File Note: It is submitted that the industry is small scale orange category unit. Earlier the industry was visited by the officer of this office on 06.06.2022 and it was observed that the industry has installed induction furnace of capacity 100 kg/heat. The industry has not provided any APCD to contain emissions generated from the furnace. Thereafter, notice u/s 31-A of the Air Act, 1981 has been issued to the industry with opportunity of personal hearing before the Chief Environmental Engineer, Ludhiana on 11.09.2023 and wherein it was decided that: - 1. Directions u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 be confirmed for closure of the industry and disconnection of electric supply available to the premises of the industry by PSPCL authorities. 2. Regional Office to seal the DG set (s) if any for effective implementation of directions. In compliance of the above said directions u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 following action were taken: 1. Executive Engineer, PSPCL was also written vide this office letter no. 2287 dated 28.09.2023 to disconnect the electric supply of the industry with immediate effect and same was sent through email dated 28.09.2023. 2. The industry was visited by on 18.10.2023 to seal the DG set however the industry was found closed. Then industry was again visited by undersigned on 27.10.2023 and it was observed that the industry has not installed DG set in it premises. The industry was in operation in violation to the directions issued by the Board vide no. 5714 dated 22.09.2023. Thereafter, the industry has request letter dated 25.11.2023 in this office wherein it has been informed that the work of installation of air pollution control device has been halted due to electric disconnection. Further, the industry has requested that electric connection may be restored for the manufacturing of APCD. It is added here that the request letter the industry has submitted feasibility report from the PSCST vide no.457 dated 02.11.2023 alongwith the receipt of fee deposited in the PSCST. The industry has submitted TDCO no. 274/8 dated 17.11.2023. It is added here that the industry was visited on 04.12.2023 and Sh. Prince Shakarwal was contacted. During visit, it was found that the industry was not in operation due to electric disconnection. Now, the industry has applied for Consent to Operate under the Water Act, 1974 and Air Act, 1981 through OCMMS. The industry has deposited consent fee of amounting to Rs. 23,400/- vide R.No. 915963381 dated 10.01.2024 under the Water Act, 1974 and Rs. 21,600/- vide R.no. 806297789 dated 10.01.2024, which is adequate upto 02.01.2025 (after deducting late penalty fee and NOC fee). The industry was visited by undersigned on 13.02.2024 and it was observed as under: 1. The industry was not in operation during the visit as the electric connection of the industry was found disconnected and the industry has submitted TDCO no. 274/8 dated 17.11.2023. 2. The industry has installed 01 no. induction furnace of capacity 100 Kg/heat provided with bag filter as APCD. 3. The industry has submitted completion certificate of installation of APCD vide no. PSCST/TFD/457 dated 02.11.2023 approved by the PSCST, Chandigarh. 4. There is no generation of trade effluent, only domestic effluent is being discharged into sewer. 5. The industry has submitted electricity bill as a proof of date of commissioning i.e. 02.01.2019. 6. The industry has submitted approved building plan from the Competent Person of the Director of Factories. 7. The industry has submitted DTP certificate vide letter no. 262 dated 01.02.2024 regarding the site is located within MC limit and is a industrial zone as per the Master Plan of Ludhiana (2007-2031). 8. The is now complying with the provisions of the Water Act, 1974 and Air Act, 1981. In view of above, it is recommended as under:- 1. The electric connection of the industry may be restored temporary six months. 2. Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry for six months. The competency to decide the application lies with Hon’ble Chairman.
