
6. Domestic effluent is discharged into sewer.
Recommendations:-
Keeping in view of above, it is recommended that consent to operate under Water (Prevention and Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry upto 30.09.2028 with suitable condition.
