File Note: The application was scrutinized and it was observed that as per the record file, the industry has dismantled its earlier installed 2 no. of induction furnaces having capacities 5 T/Heat & 3T/Heat. Further, the industry has established new induction furnace of 8 TPH capacity at the site, without obtaining environmental clearance as required under the provisions of the EIA notification dated 14.09.2006. Thereafter, the industry had applied for obtaining varied consent to operate under the both Acts, which were returned by the Competent Authority of the Board with the request to resubmit the application after complying with the provisions of the EIA notification dated 14.09.2006. Now, the industry has again applied for obtaining varied consent to operate under the both Acts without obtaining environmental clearance as required under the provisions of the EIA notification dated 14.09.2006. However, the industry has submitted a document indicating that the State Environment Impact Assessment Authority (SEAC) has decided to postpone the decision on their case until they receive a response to certain observations. Among these observations is the fact that the consent to operate under both Acts, as submitted by the Project Proponent (PP), expired on 30/09/2023. The PP is required to provide a copy of the valid consent to operate in accordance with the Water (Prevention & Control of Pollution) Act, 1974, and the Air (Prevention & Control of Pollution) Act, 1981. However, as per Policy of the Board, the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 will be granted to the industry after submission of environmental clearance as required under the provisions of the EIA notification dated 14.09.2006. In this case, the Regional Office, Fatehgarh Sahib will take legal opinion from Senior Law Officer of the Board to determine if the industry can be granted consent to operate without the environmental clearance required by the EIA notification of September 14, 2006. As such, the application cannot be processed at this stage and if approved, the application may be returned, please.
