File Note: It is intimated that the project is a small scale red category unit. The project proponent has applied for obtaining Consent to Establish (NOC) under the Water (Prevention & control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for development of 121 plots, 23 shops & 2 booths, alongwith requisite documents and fee. The project proponent has deposited Rs. 22,100/- vide R. No. 710900103 dated 10.02.2024 including application form fee. The NOC fee deposited by the project proponent is adequate for one year, against the proposed cost of the project is Rs. 9.75 Crore. The project proponent has submitted copy of letter vide Memo No. 313 dated 29.03.2022 regarding permission for change of land use for setting up an Affordable Plotted Colony at Village Nogiari (H.B.No. 282), Tehsil Mohali, Distt. SAS Nagar and the Khasra Nos. are mentioned in agenda note. The project proponent has submitted copy of partnership deed executed on 18.11.2011 between Sh. Varun Dham S/o Sh. Krishan Lal and Sh. Krishan Lal Dham. Water Pollution The project proponent has submitted project report and as per which the total population of the project is 1815 persons. The total water requirement for the project has been estimated to be 247 KLD, which is met through submersible installed within the project site. The domestic effluent discharge will be 198 KLD, which will be treated through STP of capacity 250 KLD, based on MBBR technology installed within the project, which is principally adequate. The project proponent will be utilized 82 KLD for dual flushing purpose, 16 KLD for green area during summer season and about 100 KLD will be used for irrigation of green area to be developed in 9.5 acre near the project site. The project proponent has submitted lease deed of 9.5 acre land singed with Panchayat of Village Nogiari which is valid upto 31.07.2024. The season wise disposal is as under: - Sr. no. Rainy 82 2 114 As per the project report, the project proponent has proposed to install STP of 250 KLD based on MBBR Technology consists of Collection Tank, MBBR Reactor, Tube Settler, Clean Water sump, Sludge Drying beds. The project shall generate total solid waste of approximately 734 Kg/ Day, which will be segregated into biodegradable and non-biodegradable. The biodegradable solid waste shall be converted to organic manure by providing mechanical composter of 370 kg/day and the rest shall be disposed of as per the provisions of solid waste management rules, 2016. Air Pollution The project proponent has proposed to install 01 no. DG set of capacity 25 KVA with canopy and adequate stack height. Applicability of EIA notification dated 14.09.2006: As per the site plan and project report, the total site area is 7.078 acres and it is a Area Development Project. The project as such is not covered under the EIA notification dated 14.09.2006. Visit: The site of the project was visited by AEE of this office on 19.02.2024 and during visit, it was observed that: 1. The site is located in Village-Nogiari Landran-Banur Road, Mohali, SAS Nagar. 2. The civil construction work has been started. 3. As physically observed, the distance of the proposed site from the various approved existing operational industries / units (for which specific siting guidelines has been issued by the Board for time to time), is more than the required distance as per the siting criteria given as under: Sr. No. Type of Industrial unit Required distance as per siting criteria 1. Jaggery Unit 200 m The site is complying with general siting criteria as per policy dated 30.04.2013 and specific sitting guidelines as per the Department of Science, Technology, Environment, Government of Punjab notification no. 3/6/07/STE(4)/2274 dated 25.07.2008. 4. The project proponent has submitted the approved site plan from Senior Town Planner vide letter no. 780 STP(S)55-11(GR) dated 08.07.2022. Recommendations: Keeping in view of the above, it is recommended that Consent to Establish (NOC) under the Water (Prevention & control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted for one year, subject to suitable conditions and additional conditions that: 1. The disposal of treated domestic effluent is the sole responsibility of promoter company and it shall ensure that the lease deed with Gram Panchayat Nogiari is renewed from time to time. 2. The promoter shall not allow any occupancy in the project till the time adequate arrangements for treatment & disposal of wastewater and solid waste are made as well as 'consents to operate' under the Water Act, 1974 & the Air Act, 1981 are obtained. 3. The project proponent shall submit the complete drawing and design of the STP and its component at the time of obtaining consent to operate. 4. The project proponent shall provide separate water meter and energy meter for the STP and maintain record of the same on daily basis. 5. The promoter company shall ensure that the total built up area of all individual projects/plots combined together is not more than 1,50,000 sqm, otherwise the project as such is covered under category 8(b) of the schedule appended to the EIA notification and project proponent of the area development project is required to obtain the environmental clearance, failure which, the promoter company shall be liable for action for the violation of EIA notification dated 14/09/2006. 6. The promoter company shall ensure that the total built up area of construction being carried out by it or any different builders may not be greater than 20,000 sqm, otherwise the project as such is covered under category 8(a) of the schedule appended to the EIA notification and project proponent of the building and construction project is required to obtain the environmental clearance, failure which, the promoter company/builder shall be liable for action for the violation of EIA notification dated 14/09/2006. 7. The project proponent shall utilize treated wastewater from nearby STPs for the construction purpose and shall submit an agreement in this regard within one month. 8. The project proponent shall place adequate no. of bins outside its premises from where the Municipal Solid Waste shall be got lifted. 9. The project proponent shall properly handle and manage the solid waste as per the provisions of the Municipal Solid Waste Management Rules, 2016 and ensure that the solid waste is segregated into biodegradable and non-biodegradable components. The biodegradable component shall be treated by providing mechanical composter 370 kg/day) to produce compost, which will be disposed of/reused in an environmentally sound manner and the non-biodegradable solid waste shall also be disposed of in an environmentally sound manner. 10. The project proponent shall also ensure that the hazardous waste and e-waste components of the solid waste shall also be segregated and the same shall be channelized to the authorized facility for such type of waste. 11. The project proponent shall comply with the provisions of the Construction and Demolition Management Rules, 2016. 12. The project proponent shall take adequate steps to the effect that the construction material of any kind that is stored at site shall be fully covered in all respects so that it does not disperse in the air in any form. 13. The project proponent shall ensure that all the construction material and debris shall be carried out in trucks or other vehicles which are fully covered and protected so as to ensure that the construction debris or the construction material does not get disburse into the air or atmosphere in any form. 14. The project proponent shall take all necessary steps to control the dust emissions to be generated from the construction activities of the project. 15. The project proponent shall ensure that the vehicles carrying construction material and construction debris of any kind shall be cleaned before it is permitted to ply on the road after unloading of such material. 16. The project proponent shall provide mask to every worker working on the construction site and involved in loading/ unloading and carrying of construction material and construction debris. 17. The project proponent shall provide all medical help, investigation and treatment of workers involved in construction of building and carrying out construction material and debris related to dust emissions. 18. The promoter shall develop its residential complex strictly in accordance with the layout / building plans approved / to be approved by the Competent Authority. 19. The NOC is being issued to the project proponent based upon the documents/ information submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing. 20. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent.
