The industry is small scale unit and was granted 'Consent to Operate' under Water (Prevention & Control of Pollution) Act, 1974 vide no. R15LDH1CTOW3069287 dated 16.09.2015 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. R15LDH1CTOA3069251 dated 16.09.2015 both valid upto 30.06.2020 under the name and style of M/s A.S. Auto Industries.
The industry was visited by undersigned on 09.11.2023 and observed as under:
1. It has changed its name from M/s A.S. Auto Industries to M/s Bir Auto Tech.
2. Sh. Amritpal Singh, Proprietor, M/s Bir Auto Tech is currently operating the unit since 2019.
3. The industry was in operation during visit & engaged in manufacturing of heat treatment & annealing of auto, cycle parts & hardware goods on job basis.
4. The industry has installed two pit type electrically operated annealing furnaces, one gas carbonizing furnace & five rotary furnaces (3 no. LPG fired and 2 no. Diesel fired) which are provided with proper hood & adequate stack height.
5. The industry has not installed any DG set.
6. The industry has not generated any trade effluent & domestic effluent is being discharged into sewer.
7. The industry is operating its unit without valid 'Consent to Operate' under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
Further, the industry was given personal hearing before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 21.12.2023 w.r.t show cause notice for violation of the provisions under Water Act, 1974 and the Air Act, 1981 to M/s A.S. Auto Industries, D-15, Phase-1, Focal Point, Ludhiana, wherein, it was decided as under:
1. The industry shall apply for obtaining consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 in the name M/s Bir Auto Tech, within 15 days.
2. The Environmental Engineer, Regional office shall verify submission made by the industry and process the consent applications on merits.
In compliance, the industry has applied for obtaining fresh consent to operate under the Water Act, 1974 and Air Act, 1981 as new name & style of M/s Bir Auto Tec with requisite documents. The industry has deposited consent fee against the un-depreciated fixed assets of Rs. 46.18 Lacs as on 31/07/2023 CA Certificate dated 05/09/2023, which is adequate upto 30/06/2028 under Water Act, 1974 and Air Act, 1981, as per Board's Office Order dated 29/10/2018 after deducting penalty charges 400 %.
The industry was visited by the undersigned on 23.02.2024 and it was observed as under:
1. The industry was in operation during visit & engaged in manufacturing of heat treatment & annealing of auto, cycle parts & hardware goods on job basis.
2. The industry has installed two pit type electrically operated annealing furnaces, 4 no. Electric heat treatment furnaces, one gas carbonizing furnace & five rotary furnaces (3 no. LPG fired and 2 no. Diesel fired) which are provided with proper hoods and adequate stack heights.
3. The industry has not installed any DG set.
4. There is no generation of trade effluent and domestic effluent is being discharged into sewer.
5. The industry has submitted building plan prepared by approved Architect from Director of Factories, Punjab.
6. The industry is complying with the previous consent conditions granted to the industry under Water Act, 1974 & Air Act, 1981.
The site of the industry falls in the Industrial Focal Point as per Master Plan of Ludhiana.
In the subject cited case, the industry has mentioned ground water extraction @ 2.5 KLD. Considering 25 working days per month, ground water extraction will be 62.5 KL/month, which is less than 300 KL/month.
It is therefore recommended that 'Consent to operate' under the Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 30/06/2028 with suitable conditions as per policy of the Board.
