File Note: It is intimated that the project is a small-scale orange category restaurant. The project proponent has applied for obtaining fresh consent to operate under Water (Prevention & control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Beer @ 300 ltr/day & Restaurant Meals @ 250 Kgs/day alongwith requisite documents and fee. The project proponent has submitted CA certificate as per which value of fixed assets is Rs 62.25 lacs. The project proponent has deposited Rs 21,600/- vide Receipt No. 325409354 dated 08.02.2024 (Rs. 18,000/- under Water Act, 1974 & Rs. 3,600/- as NOC fee) and Rs. 18,000/- vide Receipt No. 623534855 dated 08.02.2024 under Air Act, 1981. The consent fee under both acts is adequate upto 30.09.2028. The project proponent has submitted the copy of lease deed made on 22.05.2023 between Sh. Lakshit Gupta (First Party) and M/s C and D Hospitality (Second Party) through its partner Sh. Vikas Garg at showroom no. 102 to 104 First Floor and 201 to 204 JD Towers Nabha MC Zirakpur. It is pertinent to mention here that M/s J.D Towers has already obtained consent to operate from the Board which is valid upto 30.09.2026. The project proponent has submitted copy of partnership deed executed on 16.11.2022 between Sh. Vikas Garg S/o Vinod Kumar Garg and Sh. Sukhwant Singh S/o Sh. Harpreet Singh. The project proponent has submitted the feasibility report for ETP of capacity 5 KLD, as per which the ETP component are as under: - Bar Screen, Collection Tank & Effluent transfer Pumps, Chemical reaction tanks, Primary settler, Bioreactor & Aeration System, Secondary Settling tank, Filter Feed Tank, Filter feed Pumps, Multi Grade Filter, Activated Carbon Filter, sand filter, Chlorine Dosing system, Interconnecting Pipeline & Valves, Electrical Control Panel, Sludge Drying Beds. The restaurant was visited by the undersigned on 19.02.2024 and it was observed as under: 1. The civil construction work has been completed and the restaurant is operational. 2. The project proponent has installed ETP of capacity 5 KLD and also submitted completion certificate for the same on dated 15.12.2023 for treatment of trade effluent which is discharged into sewer network of i.e. M/s J.D Towers. 3. The treated trade effluent and domestic Effluent is being discharged into sewer network of the project leading to septic tank installed by M/s J.D Towers. 4. The project proponent has installed 1 no. of DG set of capacity 125 KVA, which is equipped with canopy and stack of adequate height. 5. The project proponent has provided suitable chimneys and suction hoods in the kitchen area along with adequate stack height to control air emissions from this section. 6. The representative informed that the solid waste will be handled as per the provisions of SWM Rules, 2016. It is submitted that the site of the project falls in mixed land use zone as per Master Plan of Zirakpur and establishment of Hotel/ Restaurant is permissible. It is submitted that the industry is not a brewery unit and is a micro brewery. Many such type of micro breweries are operating in the state of Punjab in various markets and commercial centres. These units have also obtained consent to operate of the Board. As such the site is suitable for establishment of Micro Brewery. In view of above, it is recommended that the consent to operate under Water (Prevention & control of Pollution) Act, 1974 and under Air (Prevention & control of Pollution) Act, 1981 may be granted upto 30.09.2028 with subject to suitable conditions and special condition that:- 1. The restaurant will operate its ETP adequately and efficiently and will maintain daily record regarding operation of the same. 2. The restaurant shall maintain record regarding utilization of fresh water on daily basis. 3. The restaurant shall submitted effluent analysis results from Boards lab within one month. 4. The restaurant shall apply for obtaining authorization under the Hazardous and Other Wastes (Management and Trans-boundary Movement) Rules, 2016 within one month. 5. The restaurant will comply with the mechanism/guidelines for control of pollution and enforcement of environmental norms at individual establishments and the area / cluster of restaurants / hotels / motels / banquets etc. framed by the CPCB and adopted by PPCB vide letter no. SEE(HQ-2)/2021/64 dated 02.02.2021. 6. The restaurant will comply with the provisions of Noise Rules, 2000. 7. The restaurant will be bound to comply with the zoning regulations of the Master Plan in force and the grant of consent by the Board will not vest any right on the industry w.r.t other stipulations by any authority or the zoning regulations of the master plan. 8. The restaurant shall not carry out any activity in its premise, which can change the category of unit from Orange to Red, without prior permission from PPCB. 9. The restaurant shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances. 10. The restaurant shall ensure that the activity of unit does not create any nuisance in the surrounding areas and no public complaints are received. 11. The Consent is being issued to the industry based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time. 12. In case the restaurant fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the industry. *Competency –Senior Environmental Engineer Date of Receipt : 08.02.2024 Date of Scrutiny : 13.02.2024 Date of Deemed Approval : 02.03.2024
