The industry has applied for fresh ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, under Green Category for manufacturing of for manufacturing of Tile Adhesive @ 6300 Kgs/day, Tile Grout @ 43 Kgs/day and Epoxy @ 100 Kgs/day, along with requisite document.
The industry has establish its unit without obtaining ‘Consent to establish’ from PPCB and has directly applied for obtaining ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
The industry has deposited Rs. 14500/- vide R no. 636776623 dated 03.02.2024 and Rs. 9000/- vide R. no. 117974047 dated 14.02.2024 under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 14500/- vide R. no. 916391593 dated 03.02.2024 and Rs. 12000/- vide R. no. 143842524 dated 14.02.2024 under the Air (Prevention & Control of Pollution) Act, 1981, which is adequate upto 30.09.2026, (Considering late fee and NOC regularization fee) for both the Acts against the assets of Rs. 50.41 lakhs on 03.01.2024.
Suitability of Site:
The industry has submitted a copy of land use classification letter issued by DTP SAS Nagar vide letter no. 596 dated 05.04.2022, wherein it has mentioned as under:
“ਉਪਰੋਕਤ ਵਿਸ਼ੇ ਅਤੇ ਹਵਾਲੇ ਅਧਿਨ ਪ੍ਰਾਪਤ ਦੇ ਸਬੰਧ ਵਿੱਚ ਇਹ ਦੱਸਿਆਂ ਜਾਂਦਾ ਹੈ ਕਿ ਪਿੰਡ ਭੰਗਵਾਨਪੁਰ (ਹ.ਬ.ਨੰ. 199), ਦਾ ਖਸਰਾ ਨੰਬਰ 1021/276(2-0) ਕੁੱਲ ਰਕਬਾ 2 ਬਿੱਘੇ 0 ਬਿਸਵੇ 0 ਬਿਸਵਾਸੀ ਦਾ 284/800 ਹਿੱਸਾ ਕੁੱਲ ਰਕਬਾ 0 ਬਿੱਘਾ 14 ਬਿਸਵੇ 7 ਬਿਸਵਾਸੀ ਦਫਤਰੀ ਰਿਕਾਰਡ ਵਿੱਚ ਉਪਲੱਬਧ ਰਿਜਨਲ ਪਲੈਨ, ਗਮਾਡਾ, ਐਸ.ਏ.ਐਸ ਨਗਰ ਦੇ ਐਫ.ਈ.ਜੈਡ ਖੇਤਰ ਅਧੀਨ ਪੈਂਦੇ ਹਨ। ਜੇਕਰ ਆਪ ਵੱਲੋ ਮੌਕੇ ਤੇ ਕੋਈ ਉਸਾਰੀ ਕੀਤੀ ਹੋਈ ਹੈ ਜਾਂ ਕੀਤੀ ਜਾਂਣੀ ਹੈ ਤਾਂ ਸਾਈਟ ਵਿੱਚ ਕਿਸੇ ਵੀ ਤਰ੍ਹਾਂ ਦੀ ਐਕਟੀਵਿਟੀ ਕਰਨ ਤੋਂ ਪਹਿਲਾ ਉਸ ਸਬੰਧੀ ਮੰਨਜੂਰੀ ਇਸ ਵਿਭਾਗ ਅਤੇ ਹੋਰ ਵਿਭਾਗਾ ਤੋ ਪ੍ਰਾਪਤ ਕਰਨ ਦੇ ਪਾੰਬਦ ਹੋਵੇਗੇ। ਉਪਰੋਕਤ ਕਲਾਸੀਫਿਕੇਸ਼ਨ ਆਪ ਵੱਲੋ ਪੇਸ਼ ਕੀਤੇ ਗਏ ਦਸਤਾਵੇਜ਼ਾ ਦੇ ਸਨਮੁੱਖ ਜਾਰੀ ਕੀਤੇ ਗਏ ਹਨ।
ਇਸ ਪੱਤਰ ਨੂੰ ਵਿਸ਼ੇ ਅਧੀਨ ਸਾਈਟ ਦਾ ਲੈਂਡ ਯੂਜ਼ ਕਲਾਸੀਫਿਕੇਸ਼ਨ ਸਰਟੀਫਿਕੈਂਟ ਹੀ ਸਮਝਿਆ ਜਾਵੇ। ਇਸ ਲੈਂਡ ਯੂਜ਼ ਕਲਾਸੀਫਿਕੇਸ਼ਨ ਸੀ.ਐਲ.ਯੂ ਦੀ ਪ੍ਰਵਾਨਗੀ ਜਾ ਕਿਸੇ ਕਿਸਮ ਦਾ ਐਨ.ਓ.ਸੀ ਨਾ ਸਮਝਿਆ ਜਾਵੇ।”
Thus, the site of the unit is suitable.
The industry has submitted a copy of GST registration certificated dated 14.05.2021, as a proof of date of commissioning of the unit, along with the online application form.
The industry has also submitted a copy of building plan signed by Er. Ajaypal Singh Rehal, Competent Person of Director of Factories of Punjab.
The industry has submitted a copy of registry dated 10.12.2020 executed between Sh. Sunil Kumar and Smt. Sunahari Devi for Khasra no. 1021//276 (2-0).
Visit:
Accordingly, the industry was visited by AEE of this office on 09.02.2024 and during visit, it was observed as under:
1. The industry is engaged in manufacturing of tile adhesive, tile grout and epoxy and was in operation.
2. The industry has installed 02 no. of small mixers of mixing of cement, sand & cement sand and glue for manufacturing of tiles adhesive and tile grout. No visible dust emissions were seem generating from these mixers during visit.
3. The industry has installed one no. of tubewell in its premises and flow meter is yet to be installed with the same.
4. The project proponent has constructed septic tank, after which domestic effluent shall be used onto land for plantation done along the boundary wall.
5. The industry is not carrying out any trade effluent generating process in its premises.
6. The project proponent has installed not installed any boiler, furnace etc., or any source of air pollution in its premises.
7. The industry has not installed any DG set in its premises.
From above, it is clear that the industry is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
Recommendations:
In view of above, if may approved, the industry may be granted fresh ‘consent to operate’ granted to the industry under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, upto 31.12.2025 with usual conditions & with following special conditions:
1. The industry shall not carry out any activity, which can change in category from Green to Orange or Red, under any circumstances.
2. The industry shall establish and operate its unit only in Khasra nos. for which the industry has obtained land use classification letter from the Department of Town and Country Planning.
3. The industry shall not generate and discharge any kind of trade effluent from its premises and shall discharge only domestic effluent onto land for plantation in its premises after passing through septic tank.
4. The industry shall not discharge the effluent into any drain/choe/nallah, in any case.
5. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances.
6. The industry shall not install any boiler/furnace or any source of air pollution in its premises, without prior permission from PPCB.
7. The industry shall ensure that no problem related to pollution is being caused by the unit due to its operation and no public complaints are received by the Board in this regard.
8. The project proponent shall comply with the guidelines issued by PWRDA and shall obtain permission from PWRDA for abstraction of ground water (as applicable).
9. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time.
10. The industry shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time.
11. The ‘consent to operate’ is being issued to the project proponent based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing.
12. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent.
