It is submitted that the project proponent was granted consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/SAS/2017/6564837 dated 26.12.2017 which was valid upto 25.12.2018 & further extended upto 31.03.2021 for construction of 228 flats, out of total 368 flats for which environmental clearance has been obtained by the project proponent vide no. SEIAA/2017/486 dated 03.05.2017 subject to certain terms and conditions mentioned therein.
Further, a complaint was received in this office regarding illegal sewer connection with Municipal Committee sewer.
Accordingly, the site of the project proponent was visited by undersigned on 06.09.2023. During the visit, it was observed as under:
1. The project proponent has proposed to develop 368 flats. The construction work of 112 flats has been completed and the construction work of remaining flats was not started yet.
2. The project proponent has provided occupancy in 70 flats. The untreated effluent of the residents of the flats is being directly discharged into Municipal Committee sewer without any treatment.
3. The construction work of STP was in under progress.
4. The project proponent has provided Borewell for the abstraction of groundwater. No watermeter provided on it.
5. The project proponent has not provided any DG set.
The project proponent was not complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 as well as conditions of the earlier NOC granted by the Board under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. The above violation was recommended to the Competent Authority of the Board through E-noting no. 23802300 dated 03.10.2023.
Accordingly, the project proponent was issued notice to issue directions u/s 33-A of the Water (Prevention and Control of Pollution) Act, 1974 Board's letter no. 7822-25 dated 11.10.2023 alongwith an opportunity of personal hearing before Chairman of the Board on 25.10.2023.
The project proponent was given personal hearing before the worthy Chairman of the Board on 25.10.2023, wherein, it was decided as under:
1) Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 be issued to project proponent as under:
i) The Revenue Authorities shall not register any sale deed related to any plot/ flat/ house/ shop/ any other component of this project w.e.f. issue date of the orders.
ii) The Punjab State Power Corporation Ltd. authorities shall be directed not to release any further electric connection to the residential houses in the project from the date of issue of orders.
2) A copy of proceedings be sent to EO, MC, Kharar with the request to:
(a) Illegality of the connection made by the project proponent with their sewer and action as deemed fit shall be taken against the project proponent as per the bye laws of the department.
(b) As to whether the location of STP installed as well as construction being carried out at site by project proponent is as per approved layout plan or not and accordingly, to initiate action against the project proponent with intimation to the Board.
3) Environmental Engineer, Punjab Pollution Control Board, Regional Office, SAS Nagar visit the project site and verify the compliance made by the project proponent and thereafter submit the report alongwith recommendations.
Now, the project proponent has applied for obtaining fresh partial consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 for Residential flats @ 112 numbers alongwith requisite documents. (Scrutiny was carried out on 06.01.2024 (Clarification raised 2 times) & Scrutiny completed on 22.02.2024)
The project proponent has deposited Rs. 127200/- vide R. No. 291362468 dated 31.01.2024 & Rs. 460000/- vide UTR No. BARBR520240212009848755 dated 12.02.2024 under Water (Prevention & Control of Pollution) Act, 1974. The fee deposited by the project proponent is adequate upto 24.10.2025 after adjusting late fee / penalty against the total cost of the project Rs. 3914.54 lacs.
The project proponent has submitted completion certificate issued by M/s Jal Vayu Consultants in which, it has been mentioned that:
“It is to certify that the STP of 325 based on MBBR has been installed and it is fully operational at site namely Royal Fame II at Kharar”.
The project proponent has also submitted a copy of certificate issued by Executive Officer, Municipal Council, Kharar vide no. 118 dated 09.03.2017 in which, it has been mentioned that:
“It is certified that Group Housing project of M/s Motia Real Estate, Sector 117 Chajju Majra, Group Housing Project namely ROYAL. FAME-II at Chajju Majra has been approval by this office vide letter no. 64 dated 20-2-2017, Solid Waste (Garbage) generated from this Housing Group will be disposed off by the firm at the dumping site or will be collected by the Municipal Council Kharar on payment. This area falls in residential zone as per master plan of Kharar. This will be done as per Solid waste management and handling rules 2000 as per Govt. instructions and rules of Punjab Pollution Control Board.”
The project proponent has submitted a copy of certificate issued by Executive Officer, Municipal Council, Kharar vide no. 119 dated 09.03.2017 in which, it has been mentioned that:
“It is certified that M/s Motia Real Estate, Sector 117 ChajjuMajra, Kharar Group Housing Project namely ROYAL FAME-II is approved by the MC Kharar vide letter No.’ 64 dated 20-2-2017. At present there is no sewerage system is laid in this area. After laying sewerage system in this locality, Municipal Council Kharar has no objection if Group Housing Project namely ROYAL FAME-II discharge its Sewerage treated water 290 KLD as per norms made by Punjab Pollution Control Board at their own cost into the sewer system of Municipal Council Kharar after depositing charges framed by Govt. and as per Govt. instructions and rules of the Deptt. of Local Govt. Punjab. This certificate is being issued on the basis of undertaking given by the M's Motia Real Estate., Sector 117, Chajju Majra, Kharar.”
The project proponent has submitted layout plan approved by Competent Authority.
The site of the project was visited by the undersigned on 13.02.2024. During the visit, it was observed as under:
1. Out of 228 flats, the project proponent has constructed 112 flats.
2. The project proponent has provided occupancy in 90 no. flats and the remaining flats will be occupied soon.
3. The project proponent has installed STP of capacity 325 KLD based on MBBR Technology, which was in operation during visit.
4. The project proponent was advised to provide watermeter at the outlet of STP and separate energymeter with the STP and maintain proper daily record of the same in the log book.
5. The treated wastewater was being discharged into MC sewer. The project proponent was advised to provide dual plumbing in the remaining flats to be constructed and utilize the treated wastewater in gardening purpose to the maximum extent.
6. The project proponent has provided mechanical composter for the treatment of wet biodegradable waste and remaining solid waste is being sold to recyclers.
7. The project proponent has installed DG set of capacity 63 KVA which is equipped with canopy and stack of adequate height.
In view of the above, may if approved, it is recommended that:
A. Consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 may be granted upto 31.03.2025 subject to suitable condition and following additional conditions that:
1. The project proponent shall provide watermeter at the outlet of STP and energymeter and maintain their proper daily record within 1 month.
2. The project proponent shall provide dual plumbing in the proposed flats to be constructed for utilization of treated wastewater for flushing purposes.
3. The project proponent shall provide fixed pipeline in parks / lawns for utilization of treated wastewater for gardening purposes within 1 month.
B. Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 issued to the project proponent may be dropped.
