File Note: Amoha Leaf: It is submitted that the project proponent had earlier filed application for CTE twice and the same were returned at scrutiny level citing one of the observations amongst other observations that: "1. The project proponent has submitted feasibility report of pollution control arrangement; wherein it has calculated water requirement for the project considering occupancy of 5 persons/ plot, which is not in line with the Department of Housing and Urban Development notification no. G.S.R. 144/P.A.11/1995/Ss.180 and 43/2021 dated 31.08.2021, wherein it has been specified that for calculation of infrastructure required for the project, the population of plotted development shall be counted @ fifteen persons per plot, hence the calculation of water pollution load as well as the disposal arrangements needs to be re-assessed by the project proponent." Now, the project proponent has again applied for obtaining consent to establish/NOC for the establishment of residential colony in an area of 114.21 Acres(462245.54 sqm) having 1077 residential plots(211062.45 sqm) and 209 commercial plots(18621.15 sqm), EWS- 22895.22 sqm, area reserved for future planning- 2850.21 sqm through online on OCMMS, with requisite documents. The RO had submitted the following report pertaining to the application filed by the project proponent:  In reply to the observations raised earlier the project proponent has submitted undertakings dated 12.12.2023, details of which is as under: It is informed that the company M/s Aggarwal Builders and Promoter is developing a residential project in the name of “Amoha Leaf” in the land area 114.21 Acres. Out of the Total land area 16 Acres have been owned by the Firm itself and rest of the land is acquired as per the Land Pooling Policy of Punjab Government issued by PUDA, Punjab. As per the Land Pooling Policy of Punjab Government issued by PUDA, Punjab the land has been acquired @ 98.21 Acres under Land Pooling which will be developed by us and the total development cost will be 46.92 Cr which is reflected in the Project report. It is further informed that under the Land Pooling Policy the earlier owner of the land from which the land has been taken will be provided with the developed land plots @ 50% of the saleable area/ acre of land pooled. (copy of the Joint Venture attached as per specimen) It is further submitted that if in future there is any change w.r.t. project cost of the project, the firm shall be responsible for payment of the dues, if any. In reply to the observations raised the PP has submitted undertakings dated 12.12.2023, details of which is as under: It is informed that the total green area within the project which will be used for utilization of treated effluent after treatment through STP will be 22267.86 sq.mtr(5.5 Acres). Further, consent letter from Smt. Jasvir Kaur w/o Sh. Harbhajan Singh will be 13 Bighe 10 Bisve in Khasra no. 4788(27-0) has been attached in the name of firm. Total consent Area = 4.60 Acres The total effluent generation at the peak load from the project will be 600 KLD The treated effluent will be disposed of into the green area developed as parks within the premises as well as the area to be developed as per Karnal Technology from the above mentioned consent area. The details of which is as under: Utilization capacity of park based green area 40 KLD per acre. Therefore, in 5.5 acres of green area to be developed as park, the utilization of treated effluent will be 220 KLD. Rest of the effluent @ 380 KLD can be easily disposed of in the 4.60 acres of land, which will be developed as per Karnal Technology and the utilization of the same will be more than 100 KLD per acre. Other than this, the treated effluent will also be utilized for reuse by the residents through dual plumbing pipe line provided in the project as per the guidelines of PPCB. The demarcation of the same has been attached as per the plan attached. The built-up area of the project is more than 1,50,000 sqm and is covered under EIA Notification, 2006 and the application for obtaining Environment Clearance has already been submitted through PRIVESH Portal. We have considered max. occupancy as 5 persons per household (Plot) for estimation of the water requirement as well as Sewage generation and accordingly 600 KLD of effluent generation has been estimated which will be maximum as per the present scenario of District Bathinda. I hereby undertake that in future if there is any extra generation of the effluent / modification in the pollution load, the same will be the responsibility of the project to provide adequate treatment as well as disposal facility of the same.  The project proponent has deposited NOC fee of Rs. 84500/- through online vide R.No. 113940208 dated 18.10.2023 against the proposed project cost of Rs. 58.64 Cr, which is adequate for one year.  It is also submitted that the Project has already applied for obtaining EC in the matter and the status report in the matter has already been sent to the SEIAA vide Board’s letter no. 2903 dated 22.9.2023.  The Project proponent has calculated maximum effluent generation as 598 KLD and has proposed to install 600KLD ETP based on MBBR technology. The PP has proposed that effluent disposal will be onto land for plantation (karnal technology-4.6 Acres) and gardening (parks 5.5 Acres). The PP has also proposed that the compost pits / bio-composter will be installed for disposal of bio-degradable waste. The proposal submitted by the PP is adequate in principle.  