File Note: • The institute was in operation without obtaining NOC/Consents to operate of the Board. • Earlier, the institute has applied for obtaining consent to operate under Water Act, 1974 & Air Act, 1981 through OCMMS under orange category and the consent to operate applied by the institute is refused under the Water Act, 1974 vide no. CTOW/Fresh/MKS/2024/24499287 and under the Air Act, 1981 vide no. CTOA/Fresh/MKS/2024/24498763 both dated 29.01.2024 with following observations. • The institute shall provide adequate treatment facility for the treatment of domestic effluent as well as the effluent generated from the premises of the hospital, within one month. • The institute shall apply for obtaining authorization under Bio-Medical Waste Management Rules, 2016, within one month. • The institute shall provide compost pits for the management of wet solid waste in compliance to the Solid Waste Management Rules, 2016, within one month. • Now, the institute has again applied for obtaining consent to operate under Water Act, 1974 & Air Act, 1981 through OCMMS under orange category with new registration ID. • The detail of the case is as under: - • The institute has submitted CA certificate of fixed assets of Rs. 374.73 lacs. Accordingly, the institute has deposited consent fee of Rs. 89800/- vide UTR No. SBIN423355018216 dt. 21.12.2023 (including Rs. 25000/- as Notional fee) under Water Act, 1974 and Rs. 89800/- vide UTR No. SBIN423355019909 dt. 21.12.2023 (including Rs. 25000/- as Notional fee) under Air Act, 1981, which is now adequate upto 30.09.2024. Further, the institute has deposited NOC regularization fee of Rs. 10800/- vide UTR No. SBIN423355017739 dt. 21.12.2023. • The institute was established in 1997. • The institute has submitted certificate of registration of societies vide no. 728 of 1996-97 as a proof of commissioning. The institute covered under Voluntarily Disclosure Scheme (VDS). The institute is operating before 2000, accordingly, the institute has deposited Rs. 25000/- under each act. • The institute has submitted revenue record i.e. Registry. The institute has submitted MOA (attached). The institute has submitted layout plan/building plans approved by MC Muktsar. The institute has submitted bill of MC sewer. • To verify the contents of the application, the institute was visited by officer of the board on 19.02.2024 and it was observed as under: - 1. The institute is having sanctioned strength of 180 no. persons and at present the current strength is about 130 persons. 2. The institute has provided 49 beds in the hospital section out of which 14 beds used for ayurvedic therapy purposes and remaining 35 beds ( 10 beds in Male ward, 17 beds in female ward, 06 beds in OPD and 02 beds in dressing section of OT) and a laboratory. However, the institute has signed agreement with CBWTF for 10 beds only. 3. The institute has sewer connection for discharge of its domestic effluent and waste water from hospital directly into MC sewer. The terminal STP provided for the town are not in operation. 4. The institute has placed the dustbins in all sections for collection of municipal solid waste and further same was collected at one no. common point from employees of the Municipal Council, Muktsar are being lifted. The institute has not provided compost pits for in house treatment of wet waste. 5. The institute has installed 1 no. D.G. Set of capacity 35 KVA within its premises and canopy has been provided. 6. The institute was not segregating Bio-Medical Waste being generated by its category wise at the point of their generation as per colour coding, collected in polythene / puncture proof bags, which were placed in plastic containers and Bio-Medical Waste was also found mixed with Municipal Solid Waste. 7. The institute was not cutting catheters/tubing i.e. Red Category waste to avoid its reuse. 8. The institute has provided shredders/ cutters for shredding of used needles. 9. The institute has not provided White (Translucent) container/box for storage of sharps/needles as prescribed by the Bio Medical Waste Management Rules, 2016 as uncut needles and sharps were found stored in a Red colored Non-Polychlorinated bag. 10. Only Red colored Non-Polychlorinated bags were used at Bio-Medical Waste generation points and all category of waste was kept in these bags. 11. The institute has made provision for treatment/ disinfection of liquid Bio waste category and sharps with 1% sodium hypochlorite solution. 12. The institute has not stored glass (broken / unbroken) in a cardboard box with blue colour marking on it. 13. The institute has not provided Final storage room for storage of bio medical waste, which is safe, pucca and with lock & key arrangement systems. 14. There is no air polluting industry located within 100 meter radius of the institute. The institute has not applied for obtaining authorization under Bio-Medical Waste Management Rules, 2016.  From above, it was found that the institute has not provided ETP-cum-STP for treatment of waste water and wet waste. As such the institute is not complying with the provisions of the Water Act, 1974.  Keeping in view of above, it is recommended as under: - 1. Consent to operate under Air Act, 1981 may be granted to the institute up to 30.09.2024 with suitable conditions. 2. Consent to operate under Water Act, 1974 may be refused please 3.Show cause notice for violation of the provisions of BMW Rules, 2016 may be issued please
