Sir, the industry was visited by RO on 02/08/2023 and it was observed that the industry was manufacturing plastic carry bags and operating its unit without consents of the Board.
Accordingly, the industry was given personal hearing before the CEE, Ludhiana on 18.09.2023 w.r.t notice to issue directions u/s 33-A of the Water Act, 1974 and u/s 31-A of the Air Act, 1981, wherein, it was decided as under:
1. The directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 be confirmed for closure of the industry and for disconnection of its electric connection.
2. The Environmental Engineer, Regional office shall ensure the compliance of above decisions and shall submit its report within 10 days.
In compliance to the directions, PSPCL has issued TDCO vide no. 166/101 dated 27.10.2023.
To verify the compliance, RO has visited the industry on 31.10.2023 and found that electric connection was found disconnected and the industry was not in operation.
Now, the industry has applied for obtaining 'Consent to Operate' under the Water Act, 1974 and Air Act, 1981 with requisite documents.
The industry was visited by RO on 13.02.2024 and it was reported as under:
1. The industry was not in operation during visit as electric connection of the unit was found disconnected.
2. The industry will manufacture Industrial Packing Material @ 300 Kgs/day by using raw material as Fresh Granules @ 300 Kgs/day.
3. The industry has installed 3 no. side sealing machines for manufacturing plastic packing material.
4. The industry has assured that it will not manufacture plastic carry bags in future.
5. It has submitted request letter, which is reproduced as under: “I assured you we will not do any violation against plastic carry bags rules further and kindly grant us the consents of Air and Water to operate the industry.
6. The industry falls under industrial mix zone as per Master Plan, Ludhiana and the subject cited industry being a green category unit can be allowed in the said area.
Vide e-note dated 22.02.2024, RO recommended that:
1. Fresh 'Consent to Operate' under the Water (Prevention & Control of Pollution) Act, 1974 may be granted for short term of six months with suitable conditions as per policy of the Board and special condition that the industry will not manufacture carry bags as well as any other product, which has been banned by the Govt. of Punjab vide notification no. 5/18/2016-4SS4/692728/1 dated 18/02/2016 and Ministry of Environment, Forest & Climate Change, Govt. of India vide notification dated 12/08/2021.
2. Bank Guarantee of suitable amount may be imposed on the unit as an assurance that the industry will not manufacture plastic carry bags and banned SUP and shal comply with the provisions of Plastic Waste Management (Amendment) Rules, 2022
3. Directions under 33-A of Water (Prevention & Control of Pollution) Act, 1974 may be issued to PSPCL authority for temporary restoration of electric connection for short period of six months.
In view of report of RO, it is recommended that :
1. Fresh 'Consent to Operate' under the Water (Prevention & Control of Pollution) Act, 1974 may be granted for short term of six months as proposed by RO.
2. Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 may be issued to PSPCL authority for temporary restoration of electric connection for short period of six months as proposed by RO.
