It is submitted that the industry is a rice sheller unit, which falls under small scale orange category and has been established after obtaining consent to establish (NOC) vide no. CTE/Fresh/FZR/2023/22645818 dated 03.07.2023, valid upto 02.07.2024 for the manufacturing of Raw rice with Dryer @ 10 TPH and Sorted rice @ 10 TPH, under Orange category, with certain conditions mentioned therein alongwith special condition that the industry shall install source of pollution i.e. stacks of shelling section as well as paddy cleaner of dryer section in khasra no. 54m//9, which is meeting with siting guidelines as per Tehsildar report and DTP report.
Now, the industry has applied for obtaining fresh consents to operate under the Water Act, 1974 and the Air Act, 1981, for operation of rice sheller unit to manufacture Raw rice with dryer @ 10 TPH and Sorted rice @ 10 TPH, under Orange category, with requisite documents and adequate consent fees. The detail of case is as under:-
1. The industry has Rs. 54,000/- deposited vide Receipt No. POD010355705 dated 31.01.2024 as water consent fee under the Water Act, 1974 and Rs. 54,000/- deposited vide Receipt No. POD010358672 dated 31.01.2024 as air consent fee under the Air Act, 1981, against the fixed assets of Rs. 272.96 Lakhs as on 31/12/2023 as per CA certificate dated 12.02.2024 submitted by it. The consent fee deposited by the industry is adequate upto 30/09/2028 under each Acts.
The industry was visited by this office on 22.02.2024 and it was observed as under:-
1. The industry was in operation during visit. The industry has installed machinery for the production of sorted raw rice with dryer.
2. The industry has not provided any APCD with the shelling section as well as paddy cleaner of dryer and the dust emission arising from the process leading to the nuisance in the surroundings.
3. The industry has not provided wall of adequate height or jail in front of husk discharge area in compliance to the code of practice.
4. The industry has provided septic tank for treatment of domestic effluent however there is provision to discharge the treated effluent onto land for irrigation along the boundary.
5. The industry has not stabilized the movement area.
6. The industry has not planted adequate trees along its boundary wall.
7. The industry has failed to submit site plan showing the installation source of pollution i.e. stacks of shelling section as well as paddy cleaner of dryer section in khasra no. 54m//9, which is meeting with siting guidelines as per Tehsildar report and DTP report.
The industry is not complying with the provisions of the Water Act, 1974, Air Act, 1981 and code of practice notified by the Govt. of Punjab, Department of Science, Technology & Environment vide notification no 10/48/2004-STE-(4) / 932 dated. 15/10/2013.
Keeping in view of above mentioned facts, it is, therefore, recommended that show cause notice for refusal of consent to operate under the Water Act, 1974 and the Air Act, 1981 may be issued to the industry please.
