It is submitted that the project proponent has applied for obtaining fresh consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for Affordable Residential Colony having 56 Residential Plots & 7 EWS Plots alongwith requisite documents and fee.
NOC fee:
The project proponent has submitted brief project report as per which the proposed cost of the project is Rs. 6.00 Crore. The project proponent has deposited Rs. 18,000/- vide UTR. No. 000143991039 dated 29.01.2024. The NOC fee deposited by the project proponent is adequate for one year.
Land Documents
The project proponent has submitted the copy of partnership deed executed on 17.08.2022 between Sh. Tarundeep Mittal, Sh. Sanjiv Khanna, Sh. Krishan Kumar Gupta & Sh. Sanjeev Kumar Bindlish.
The project project proponent has submitted certificate registration from Office of Additional Commissioner (Urban Development), SAS Nagar-Cum-Competent Authority vide no. ADC(UD)SASNAGAR/2023/83 dated 07.12.2023 for development of colony which is valid for five years from the date of its issue.
The project proponent has submitted the copy of sale deed made on 28.06.2023 between Sh. Ranjit Singh S/o Sh. Banarsi Dass and M/s Luxe Lanes Developers for land measuring 2 Bigha 9 Biswe 2 Biswasi and 1 Bigha 0 Biswe sale deed made on 11.10.2023.
The project proponent has submitted the Change of Land Use letter issued by Competent Authority-Cum-Additional Deputy Commissioner, (Urban Development), SAS Nagar Vide No. CLU/ADC(UD)/S.A.S.Nagar/2023/4984 dated 13.09.2023 regarding transfer of CLU Memo No. PB/CLU/SAS/ZIRAK/2999 dated 28.03.2023 in the favor of M/s Luxe Lanes Developers for Residential Colony (Plotted).
Water Pollution:
The project proponent has submitted feasibility report, as per which the total population of the project is 347 persons. The total water requirement of the project is 43 KLD which will be met through Submersible. The project proponent will install STP of capacity 40 KLD based on MBBR technology to treat the domestic effluent @ 33 KLD generated from the project. About 33 KLD of wastewater will be generated and the season wise disposal arrangement is as under:

The solid waste generated in the project after completion will be mostly domestic waste @ 132 kg/day. Necessary arrangements for segregation and collection of solid wastes shall be made at source. The recyclables like paper, plastic, tins etc. will be sold to authorized venders and the Municipal solid wastes will be treated through composter having capacity 60 kg/day. Thus, there will be no problem of solid waste from the project.
Air Pollution:
The project proponent has not proposed to install any D.G set, as such there is no other source of air pollution.
Applicability of EIA notification dated 14.09.2006:
As per the application form and site plan submitted by the project proponent is a Area Development Project. As the total plot area is less than 50 hectars, it is not covered under category 8-A of the EIA notification dated 14.09.2006 and not required to obtain prior Environmental Clearance.
Visit:
The site of the project was visited by AEE of this office on 23.02.2024 and during visit, it was observed that:
1. The site is having 56 Residential Plots & 7 EWS Plots.
2. The project proponent has started leveling of roads etc.
3. As physically observed, the distance of the proposed site from the various approved existing operational industries / units (for which specific siting guidelines has been issued by the Board for time to time), is more than the required distance as per the siting criteria given as under:

The site is complying with general siting criteria as per policy dated 30.04.2013 and specific sitting guidelines as per the Department of Science, Technology, Environment, Government of Punjab notification no. 3/6/07/STE(4)/2274 dated 25.07.2008.
4. The project proponent has submitted the approved site plan from competent person.
Recommendations:-
In view of the above, it is recommended that Consent to Establish (NOC) from pollution angle under the provisions of the Water (Prevention & control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted for one year with subject to suitable conditions and following additional conditions that:
1. The project proponent shall comply with the conditions of the CLU granted vide Memo No. PB/CLU/SAS/ZIRAK/2999 dated 28.03.2023 and further transferred on 13.09.2023.
2. In case, there is any change in the approved plan submitted by the project proponent with the CTE application at the time of approval by Competent Authority or otherwise, then the project proponent shall apply to the Board for revised CTE before starting any construction / development activities at the site.
3. The CTE/NOC has been granted on maximum effluent discharge of 34 KLD and the project proponent shall be bound to obtain revised NOC from the Board, if, in future the effluent generation exceeds the consented discharge.
4. The project proponent shall only use treated water from STP Zirakpur for construction purpose and submit an agreement in this regarding within 1 month.
5. The promoter company shall ensure that the total built up area of construction being carried out by it or any different builders may not be greater than 20,000 sqm, otherwise the project as such is covered under category 8(a) of the schedule appended to the EIA notification and project proponent of the building and construction project is required to obtain the environmental clearance, failure which, the promoter company/builder shall be liable for action for the violation of EIA notification dated 14/09/2006.
6. The project proponent shall not provide any occupancy in the project without obtaining the prior permission / consents of the Board and is bound to make adequate arrangement for the disposal of treated domestic effluent before providing any occupancy.
7. The project proponent shall submit the complete drawing and design of the STP and its component at the time of obtaining consent to operate.
8. The project proponent shall place adequate no of bins outside its premises from where the Municipal Solid Waste shall be got lifted.
9. The project proponent shall properly handle and manage the solid waste as per the provisions of the Municipal Solid Waste Management Rules, 2016 and ensure that the solid waste is segregated into biodegradable and non-biodegradable components. The biodegradable component shall be treated by providing on-site facility to produce compost, which will be disposed of/reused in an environmentally sound manner and the non-biodegradable solid waste shall also be disposed of in an environmentally sound manner. The project proponent shall install mechanical composter for the treatment of wet biodegradable solid waste.
10. The project proponent shall also ensure that the hazardous waste and e-waste components of the solid waste shall also be segregated and the same shall be channelized to the authorized facility for such type of waste.
11. The project proponent shall comply with the provisions of the Construction and Demolition Management Rules, 2016.
12. The project proponent shall take adequate steps to the effect that the construction material of any kind that is stored at site shall be fully covered in all respects so that it does not disburse in the air in any form.
13. The project proponent shall ensure that all the construction material and debris shall be carried out in trucks or other vehicles which are fully covered and protected so as to ensure that the construction debris or the construction material does not get disburse into the air or atmosphere in any form.
14. The project proponent shall take all necessary steps to control the dust emissions to be generated from the construction activities of the project.
15. The NOC/ CTE has been granted on the basis of information filed by the project proponent and if, in future any information is found wrong, the Board has right to revoke the NOC/ CTE.
