The marriage palace has applied for obtaining fresh consent to operate under the Water Act, 1974 and the Air Act, 1981 for operation of marriage palace with seating capacity 300 person per function. Details of the case is as under:-
1) The palace has submitted copy of change of land use (CLU) issued by District Town Planner, Ferozepur vide memo no. 1115 DTP(F)/M-21(FZK) dated 06.08.2021 for area 07 kanal 18 marlas from khasra numbers 132//23 and 141//3, in the revenue estate of Village Khuian Sarwar, Tehsil Khuian Sarwar, District Fazilka.
2) The palace has submitted approved building plan issued by Senior Town Planner, Bathinda vide no. 789 –STP(B)(FZK) dated 06.12.2021
3) The palace has requested that the first function of the marriage palace was held on 28.12.2023 and submitted copy of tax invoice of the same, as proof of its date of commissioning.
4) The palace has submitted certificate of CA, mentioning the value of its gross fixed assets of Rs. 55.80 Lakhs and it has deposited Rs. 7200/- vide UTR no. N354232792867095 dated 20.12.2023 under Air Act, 1981. The palace has deposited Rs. 3600/- vide UTR no. N354232792890910 dated 20.12.2023 under the Water Act, 1974.
To check compliance, the palace was visited by undersigned (AEE) on 20.02.2024 and it was observed as under:-
1) The marriage palace was not in operation during the visit.
2) The palace has provided oil & grease chamber for kitchen section, however has not provided septic tank for treatment of domestic effluent. It has provided an underground cemented tank for storage of effluent from where it is being disposed off into neighboring agriculture fields.
3) The marriage palace has not provided plantation area for disposal of effluent.
4) The marriage palace has not provided compost pit for disposal of municipal solid waste generated from its premises. As per representative, biodegradable solid waste generated during the functions is being lifted to the pigree farms and non-biodegradable waste is being sold to the kabaris.
5) The marriage palace has not provided hood arrangement with chimney at the kitchen section.
6) The marriage palace has installed DG set of unknown capacity without canopy and inadequate stack in its premises.
7) The marriage palace has not submitted any concrete documentary proof regarding its date of commissioning so as to adjudge the adequacy of fee deposited by it.
The marriage palace is not complying with the provisions of the Water Act, 1974 and Air Act, 1981 as well as provisions of Solid Waste Management Rules, 2016.
Keeping in view of above, it is recommended that application of marriage palace applied under consent to operate under the Water Act, 1974 and the Air Act, 1981 may be refused.
