The industry has applied for fresh ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, for manufacturing of HB Wire and Annealed Wire @ 15.0 MTD along with requisite document.
The industry has establish its unit without obtaining ‘Consent to establish’ from PPCB and has directly applied for obtaining ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
The industry has deposited Rs. 16200/- vide UTR no. BKIDY23340649582 dated 06.12.2023 under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 22100/- vide UTR. no. BKIDY23340649440 dated 06.12.2023 under the Air (Prevention & Control of Pollution) Act, 1981, which is adequate upto 31.12.2025 (Considering NOC regularization fee of Rs. 5400/-) for both the Acts against the fixed assets of Rs. 54.59 lakhs.
Suitability of Site:
The industry has submitted a copy of registry dated 22.10.2018 executed between Sh. Shyam Lal, Sh. Ashok Kumar (seller) and Smt. Satwinder Kaur (Purchaser) for Plot no. E-01.
The industry has further submitted a copy of rent agreement dated 05.08.2023 executed between Smt. Satwinder Kaur w/o Sh. Manjit Singh and M/s KRH Wires LLP, which is valid for 11 months, w.e.f. 31.07.2024.
As the site of the industry is located in focal point. Thus, the site of the industry is suitable.
The industry has submitted a copy of GST registration certificated dated 22.09.2023, as a proof of date of commissioning of the unit, along with the online application form.
The industry has also submitted a copy of building plan signed by Er. Rajnish Kumar Singla, Competent Person of Director of Factories of Punjab.
Visit:
Accordingly, the industry was visited by AEE of this office on 14.02.2024 and during visit, it was observed as under:
1. The industry has installed machinery for manufacturing of HB & Annealed wires and was not in operation.
2. The industry has installed two no. electric annealing furnaces (below ground level).
3. Further, the industry has installed wire drawing block machine wherein the wire is collected in the form of coils.
4. The source of fresh water supply is PSIEC and the supply line is equipped with mechanical flow meter. The representative of the industry was advised to maintain record regarding water consumption.
5. The industry has installed two no. acid pickling tanks (used alternatively), one no. rinsing tank and one no. tank for lime bath. Further, the industry has provided tank for collection of the spent acid and rinsing water, from where the effluent will be collected by the CETP. The industry has made agreement dated 09.02.2024 with the operator of the CETP i.e. M/s JBR Technologies Pvt. Ltd., Kohara, Ludhiana for lifting of effluent to the tune of 3000 ltrs./month.
6. The representative of the industry was also advised to install flow meter at the point of supply line to the surface treatment section and maintain separate record regarding consumption of fresh water in the surface treatment section.
7. The domestic effluent is discharged into sewer leading to STP of 2 MLD capacity installed by the PSIEC.
8. The industry has not installed any D.G. set within its premises
From above, it is clear that the industry is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
Recommendations:
In view of above, if may approved, the industry may be granted fresh ‘consent to operate’ granted to the industry under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, upto 31.07.2024 (i.e. upto validity of lease deed) with usual conditions & with following special conditions:
1. The industry shall get its trade effluent lifted from the operator of authorized CETP under proper record and manifest, at all times.
2. The industry shall maintain proper daily record of fresh water consumption, wastewater generation, collection and disposal of trade effluent at the site, at all times.
3. The industry shall discharge only domestic effluent into PSIEC sewer.
4. The industry shall not discharge the effluent into any drain/choe/nallah, in any case.
5. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances.
6. The industry shall ensure that no problem related to pollution is being caused by the unit due to its operation and no public complaints are received by the Board in this regard.
7. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time.
8. The industry shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time.
9. The ‘consent to operate’ is being issued to the project proponent based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing.
10. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent.