The project proponent has undertook that if there is any increase in pollution load there will be full responsibility of the PP to provide adequate treatment and disposal system.  The project proponent vide its undertaking dated 12.12.2023 has clarified that the land owned under project is 16 Acres and the Development rights of the land have been given by the Firm by the owners (on Joint venture under Punjab Land Pooling Policy) of the rest of the land against which the saleable plots as negotiated upon will be given to the land providers.  The site of the project proponent was visited by officer of Regional Office on 12.12.2023 and it was observed as under: - 1. The site falls in Residential land use zone of notified master plan, Bathinda. 2. No construction activity has been started at site and only boundary wall construction was going on. 3. The project proponent has proposed to generate maximum 598 KLD of domestic effluent from the whole project and has proposed to dispose-off its treated water for reuse in Flushing by dual Plumbing, gardening/ plantation in parks & onto plantation in green area to be developed as per Karnal technology which is adequate. 4. There is no rice sheller/BKO/HMP in 100-meter radius, MAH within 250-meter radius and air polluting industry within 100-meter radius of the proposed industry. 5. The project proponent has not proposed any DG set.  The project proponent has submitted the layout plan demarcating the green area being reserved for the development as per Karnal technology @ 4.6 Acres for disposal of the treated effluent and has submitted authentic proof for non-coverage of the project under EIA Notification, 2006.  The site of the colony is suitable for the establishment and proposal submitted by the project proponent is adequate as per the Water Act, 1974 & Air Act, 1981.  The RO had recommended that the Consent to Establish be granted to the project proponent for one year. Since, the project proponent had again filed application for CTE but the project proponent has still not resolved the aforementioned observation and again attached the same feasibility report wherein it has calculated water requirement for the project considering occupancy of 5 persons/ plot instead of 15 persons/ plot. In this regard, the project propoennt has submitted in reply that "We have considered max. occupancy as 5 persons per household (Plot) for estimation of the water requirement as well as Sewage generation and accordingly 600 KLD of effluent generation has been estimated which will be maximum as per the present scenario of District Bathinda. I hereby undertake that in future if there is any extra generation of the effluent / modification in the pollution load, the same will be the responsibility of the project to provide adequate treatment as well as disposal facility of the same." However, if the water consumption is calculated on basis of 15 persons/ plot as per applicable building bye-laws, the waste water thus generated shall be almost thrice the envisaged load of 600 KLD and the disposal arrangements proposed by the project proponent i.e. onto land for plantation (karnal technology-4.6 Acres) and gardening (parks 5.5 Acres), shall be inadequate to handle the effluent load. Therfore, it was proposed to refuse the application of the project proponent after affording an opportunity of Show Cause with notice to submit validated reply within 10 days. Accordingly, the project proponent was issued SCN for refusal of Consent to Establish of the Board under the Water Act, 1974 and Air Act, 1981 vide no. PBIP/PPCB/2024/4 dated 03.01.2024; in reply the project proponent has submitted an undertaking which is reproduced as under: “The total effluent generation at the peak load from the project will be 600 KLD However, if considering the effluent 3 times, the total effluent generation may be projected to 1800 KLD. The projected treated effluent will be disposed of into the green area developed as parks within the premises as well as the area to be developed as per Karnal Technology from the above mentioned consent area. It is informed that the total green area within the project which will be used for utilization of treated effluent after treatment through STP will be 22267.86 sq.mtr(5.5 Acres). Further, consent letter from Smt. Jasvir Kaur w/o Sh. Harbhajan Singh will be 13 Bighe 10 Bisve in Khasra no. 4788(27-0); Sh. Raj Kumar s/o Sh. Ashok Kumar having land 4 Bighe 3.5 Bisve bearing Khasra no. 4778(4-3.5); Sh. Inderjit Singh s/o Sh. Baldev Singh, Sh. Balwinder Singh s/o Sh. Keemat Singh, Sh. Sandeep Singh s/o Sh. Labh Singh will be 33 Bighe 10 Biswa bearing Khasra no. 4787min(22-7) and 4787min(22-7) has been attached in the name of firm. Detail of the land is as under- 1. Land of Smt. Jasvir Kaur w/o Sh. Harbhajan Singh will be 13 Bighe 10 Bisve in Khasra no. 4788(27-0) 4.60 Acres 2. Land of Sh. Raj Kumar s/o Sh. Ashok Kumar having land 4 Bighe 3.5 Bisve bearing Khasra no. 4778(4-3.5) = 1.43 Acres 3. Land of Sh. Inderjit Singh s/o Sh. Baldev Singh, Sh. Balwinder Singh s/o Sh. Keemat Singh, Sh. Sandeep Singh s/o Sh. Labh Singh will be 33 Bighe 10 Biswa bearing Khasra no. 4787min(22-7) and 4787min(22-7) Acres 11.218 Acres (41% of this area will be used) 4.57 Acres Total consents Area = 17.248 Acres (10.6 Acres to be used) The total effluent generation at the peak load from the project will be 600 KLD, however, in case if 1800 KLD is considered The treated effluent will be disposed of into the green area developed as parks within the premises as well as the area to be developed as per Karnal Technology from the above-mentioned consent area. The details of which is as under- Utilization capacity of park based green area 60 KLD per acre. Therefore in 5.5 acres of green area to be developed as park, the utilization of treated effluent will be 330 KLD. In 10.6 acres effluent will be utilized @ 135 KLD per acre having utilization capacity @ 1431 KLD. Further, there will be approx. 