• The industry has been established in the year 1995 after obtaining 'No Objection Certificate' from the Board dated 05.05.1995 for production of cement @ 50 TPD………..
• The industry was granted consents to operate under the Water Act, 1974 & Air Act, 1981 on 27.02.2006 (valid upto 28.02.2007) for production of cement @ 50 TPD, which was further extended time & again upto 30.06.2024………..
• As per the record file, the industry has installed only one ball mill of capacity @ 50 TPD for production of cement @ 50 TPD……….
• Now application applied for 'Consent to establish' (NOC) for expansion under the Water Act, 1974 & Air Act, 1981 by replacement of existing one ball mill of capacity 50 TPD to 2 ball mills of capacity @ 25 TPD each………..
• Cement grinding (irrespective of its production capacity) units falls under the purview of EIA notification dated 14.09.2006, however since the industry has been established well before 2006, as such it has not obtained environmental clearance during its establishment. Since, now the industry has proposed modernization by installing 2 ball mills of capacity @ 25 TPD each by replacing existing ball mill of capacity 50 TPD, the undersigned is of the view that the industry is required to obtain environmental clearance as per EIA notification dated 14.09.2006………..
• If approved, show cause notice before refusal of NOC (expansion) be issued to the industry alongwith an opportunity of personal hearing before the Competent Authority…………
