The industry has applied for fresh ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, for operation of an industrial unit for Electroplating of NUT, BOLT & SCREW @ 300 Kgs/day along with requisite document.
The industry has established its unit without obtaining ‘Consent to establish’ from PPCB and has directly applied for obtaining ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
The industry has deposited Rs. 23000/- vide R no. 818836360 dated 08.02.2024 under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 18900/- vide R. no. 441205875 dated 08.02.2024 under the Air (Prevention & Control of Pollution) Act, 1981, which is adequate upto 30.06.2028 (Considering NOC regularization fee of Rs. 3600/- and Penalty of Rs. 1800/-) for both the Acts against the fixed assets of Rs. 42.22 lakhs on 07.02.2024.
While processing the application, the industry was raised clarification and the reply as under:
“WE M/S ULTIMATE FASTENERS & PRDUCTS, PLOT NO. E-21, FOCAL POINT, DERABASSI, DISTT. SAS NAGAR HEREBY UNDERTAKE THAT PRESENTLY CETP (JBR TECHNOLOGIES/BANTECH) ARE NOT EXECUTING THE AGREEMENTS FOR LIFTING OF TRADE EFFLUENT FROM ELECTROPLATING UNITS SO WE ARE GETTING THE TRADE EFFLUENT LIFTED BY MAKING THE PAYMENT IN ADVANCE THROUGH JBR TECHNOLOGIES. AS SOON AS THEY WILL START EXECUTING THE AGREEMENTS, WE WILL GET THE SAME DONE AND SUBMIT TO YOUR OFFICE.”

Suitability of Site:
The industry has submitted a copy of allotment issued vide letter no. PSIEC/ESTATE/EO/13596 dated 22.08.2023 issued by PSIEC to M/s Ultimate Fasteners & Products, Proprietor Sh. Divyam Aggarwal S/o Sh. Satish Chand Aggarwal, Plot no. E-21, Focal Point, Tehsil Derabassi, Distt. SAS Nagar for manufacturing of ‘MS, SS, Screw & Nut Bolt and Plating.
Thus, the site of the industry is suitable.
The industry has submitted a copy of GST registration certificated dated 01.12.2023, as a proof of date of commissioning of the unit, along with the online application form.
The industry has also submitted a copy of building plan signed by Er. Anmol Bansal, Competent Person, Director of Factories of Punjab.
Visit:
Accordingly, the industry was visited by AEE of this office on 14.02.2024 and during visit, it was observed as under:
1. The industry is engaged in zinc plating of nuts & bolts was in operation during the visit. The representative of the industry informed that they have started production at the site recenlty in January 2024.
2. The industry has installed 05 no. of barrels for zinc plating inside its premises.
3. The industry is using PSIEC supply as source of freshwater and flow meter has been installed with the same.
4. The industry has provided 01 no. underground collection tank for storage of effluent to be generated from plating process. The representative of the industry informed that the said tank is of capacity 8000 ltrs.
5. The industry has submitted a copy of receipt dated 07.02.2024 of the operator of CETP at Ludhiana, M/s JBR Technologies vide which, 4000 lts of effluent was lifted from the industry by the said CETP. The representative of the industry informed that the said operator of CETP at M/s JBR Technologies is not doing formal agreement for lifting of trade effluent but the operator lifts the effluent under proper manifest as and when the industry approaches them to lift the same. He further informed that as CETP at Chanalon is not yet operational, as such, they are unable to get the agreement with the said CETP also.
6. During visit, it was observed that around 4000 ltrs. of effluent was lying stored in the collection tank of the industry.
7. Domestic effluent being generated from the unit is discharged into PSIEC sewer.
8. The industry has not installed any DG set in its premises.
From above, it is clear that the industry is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
Recommendations:
In view of above, if may approved, the industry may be granted fresh ‘consent to operate’ granted to the industry under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, upto 30.06.2025 with usual conditions & with following special conditions:
1. The industry shall get its trade effluent lifted from the operator of authorized CETP under proper record and manifest, at all times.
2. The industry shall maintain proper record of generated, collection and disposal of trade effluent at the site, at all times. The industry shall discharge only domestic effluent onto land for plantation in its premises after passing through septic tank.
3. The industry shall get agreement executed with the CETP at Chanalon, Kurali for lifting of trade effluent, as and when the same is made operational.
4. The industry shall not discharge the effluent into any drain/choe/nallah, in any case.
5. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances.
6. The industry shall ensure that no problem related to pollution is being caused by the unit due to its operation and no public complaints are received by the Board in this regard.
7. The project proponent shall comply with the guidelines issued by PWRDA and shall obtain permission from PWRDA for abstraction of ground water (if applicable).
8. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time.
9. The industry shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time.
10. The ‘consent to operate’ is being issued to the project proponent based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing.
11. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent.
