It is intimated that the subject cited industry was granted Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974 vide No. CTOW/Renewal/TRT/2018/8543597 dtd 27/09/2018 and under Air (Prevention & Control of Pollution) Act, 1981 vide No. CTOA/Renewal/TRT/2018/8543420 dtd 27/09/2018 for production of Raw/Sorted Rice @ 32 MTD (with drier), which was valid up to 30/09/2023.
Now, the industry has applied for obtaining varied consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981. as the partners namely Sh. Harinder Kumar, Smt. Rosy Aggarwal and Smt. Suman Aggarwal have voluntarily retired. The industry has filled online application form, uploaded latest C.A. Certificate, Compliance of previous Consents Granted and Retirement-cum-Partnership Deed dated 29/07/2023 comprising Sh. Anil Kumar Joshi, Smt. Mamta Joshi and Sh. Varinder Joshi as partners and Sh. Harinder Kumar, Smt. Rosy Aggarwal and Smt. Suman Aggarwal have voluntarily have voluntarily retired as partners.
The industry has deposited Rs. 50,900/- vide UTR/Ref.No. SDL142248117 dtd 11/10/2023 as consent fee under Air (Prevention & Control of Pollution) Act, 1981 (including Rs. 8400/- as Penalty for Consent expiry and Rs. 500/- as an application form fee). The industry has also deposited Rs. 50,400/- vide UTR/Ref.No. SDL142248599 dtd 11/10/2023 as consent fee under Water (Prevention & Control of Pollution) Act, 1974 (including Rs. 8400/- as Penalty for Consent expiry). The consent fee deposited by the industry is adequate up to 30/09/2028 under both Acts against the fixed assets of the industry below 2 Crores.
It is pertinent to mention here that earlier the Board has issued order vide no. CEE(HQ)F.No. 957/2016/59 dated 2/2/2016 regarding to grant of auto renewal consent to establish/consent to operate to the Orange & Green category industries. Now in continuation to above orders Board has issued fresh orders vide no. 329 dated 14/9/2023 regarding to Auto generation of renewal of consent to establish / operate / Authorization of any category of Small-Scale industries / projects / Health Care Facilities (up to 50 beds) and Hazardous Waste generating industries.
It is further intimated that the industry is complying with the provisions of Water Act, 1974 and Air Act, 1981. The industry falls in Orange category in the small-scale sector and competency to decide the case lies with the Environmental Engineer of the Board.
May if approved, the consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry for production of Rice/Sorted Rice @ 32 MTD (with drier) up to 30/09/2028 with suitable terms and conditions and with special condition that:-
1. The industry shall get its Air emission sample analyzed from Board’s Lab in the coming season.
2. The industry shall plant more trees around the boundary of the rice sheller within 03 months and shall submit the compliance of the same. |
