File Note: The Municipal Corporation, Ludhiana was granted ‘Consent to Operate’ under the Water Act, 1974 & the Air Act, 1981 vide no. CTOW/Fresh/LDH3/2022/19276595 & CTOA/Fresh/LDH3/2022/19276599 both dated 21.07.2022, valid upto 30.06.2023 for manufacturing of MBM @ 3000 Kg/day, Tallow @ 100 kgs/day, Bio fertilizer and manure @ 1000 kgs/day alongwith generation of trade effluent @ 4.3 KLD onto land for plantation after treatment through ETP. Now, the Municipal Corporation, Ludhiana has applied for renewal of ‘Consent to Operate’ under the Water Act, 1974 & the Air Act, 1981 for manufacturing of MBM @ 3000 Kg/day, Tallow @ 100 kgs/day, Bio fertilizer and manure @ 1000 kgs/day alongwith generation of trade effluent @ 4.3 KLD onto land for plantation after treatment through ETP. The project proponent has submitted Rs. 32,400/- each vide UTR No. 82199712 & 969331770 both dated 25.01.2024 as ‘Consent fee’ under the Water Act, 1974 & the Air Act, 1981 respectively. Consent fee deposited by the project proponent is adequate for period upto 18.07.2024 after deducting Rs. 10,800/- as penalty under each Act. It is pertinent to mention here that the Hon’ble National Green Tribunal vide its order dated 13.05.2020 in O.A. no. 465/2019 titled as “Kulwinder Singh Sandhu and ors. Vs. Ram Murti & Ors.” has directed as under: “Directions may be issued to the Commissioner, Municipal Corporation, Ludhiana to complete and commission the modern and scientific carcass disposal plant at Noorpur Bet, Ludhiana by 31.08.2020 failing which environmental Compensation amounting to Rs. 1 Lakh per month may be imposed upon the Municipal Corporation, Ludhiana till the commissioning of the Plant.” Thereafter, the Monitoring Committee constituted by the Hon’ble National Green Tribunal visited the site of Modern Carcass Plant on 27.11.2020 and made following recommendations: “The construction work of Modern Carcass Plant should be completed by 31.12.2020. The machinery should be installed by 31.01.2021 and the plant should be commissioned by 28.02.2021, failing which Environmental Compensation double the amount as already imposed by the Monitoring Committee shall be imposed.” The Municipal Corporation, Ludhiana failed to comply with the timelines provided vide orders dated 13.05.2020 as well as recommendations of the Monitoring Committee after visit dated 27.11.2020. Accordingly, the Environmental Compensation of Rs. 68 Lac (Rs. 8.0 Lac for period 01.09.2020 to 31.03.2021 vide Board’s letter no. 1352 dated 13.04.2021 & Rs. 6.0 Lac for period 01.04.2021 to 30.06.2021 vide Board’s letter no. 1776 dated 27.01.2022 and Rs. 54 Lac for period 01.07.2021 to 30.09.2023 vide Board’s letter no: 7985 dated 24.11.2023) was imposed on the Municipal Corporation, Ludhiana. It is pertinent to mention here that a COCP no 2625 of 2021 in CWP no. 14716 of 2021 titled as “Gram Panchayat, village Manuke, Tehsil Jagraon, District Ludhiana v/s Adarsh Pal Vig and Others” is pending before the Hon’ble Punjab & Haryana High Court, Chandigarh where Petitioner had alleged that neither the Modern & Scientific Carcass Plant at Noorpur Bet has been put into operation by Municipal Corporation Ludhiana nor the Hadda Roddi installed by Gram Panchayat village Jatpura, Tehsil Raikot on the outskirts of village Manuke, Tehsil Jagraon has been shifted. Board has already filed status report in the matter though Council “Sh. Abhilaksh Gaind” and now, Hadda Roddi installed by Gram Panchayat village Jatpura, Tehsil Raikot on the outskirts of village Manuke, Tehsil Jagraon have been shifted. The carcass utilization plant was visited by undersigned on 20.01.2024 and it was observed as under: 1. The carcass plant was in operation. 2. The project proponent has installed ETP for the treatment of waste water generation from the process area, washing of equipment, utensil and floor area. The ETP consist of collection tank  screen chamber  oil and grease trap  aeration stage 1  clarifier stage 1  aeration stage 2  clarifier stage 2  polishing tank  treated water discharged on to land for plantation. 3. The project proponent has installed bio filter with the cooker/ dryer to treat the vapor coming for the dryer and to discharge the clean gas to the atmosphere. 4. The project proponent has installed boiler of capacity 02 TPH and has provided stack height of 30 m with boiler section after APCD. Agro Waste was used as fuel in the boiler section. 5. The project proponent has provided plantation all along the boundary wall and condition of plantation is good. The carcass utilization plant is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981. Keeping the above in view, it is recommended as under: B) Renewal of ‘Consent to Operate’ under the Air Act, 1981 may be granted for operation of carcass utilization plant to manufacture MBM @ 3000 Kg/day, Tallow @ 100 kgs/day, Bio fertilizer and manure @ 1000 kgs/day by processing 150 dead animals /day for period upto 30.06.2024, subject to suitable condition alongwith special conditions: 1. The Municipal Corporation shall deposit “Environmental Compensation” of Rs. 68 Lacs within 03 months. 2. This Consent is granted subject to the orders of the Hon’ble Punjab & Haryana High Court in COCP no: 2625 of 2021 in CWP 14716 of 2021. Competency: Hon'ble Chairman of the Board.
