File Note: it is submitted that the industry was found violating by the team of CPCB and IIT-Ropar on 28/03/2022 and some non-compliances were observed Based on above non-compliances, the direction for closure was issued to the industry. Thereafter the industry applied for consents of the Board along with request for restoration of electric connection. After verifying the compliance made by the industry, the electric connection of the industry was restored by the Competent Authority and Consent to Operate was granted upto 12.08.2023 and restoration of electric connection was also granted upto that period and while granting the temporay restoration and consent no BG or any other punitive action was taken by the Board. Thereafter the industry again applied for consents and restoration, which was granted vide no. CTOA/Renewal/LDH1/2023/22688435 dated 10.08.2023 valid upto 07.02.2024 with usual terms and conditions and restoration of electric connection for six months, as the industry complied with the observation noted by the team of CPCB and IIT Ropar. However while granting consent and short term restoration on second time special condition was imposed on the industry by the Competent Authority which is reproduce as under:- 1. The industry shall submit Bank Guarantee of Rs. 5 Lakhs as an assurance to comply with the provisions of Environmental laws. In this regard, the industry vide letter dated 17.08.2023 submitted a representation to the Worthy Member Secretary of the Board to waive of BG imposed on them, mentioning the reason that they are going through a financial crunch and moreover they are complying with all the consent conditions as well as with the emission standards. Since, the industry is complying with SOP as well as with emission standards, it is recommended that the industry may be granted consent to operate under Air Act, 1981 along with restoration of electric connection and request of the industry for exempting them from submitting the BG amounting 5 lacs (due to financial crisis) may kindly be considered, please.
