It is submitted that the agency was given personal hearing before worthy CEE (B) on 23.01.2024, wherein it was decided as under: -
1) The agency shall ensure to remove all the shortcomings observed during visit by the officer of the Board on 04.01.2024.
2) The agency shall submit the extended bank guarantee of Rs. 1.0 lac, within 07 days.
3) The agency shall apply for obtaining authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016, within 07 days.
4) Environmental Engineer, Regional Office, Faridkot shall visit the agency and process the applications applied by it under the Water Act, 1974 & Air Act, 1981 on merit.
To verify the compliance, agency was visited by undersigned (AEE) on 20.02.2024 and it was observed as under:-
1) Washing section of the agency was not in operation during the visit.
2) ETP installed by the agency was not in operation as per non-availability of effluent at the inlet.
3) The agency has now maintained the plantation as per karnal technology and condition of the same was found good.
4) The agency has provided Energy meter with ETP. It has provided flow meter with ETP, however same was still out of order. The agency has still not maintained record of the operation of the ETP.
5) The agency has installed in-built filters as APCD with the painting booth and has now provided stack of adequate height with the same.
6) The agency has provided separate room for storage of hazardous waste, however same was not stored category wise and no record of the hazardous waste generation as well as disposal was maintained by the agency. The agency has failed to carried out agreement with any authorized hazardous waste disposal facility. Further the agency has failed to apply/obtain authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 till date.
7) The agency has failed to submit extended Bank Guarantee in the office in compliance to the decision of the personal hearing.
As such, the agency has failed to comply with all shortcomings report earlier and has failed to comply with the decisions of the personal hearing.
In view of the above, it is recommended that consent to operate under the Water Act, 1974 and the Air Act, 1981 may be refused please.
