File Note: Sir, case could not be processed due to maintenance of OCMMS server from 15.02.2024 to 19.02.2024. It is submitted that earlier in the premises of M/S Tech Tube Enterprises, 2nd Mile Stone, G.T.Road, Doraha, M/s Technico Strips & Tubes Pvt. Ltd was in operation. The industry (i.e. M/S Technico Strips & Tubes Pvt. Ltd ) was issued notice u/s 33-A of the Water Act, 1974 and u/s 31-A of the Air Act, 1981 alongwith notice to issue directions u/s 5 of the Environment (Protection) Act, 1986 with personal hearing before Chairman of the Board on 16.06.2023 in which following decisions were taken:- 1.    The industry shall comply with all the violations stated as above, immediately. 2.    A copy of a written replies submitted by both the units be sent to the Senior Law Officer of the Board for legal examination and to comment regarding the liability of industry regarding previous violations by M/s Technico Strips & Tubes. 3.   On Best Assessment and Judgment, the industry shall deposit Rs. 10 lacs to the Environmental Engineer, Regional Office-2, Ludhiana, within 15 days as Environmental Compensation for the damage caused to the Environment. 4.    The Environmental Engineer, Regional Office-2, Ludhiana shall personally visit the industry to verify the status of Pollution control measures adopted by the industry. 5.    Applications for consents to operate submitted by the industry be processed by the Regional Office after the compliance as above. To verify the compliance of the decisions of personal hearing dated 16.06.2023, the industry was visited by AEE of this office on 15.11.2023 and report was sent to Zonal Office-I, Ludhiana vide e-noting on dated 25.11.2023. Thereafter, industry was applied for fresh consents of the Board under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 alongwith documents & Fee on 07.12.2023. These consent applications were processed and industry was issued Show cause notice for refusal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 with an opportunity of personal hearing before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 02.01.2024 in which it was decided as under: - 1.The industry shall get its trade effluent lifted to CETP operator regularly. 2.The industry shall maintain the record of water consumption in the process and trade effluent got lifted to CETP operator. 3.The industry shall discharge only domestic effluent onto land for plantation through septic tank. 4.The industry shall submit Bank Guarantee of Rs. 50,000/- as an assurance to comply with provisions of the Water (Prevention &Control of Pollution) Act, 1974 before 31.01.2024. 5.The industry shall submit balance amount of Environmental Compensation of Rs. 5.0 Lac upto 31.01.2024 in Regional Office. 6.The Environmental Engineer, Regional Office shall verify submission made by the industry and send further recommendations in the matter. But, on the submission of the representative of the industry during hearing dated 02.01.2024 to make the corrections in the name of industry from Tube Tech Enterprises to Tech Tube Enterprises, the consent applications were returned to the industry on 06.02.2024. Now, the industry has applied for Fresh Consents to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 in the corrected name of the industry i.e. M/S Tech Tube Enterprises on 12.02.2024. 1.As per documents submitted by the industry, it has purchased the industry in auction from Indian Bank, SAM Branch. 165-lndustrial Area A. Cheema Chowk Ludhiana on 29.03.2023. 2.The industry has submitted the Udyam Registration Certificate No. PB-12-0111919 dated 01.04.2023 and GST No. as proof w.r.t. date of commissioning w.e.f. 01.04.2023. 3.As per CA Certificate the total fixed assess of the industry is Rs. 1029.26 lacs as on 03.04.2023, out of which the cost of Plant & Machinery is Rs. 175.20 Lacs. 4.The industry has submitted the site plan duly signed by Competent Person from the Director of Factories, Punjab. 5.The industry has made agreement with M/s JBR Technologies Pvt Ltd, Ludhiana for lifting of trade effluent generated from pickling/ phosphating section @ 1,45,000 Lts/Month on 05.04.2023. 6.The industry has deposited the Consent/NOC fee as under:- Rs. 1,80,000/- vide UTR No. N097232408756102 dated 07.04.2023 as Consent Fee under the Water Act, 1974. Rs. 1,80,000/- vide UTR No. N097232408733761 dated 07.04.2023 as Consent Fee under the Air Act, 1981. Rs. 18,000/- vide UTR No. N097232408752598 dated 07.04.2023 as NOC Fee. The Consent fee deposited by the industry is adequate upto 31.03.2028. The industry was lastly visited by the undersigned (AEE) on 15.01.2024 and observed as under: - (i)The industry is engaged in the process of manufacturing pipe/Tubes using HR/CR/HROP/Coils as Raw Material. (ii)It has installed LPG fired annealing furnace to whom adequate stack height and sampling arrangements have been provided. (iii)The industry has provided side suction hood with its phosphate tank which is further attached to wet scrubber to whom adequate stack height with sampling arrangements have been provided. (iv)Now, the industry has provided the suction hood with its pickling Tank which is further attached to wet scrubber to whom adequate stack height and sampling arrangements have been provided. (v)It has provided Sub Energy Meter with its APCD and reading of the same was 44548 KWh. (vi)The industry has made agreement with M/s JBR Technologies Pvt Ltd, Ludhiana for lifting of trade effluent generated from pickling/ phosphating section @ 1,45,000 Lts/Month on 05.04.2023. (vii)The industry has provided the water meters with its (i) Submersible pump and reading of the same was@ 1917 KL, (ii) Surface Treatment Plant-I @ 442 KL, (iii) Surface treatment Plant-II @ 1 KL, (iv) Other Domestic usage @ 1319 KL. (viii)Now, the industry is maintaining the record of water consumption in process area and lifting to the operator of CETP. As per record maintained by the industry, the O/B of effluent stored in storage tank was 20.50 KL as on 01.12.2023. It has consumed 178 KL fresh Water during the period 01.12.2023 to 15.01.2024, hence Total= 20.50 KL+178 KL=198.5 KL and it has lifted 191 KL of effluent during said period and appox. 1.8 KL of effluent was lying stored in storage tank, which is synchronized considering evaporation loss. (ix)The industry is lifting its trade effluent to the CETP operator on regular basis. (x)Now, the industry has improved the health of Septic tank and domestic effluent is discharged onto land for plantation. (xi)It has installed a D.G.Set of 380 KVA with canopy and adequate stack height. (xii)Now, the industry has provided the Hazardous Waste Storage room with Danger Signed and it has also provided Environment Data Board at the entrance gate of the industry. (xiii)The industry has submitted a Bank Guarantee of Rs. 50,000/- of Union Bank of India, Shakti Nagar, Ludhiana bearing No. 778701GL0000124 dated 23.01.2024 which is valid upto 23.01.2025. (xiv)The industry has deposited Rs. 5,00,000/- at the time of hearing dated 02.01.2024 and remaining amount of Rs. 5,00,000/- has been deposited vide this office R.No. 92/5496 dated 29.01.2024 as Environmental Compensation in compliance to the decisions of personal hearing dated 16.06.2023 taken by Worthy Chairman of the Board. (xv)The consent fee deposited by the industry is adequate upto 31.03.2028. Keeping in view of the above, it is recommended that Consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 may be Granted to the industry upto 30.06.2027 with usual conditions.