2 acres of line plantation along the roads of the project and effluent @ 40 KLD per acre will be utilized. Therefore, total utilization capacity will be @ 1841 KLD. It is requested to kindly consider the case for 600KLD effluent generation, however, the land area for disposal of 1800 KLD i.e., 3 times of 600 KLD considering 15 persons has been provided for disposal of projected 1800 KLD effluent.” The RO has commented on the reply submitted by the project proponent as under and recommended for grant of Consent to Establish for one year: “Sir, it is submitted that the industry was issued SCN for refusal of Consent to Establish of the Board under the Water Act, 1974 and Air Act, 1981 vide no. PBIP/PPCB/2024/4 dated 03.01.2024 alongwith opportunity to file the reply within 10 days. As such in reply to the SCN, the project proponent has submitted an undertaking regarding generation of effluent @ 600 KLD and installation of STP @ 600 KLD. However, the project proponent has provided the details of the land for disposal of effluent @ 1800 KLD, where by considering that if any extra effluent if generated, the disposal arrangements are adequate. As per the calculation given by the project proponent, the disposal arrangements seem to be adequate for disposal of effluent considering 15 persons per house hold. (Copy of the reply by the PP is attached.) Considering the reply by the project proponent it is recommended that Consent to establish/NOC may be granted to the project proponent for the establishment of colony in an area 114.21 Acres (462245.54 sqm) having 1077 residential plots(211062.45 sqm) and 209 commercial plots(18621.15 sqm), EWS- 22895.22 sqm, area reserved for future planning- 2850.21 sqm, with suitable conditions along with special conditions that” However, the project proponent has not submitted revised water balance in reference to one of the observations for which SCN was raised taking occupancy of 15 persons/ plot. As per the proposal submitted by the project proponent, total 10.6 Acre is reserved to be developed as per Karnal Technology, which shall be more than adequate. In consideration of the above facts and the report/ recommendations sent by RO; if approved, the consent to establish (NOC) from pollution angle under the provision of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to the project proponent for establishment of Residential Township Project in total land area of 462245.54 sqm or 114.24 acres, consisting of components as Residential Plots (in 211062.45 sqm, 1077 plots), Commercial Plots including 111 no. of commercial plots and 98 Booths (in 15569.53 sqm or 3.848 Acres) & one Clubhouse/ Community Centre in 7696.76 sqm or 1.90 Acres area, for one year i.e. upto 03.12.2024 (i.e. one year from date of application filing), subject to suitable conditions and the following additional conditions that: 1. This CTE is valid for establishment of for establishment of for establishment of Residential Township Project in total land area of 462245.54 sqm or 114.24 acres, consisting of components as Residential Plots (in 211062.45 sqm, 1077 plots), Commercial Plots including 111 no. of commercial plots and 98 Booths (in 15569.53 sqm or 3.848 Acres) & one Clubhouse/ Community Centre in 7696.76 sqm or 1.90 Acres area, only. 2. The project proponent shall develop its project strictly in accordance with the layout plan approved by the MC Bathinda alongside license no. 11/2023 dated 06.09.2023. In case, there is variation in built-up area/green area/ any other details in layout plan approved by the competent authority (if at any stage), then the project proponent shall get its revised layout plan approved from the competent authority as well as obtain fresh ‘Consent to Establish’ from the Board, for the said change. 3. The promoter company shall not start any construction activity at site without obtaining Environment Clearance under the EIA notification dated 14.09.2006 from the competent authority, to refrain from committing violation & action thereof under the Environment (Protection) Act, 1986. 4. In case, there is any change in components of the project such as total area, built-up area, water consumption, wastewater generation, solid waste generation etc. w.r.t. the Environment Clearance granted by the competent authority (if at any stage), then the project proponent shall obtain revised fresh ‘Consent to Establish’ from the Board, for the said change. 5. The promoter company shall install STP of capacity atleast 1500 KLD for the treatment of domestic effluent generated by the project proponent. 