File Note: It is intimated that the brick kiln was granted consent to operate under Air (Prevention & Control of Pollution) Act, 1981 vide no. ASR/APC/2005/F-15 dated 15/06/2005, which was valid upto 31/03/2011 for gravity dust settling chamber. The brick kiln was visited by JEE (OS) on 28.09.2023 to verify its latest status and observed that the BKO that the brick kiln was not in operation and has converted brick kiln from natural draft to induced draft technology. Accordingly, personal hearing recommended to Zonal Office, Amritsar for non-compliance of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Now, the subject cited brick kiln has applied for varied consent to operate under Air (Prevention & Control of Pollution) Act, 1981 and fresh consent under Water (Prevention & Control of Pollution) Act, 1974 along with compliance report, CA Certificate and request letter. The brick kiln has deposited Rs. 49400/- vide UTR No. POD010247097 dated 30.01.2024 as consent fee under Water (Prevention & Control of Pollution) Act, 1974, Rs. 2900/- vide UTR No. POD010247533 dated 30.01.2024 as NOC regularization fee, Rs. 500/- vide UTR No. POD010247387 dated 30.01.2024 as application form fee, Rs. 49400/- vide UTR No. POD010247194 dated 30.01.2024 as consent fee under Air (Prevention & Control of Pollution) Act, 1981 and Rs. 8700/- vide UTR No. POD010247272 dated 30.01.2024 as penalty under Air Act, 1981 to make the consents fee adequate up to 30/09/2029 under both Acts against the fixed assets of the industry below 50 Lakhs. The Brick Kiln has submitted the copy of Design adequacy cum Completion certificate issued by Punjab State Council for Science & Technology, vide no. PSCST/CC/1103 dated 06/03/2020 wherein, it is mentioned that the subject cited brick kiln has constructed Induced Draft Brick Kiln with Zig-Zag firing as per technology evolved by Punjab State Council for Science & Technology. The Brick Kiln has also submitted the copy of dimensional drawing/plan of Kiln showing the length of Central Island of brick kiln is less than 245 ft. The brick kiln has also submitted coal consumption Certificate duly authenticated by C.A. Atinder & Associates regarding that the brick kiln has closed down its operations on Feb 2019 to Feb 2020 and no activity had been performed during the aforesaid period. The brick kiln has submitted partnership deed dated 31.05.2010 partnership deed Sh. Gurabax Singh and Sh. Lakhbir Singh are the current partner of the firm. The subject cited brick kiln was visited by AEE on 14/02/2024 and observed as under: - 1) The brick kiln was not in operation at the time of visit. 2) The brick kiln has been converted into Induced draft technology with zig-zag settings. 3) The passage around the vessel was stabilized with Brick Bats & Keri etc. 4) The approach road to the Brick Kiln is pre-mix carpeted. 5) The brick kiln has provided adequate stack fitted with induced draft fan. 6) No un-authorized fuel found stored in the premises of the brick kiln at the time of visit. 7) The BKO has planted trees along the boundary of the kiln. However, it was guided to plant more saplings in coming season. Keeping in view of the above, if approved, a. Varied consent to operate under Air (Prevention & Control of Pollution) Act, 1981 and fresh consent to operate Water (Prevention & Control of Pollution) Act, 1974 may be granted to the brick kiln for a period up to 30.09.2029 (upto validity of fee deposited) with the conditions as under: - 1. The brick kiln shall use 20 % paddy straw pallet by replacing coal as per office order issued by the Board. 2. The consent is subject to the orders passed by the Hon’ble High Court for the state of Punjab & Haryana/Hon’ble National Green Tribunal or other judiciary authority in the cases pending or being filed with regard to the subject matter of the office order. 3. The consent is subject to the performance evaluation of new technology adopted by the brick kiln. 4. The brick kiln will plant adequate trees around the boundary of the Brick Kiln.
