It is intimated that earlier, the project proponent has applied for consent to establish (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for the establishment of commercial shops @ 67 Nos. with domestic effluent @ 12 KLD onto land for plantation after treatment of STP proposed as per application form and same was refused vide CTE/Fresh/NWS/2023/24137786 dated 28.11.2023 with conditions mentioned therein.
Now, the project proponent has re-submitted/applied for consent to establish (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for the establishment of commercial shops @ 67 Nos. with domestic effluent @ 12 KLD onto land for plantation after treatment of STP proposed as per application form alongwith documents etc. as required in the previous application.
The project proponet has already deposited Rs. 18500/- vide UTR No.
N286232688596190 dated 13.10.2023 as NOC regularization fee.
The project proponent has submitted project report, feasibility report STP, site plan location plan, land documents, CLU issued by Local Govt. Punjab. The project proponent has submitted NOC for setting up a commercial establishment within MC Limits from ADC (G) –Cum- Competent Authority, Shaheed Bhagat Singh Nagar dated 04.10.2023. ADC (G) Shaheed Bhagat Singh Nagar also requested this office to issue NOC to the project proponent vide no. 1458 dated 04.10.2023. The project proponent has submitted letter from MC Banga bearing no. 230 dated 14.02.2024 for allowing treated domestic effluent of 20 KLD is discharged into MC Sewer, which will be treated in STP Banga of 03 MLD capacity with condition that the project proponent shall install its own STP with new technology as per guidelines of the Punjab Pollution Control Board.
Earlier, the site was visited by officer of this office on 08.11.2023 and observed that the site was located in Banga- Mukandpur road, Distt. Shaheed Bhagat Singh Nagar. The site is surrounding residential area. The project proponent has earmarked the site. Further, the project proponent undertaking dated 05.12.2023, the saleable area of the proposed colony (13 Kanal-2 marlas) is 31259.34 Sqft. (commercial) as per building by laws permissible ground coverage is 70% of saleable area. Total built area of the colony is 43763.06 sqft. or 4065.68 sqmtr. Hence not required Environmental Clearance.
In view of above, it is recommended that the consent to establish (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to the project proponent for one year with suitable terms and conditions and special condition that the project proponent shall comply with all the provisions of the letters issued by the concerned Departments.