6. The project proponent shall provide necessary arrangements for usage of the treated effluent after STP for flushing purpose in accordance with Board order no. 315 dated 05.07.2018 and shall develop adequate Green/ Park Area to be developed witin premises (in 22276.86 sqm or 5.5 Acre area) for discharge of the treated effluent after STP @ 123 KLD – 40 KLD – 11 KLD during Summer-Winter-Monsoon Season respectively and only the remaining treated effluent shall be discharged onto proposed plantation area as per Karnal Technology in the area reserved of around 10.6 Acres (as undertaken by it). 7. The land restricted for development of plantation area as per Karnal technology for utilization of its treated effluent after STP i.e. 10.6 Acres, shall be developed inconsonance to the development of the project and the said land shall not be used for any other purpose. The project proponent shall be entirely responsible for the arrangement of additional land required for the disposal of treated domestic effluent, if any. 8. The promoter shall also not allow any occupancy in the project till the time adequate arrangements for wastewater treatment & disposal, solid waste handling & disposal are made as well as 'consents to operate' under the Water Act, 1974 & the Air Act, 1981 are obtained. 9. The promoter company shall submit the complete drawing and design of the STP and its component at the time of obtaining consent to operate. 10. The project proponent shall obtain permission from the PWRDA for the abstraction of ground water. 11. The project proponent shall utilize treated wastewater from nearby STPs for the construction purpose and shall submit an agreement in this regard within one month. 12. The project proponent shall provide separate water meter and energy meter for the STP and maintain record of the same on daily basis. 13. The promoter shall provide a buffer zone of green belt (dense populated trees with pleasant fragrance) around the sewage treatment plant, so as to reduce the effect of odour problem in its vicinity. 14. The promoter company shall explore the possibility of using treated domestic effluent for useful purpose such as construction work, sprinkling on dusty patches/roads, use in nearby construction activities etc. 15. The project proponent shall place adequate no. of bins outside its premises from where the Municipal Solid Waste shall be got lifted. 16. The project proponent shall properly handle and manage the solid waste as per the provisions of the Municipal Solid Waste Management Rules, 2016 and ensure that the solid waste is segregated into biodegradable and non-biodegradable components. The biodegradable component shall be treated by providing mechanical composter of adequate capacity to produce compost, which will be disposed of/reused in an environmentally sound manner and the non-biodegradable solid waste shall also be disposed of in an environmentally sound manner. 17. The project proponent shall obtain permission from MC, Bathinda for dumping the inert solid waste onto its authorized dumping site. 18. The project proponent shall also ensure that the hazardous waste and e-waste components of the solid waste shall also be segregated and the same shall be channelized to the authorized facility for such type of waste. 19. The project proponent shall comply with the provisions of the Construction and Demolition Management Rules, 2016. 20. The project proponent shall provide anti-smog guns in line with the guidelines issued by CPCB vide orders dated 21.09.21. 21. The project proponent shall take adequate steps to the effect that the construction material of any kind that is stored at site shall be fully covered in all respects so that it does not disperse in the air in any form. 22. The project proponent shall ensure that all the construction material and debris shall be carried out in trucks or other vehicles which are fully covered and protected so as to ensure that the construction debris or the construction material does not get disburse into the air or atmosphere in any form. 23. The project proponent shall take all necessary steps to control the dust emissions to be generated from the construction activities of the project. 24. The project proponent shall ensure that the vehicles carrying construction material and construction debris of any kind shall be cleaned before it is permitted to ply on the road after unloading of such material. 25. The project proponent shall provide mask to every worker working on the construction site and involved in loading/ unloading and carrying of construction material and construction debris. 26. The project proponent shall provide all medical help, investigation and treatment of workers involved in construction of building and carrying out construction material and debris related to dust emissions. 27. The project proponent shall install mechanical composter for the treatment of solid waste being a bulk waste generator. 28. The project proponent shall make use of alternatives of single use plastics (SUP) within its premises and will not use any SUP items banned in accordance with MoEF&CC notification no. G.S.R. 571(E) dated 12.08.2021. 29. The Punjab Pollution Control Board shall have the liberty to revoke this consent & take penal action against the industry/project proponent and its responsible/ concerned person(s), in case any information/document provided by the industry/ project proponent is found to be incorrect/false/misleading at any point of time. 30. The Punjab Pollution Control Board shall not be responsible for any financial liability and/ or any other liability of the project proponent, due to grant of this Consent to Establish.
