It is submitted that Sh. Rajbhupinder Singh s/o Sh. Sukhmander Singh Village Burj Rathi, Dist. Mansa has filed a Civil Suit no. 777 of 2022 in the Hon'ble Court of Civil Judge, Senior Division, Mansa for the permanent injunction to restrain the Rajpreet Kaur w/o Sh. Amritpal Singh, Village Burj Rathi, Distt. Mansa to establish Card Board /Gatta Factory. In the said Civil Suit Punjab Pollution Control Board is respondent no. 3 & 4 through Chairman, Punjab Pollution Control Board, Patiala and Environmental Engineer, Punjab Pollution Control Board, Regional Office, Bathinda.
The proposed industry against which the present Civil Suit has been filed by the complainant in the Hon'ble Court, falls under red category type of industries and general sitting criteria of the Board is applicable. Since, the site of the industry does not fall in any notified local planning area/Master Plan as per the report of District Town Planner, Bathinda and no village phirni/ lal lakhir, residential area comprising of 15 pucca houses & Municipal Council limits falls within 100 meter distance of the proposed site, therefore, the industry was granted 'Consent to Establish' under the provisions of Water Act, 1974 & Air Act, 1981 on 26.10.2022 (valid upto 25.10.2023) for its establishment and for production of Card Board/Mix Board @ 8 MTD.
The reply on behalf of the Board has already been filed and the next date of hearing is fixed on 04.03.2024.
