It is submitted that:-
• The project proponent has submitted reply to the show cause notice mentioned that they have counted 5 people per plot instead of 15 persons per plot for the plotted development calculation for our colony. The notification of Department of Housing and Urban Development is not applicable on their colony comes as it does not fall under PUDA guidelines rather it falls under Department of Local Government (Town planning Wing). The project proponent has assured there will not be more than 5 people per plot. Accordingly, they have planned to manage the domestic effluent and have taken sufficient measures and proposed the installation of STP. In future, if there will be increase in the domestic effluent than the proposed domestic effluent under any circumstances, they are liable to take the further steps to manage the domestic effluent and install the higher capacity STP to treat the domestic effluent.
• The project proponent has submitted copy of letter issued by MC Fazilka vide no. 284 dated 20.02.2024, wherein MC has mentioned that it has no objection w.r.t. discharge of effluent of the colony to the STP, which is reproduced as under:-
“ ਉਪਰੋਕਤ ਵਿਸ਼ੇ ਸਬੰਧੀ ਆਪ ਜੀ ਨੂੰ ਇਸ ਪੱਤਰ ਰਾਂਹੀ ਲਿਖਿਆ ਜਾਂਦਾ ਹੈ ਕਿ ਆਪ ਜੀ ਵਲੋਂ ਇਕ ਟੀ.ਪੀ.ਸਕੀਮ 80 ਕਨਾਲ ਐਮ.ਆਰ.ਗਰੀਨ ਸਲੇਮਸ਼ਾਹ ਰੋਡ ਫਾਜਿਲਕਾ ਦੇ ਨਾਮ ਤੇ ਬਨਾਈ ਗਈ ਹੈ ਇਹ ਮਾਨਯੋਗ ਸਕੱਤਰ ਸਥਾਨਕ ਸਰਕਾਰ ਪੰਜਾਬ ਚੰਡੀਗੜ ਜੀ ਦਾ ਪੱਤਰ ਨੰ. CTP(LG)-2023/3443 dated 01-12-2023 ਰਾਂਹੀ ਨੋਟੀਫਿਕੇਸ਼ਨ ਜਾਰੀ ਕੀਤਾ ਗਿਆ ਹੈ ।
ਨਗਰ ਕੌਂਸਲ ਫਾਜਿਲਕਾ ਨੂੰ ਕਲੋਨੀ ਦੇ ਸੋਲਿਡ ਵੇਸਟ ਮੈਨੇਜਮੈਂਟ ਅਤੇ ਕਲੋਨੀ ਦੇ ਪਾਣੀ ਡਿਸਚਾਰਜ ਨਗਰ ਕੋਂਸਲ ਦੇ ਐਸ.ਟੀ.ਪੀ. ਵਿੱਚ ਜਾਣ ਬਾਰੇ ਕੋਈ ਇਤਰਾਜ ਨਾ ਹੈ ਕਿਉਜੋ ਨਗਰ ਕੋਂਸਲ ਦਾ ਨਵਾਂ ਐਸ.ਟੀ.ਪੀ. 13 ਐਮ.ਐਲ.ਡੀ. ਕਪੈਸਟੀ ਦਾ ਹੈ ਸੀਵਰੇਜ ਟਰੀਟਮੈਂਟ ਪਲਾਂਟ ਕਲੋਨੀ ਦਾ ਵੇਸਟ ਪਾਣੀ ਲੈਣ ਵਿੱਚ ਸਮਰਥ ਹੈ । “
Regarding counting of number of person per plot, the project proponent has not submitted any guidelines specified by the Department of Local Government (Town planning Wing) for such type of projects and also not mentioned any valid reason for such calculation w.r.t. domestic effluent. As such, the reply of project proponent w.r.t. show cause notice is not satisfactory.
In view of the above, it is recommended that the application of the project proponent for consent to establish (NOC) may be refused.
