File Note: The industry has applied for fresh ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, under Orange Category for manufacturing of FRP Products @121 MT/Year, as products along with requisite document. The industry has establish its unit without obtaining Consent to establish from PPCB and has directly applied for obtaining ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. The industry has deposited Rs. 42000/- vide R no. 280523648 dated 20.01.2024 under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 50400/- vide R. no. 513984294 dated 20.01.2024 under the Air (Prevention & Control of Pollution) Act, 1981, which is adequate upto 30.09.2027 (Considering NOC regularization fee of Rs. 8400/- fee and Penalty), for both the Acts against the fixed assets of Rs. 104.22 lakhs on 11.01.2023. Suitability of Site: The industry has submitted a copy of land use classification letter issued by DTP SAS Nagar vide letter no. 42 dated 05.01.2023, wherein it has mentioned as under: “ਉਪਰੋਕਤ ਵਿਸ਼ੇ ਅਧੀਨ ਹਵਾਲੇ ਤਹਿਤ ਪ੍ਰਾਪਤ ਪੱਤਰ ਦੇ ਸਬੰਧ ਵਿੱਚ ਸੂਚਿਤ ਕੀਤਾ ਜਾਂਦਾ ਹੈ ਕਿ ਪਿੰਡ ਨਿੰਬੂਆ (ਹ.ਬ.ਨੰ. 01), ਤਹਿਸੀਲ ਡੇਰਾਬੱਸੀ, ਜ਼ਿਲ੍ਹਾ ਐਸ.ਏ.ਐਸ ਨਗਰ ਵਿਖੇ ਪੈਦਾ ਖਸਰਾ ਨੰਬਰ 24//19 (3-14) ਕੁੱਲ ਰਕਬਾ 3 ਬਿੱਘਾ 14 ਬਿਸਵੇ ਵਿੱਚੋ ਦਫਤਰੀ ਰਿਕਾਰਡ ਵਿੱਚ ਉਪਲੱਬਧ ਰਿਜ਼ਨਲ ਪਲੈਨ, ਗਮਾਡਾ ਦੇ ਉਪਲਬੰਧਾਂ ਅਨੁਸਾਰ ਐਫ.ਈ.ਜ਼ੈਡ ਜ਼ੋਨ ਖੇਤਰ ਅਧੀਨ ਪੈਦਾ ਹੈ। ਸਾਈਟ ਵਿੱਚ ਕਿਸੇ ਵੀ ਤਰ੍ਹਾਂ ਦੀ ਐਕਟੀਵਿਟੀ ਕਰਨ ਤੋਂ ਪਹਿਲਾਂ ਉਸ ਸਬੰਧੀ ਮਨਜ਼ੂਰੀ ਸਬੰਧਤ ਸਰਕਾਰੀ ਅਦਾਰਿਆਂ ਤੋਂ ਪ੍ਰਾਪਤ ਕਰਨ ਦੇ ਪਾਬੰਦ ਹੋਵੇਗੇ। ਉਪਰੋਕਤ ਕਲਾਸੀਫਿਕੇਸ਼ਨ ਆਪ ਵੱਲੋ ਪੇਸ਼ ਕੀਤੇ ਗਏ ਦਸਤਾਵੇਜ਼ਾਂ ਦੇ ਸਨਮੁੱਖ ਜਾਰੀ ਕੀਤੀ ਜਾਦੀ ਹੈ। ਇਸ ਪੱਤਰ ਨੂੰ ਵਿਸ਼ੇ ਅਧੀਨ ਸਾਈਟ ਦਾ ਲੈਂਡ ਯੂਜ਼ ਕਲਾਸੀਫਿਕੇਸ਼ਨ ਹੀ ਸਮਝਿਆ ਜਾਵੇ। ਇਸ ਲੈਂਡ ਯੂਜ਼ ਕਲਾਸੀਫਿਕੇਸ਼ਨ ਸੀ.ਐਲ.ਯੂ ਦੀ ਪ੍ਰਵਾਨਗੀ ਜਾ ਕਿਸੇ ਕਿਸਮ ਦਾ ਐਨ.ਓ.ਸੀ ਨਾ ਸਮਝਿਆ ਜਾਵੇ।” Thus, the site of the unit is suitable. The industry has submitted a copy of GST registration certificated dated 07.02.2023, as a proof of date of commissioning of the unit, along with the online application form. The industry has also submitted a copy of building plan signed by Er. Jasvir Singh, Competent Person of Director of Factories of Punjab. The industry has also submitted a copy of sale deed dated 18.01.2023 between Sh. Nitin Garg and M/s HNN Fibre Industry for Khasra no. 24//19 (3-14). The industry has submitted a copy of partnership deed dated 16.12.2022 between Sh. Tarun Goel s/o Sh. Kewal Krishan, Sh. Nitin Garg s/o Sh. Suresh Kumar Garg and Sh. Hemant Goel s/o Sh. Kewal Krishan. Visit: Accordingly, the industry was visited by AEE of this office on 23.01.2024 and during visit, it was observed as under: 1. The industry is engaged in manufacturing of Fiber reinforced polymers for railway coaches and was in operation. 2. The industry has installed environmental data board at its entrance. 3. The manufacturing process of the industry is as under: FRP Sheets Pasting of sheets (manual) Cutting (as per required thickness) Painting Final Product 4. The industry has installed one no. spray painting booth in its premises, wherein, spray guns are used and paint filters have been installed as APCD. 5. The industry has not installed any boiler or furnace in its premises. 6. The industry has provided septic tank, after passing through which domestic effluent shall be used onto land for plantation developed along the boundary wall. 7. The industry does not generate any trade effluent from its premises. 8. The industry has installed one no. DG set of capacity 125 KVA, which is provided with canopy and stack of adequate height. 9. The industry generates hazardous wastes as empty paint containers, waste paint cloths, spent filters of spray painting booth and used oil from DG set. The representative of the industry was advised to immediately apply for obtaining authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016. From above, it is clear that the industry is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Recommendations: In view of above, if may approved, the industry may be granted fresh ‘consent to operate’ granted to the industry under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, upto 30.09.2027 with usual conditions & with following special conditions: 1. The industry shall immediately apply for obtaining authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016, within one week. 2. The industry shall not carry out any activity in its premises, which can change the category of unit from Orange to Red. 3. The industry shall not generate and discharge any kind of trade effluent from its premises and shall discharge only domestics effluent onto land for plantation in its premises after passing through septic tank. 4. The industry shall not discharge the effluent into any drain/choe/nallah, in any case. 5. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances. 6. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time. 7. The industry shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time. 8. The ‘consent to operate’ is being issued to the project proponent based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing. 9. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent. *Competency- Senior Environmental Engineer, (Small, Orange) Date of receipt of case- 08.02.2024 Target date of deemed approval- 29.02.2024 (i.e. 15 working days)
